I have also talked to the developer and to the City Building Inspector after being advised that you had contacted the inspector and the Police Department. Eagan Ordinance Section 10.01, Subdivision 2A, prohibits storage of refuse on a residential dwelling premise.' However, this particular section would not be applicable to the lot next door to you due to the fact that a vacant lot is not a residential dwelling premise as defined by Subdivision 1. In addition, waste resulting from building construction is not considered refuse. Section 1021, Subdivision 1, does make it the responsibility of any owner of any lot or parcel of land to "remove all public health or safety hazards thereon"..- However, the Building Inspector did not find that there was a public health or safety hazard particularly since one would have to trespass on private property in order to be exposed to any danger there is. Therefore, I do not believe that there is a legal basis for demanding that the developer remwe'the pallets which, like many other developers, he intends to use as sidewalks to buildings under construction as we get into the wet and cold winter season. However, I did call the developer knowing that he has always been very cooperative with the City and his buyers. He has indicated that he will attempt to find a better site for storage of the pallets and remove them by November 14, 1983. Very truly yours, skk David G.
