Re: Right -of -Way Vacation Questions
Dear Mr. Kasat,
Recently, you made an inquiry into the City's Right -of -Way Vacation process and
how the process works. The purpose of your inquiry is in regard to the small
portion of right-of-way the City owns in front of your property, at the east end of
Cleome Ln. This is the piece of property that has been causing a dispute with
your next door neighbor for a number of months.
The City has a process for vacating public right-of-way and you would be within
your rights to make this request. I've attached a copy of the application that must
be filled out and submitted as the first step in getting the process started.
I would like to point out several key items and caution you about a couple more
should you choose to move forward with the process. First, as you will notice on
page one of the application; there is a $400 -processing fee that must be submitted
at the time of application. This is the minimum amount and has the potential to
increase if associated expenses increase while working through the process. This
fee covers, but is not limited to, staff time, attorney's fees and recording fees.
As noted on the application, a public hearing will be held and neighboring
property owners will be notified and allowed to speak at the meeting should they
so choose.
As stated in Exhibit "A" which makes up page three of the application, basically
stated, the vacation cannot create a land locked parcel. Upon review of your
situation, taking into account the information provided on the application, it is
doubtful that the vacation process would solve your problem. If the right-of-way
vacation is approved, the City does not determine ownership of the vacated area.
There may be legal questions as to who is entitled to take ownership of the
vacated property.
Keep in mind, this is a process that requiresa public hearing, City Council review
and approval and there are no guarantees whatsoever that your petition for
vacating will be approved. After reviewing the information I've provided, if you
wish to proceed with the- application please submit the requested. information to
