Several weeks ago, Mayor Blomquist had a discussion with you regarding
use of boulevards throughout the City by the public. I was asked by
Mayor Blomquist to research this matter and respond in a letter.
According the my review, boulevards are designed to indirectly assist .the
transportation of persons and things. Cities have the duty to keep streets
and highways reasonably safe for travei, and therefore boulevards are
used for the storage of snow and other maintenance purposes. Often, boule-
vards are used by utility companies to place certain dist:ibution lines
above or below ground for the purpose of providing utility service to
various residents.
In any case, the property owner holds the duty of maintenance for the
boulevards and has the degree of responsibility to keep the boulevards
and sidewalks in good, safe condition. A boulevard is not dedicated as
park land, to be used for recreational purposes such as.the playing of
softball, soccer, and other organized sports. The easement dedicated to
the City for the boulevard area is only intended to provide for the usual
customary boulevard uses as I have mentioned above.
Since the -property owner is expected to maintain his or her boulevard,
the City respects the rights of that property owner to determine the use
of the boulevard with the exception of the City's need for maintenance and/
or construction within the boulevard right-of-way.
