Dear Persons,
This is a written objection to the assessments totaling
$893.00 for lot $22 (10-84351-220-02) and $3962.40 for lot #23
(10-84351-230-02). I would appreciate your reconsideration of
these assessments for the followinq reasons.
1. Both lots slope toward the Southeast so drainage is to the
storm sewer system in Cloem Lane. Both lots were assessed as
draining into Cloem Lane at the time the area was plotted and no
construction or landscaping has been done on these lots before
Pilot Knob Road improvements were made. Pilot Knob Road was
raised in this area so any drainage into the Pilot Knob Road storm
sewer system would be a result of Pilot Knob Road construction and
not due to the lay of the land. Any runoff past lots 22 and 23
will come from Pilot Knob Road, Wilderness Run Fifth Edition,
Carlson Acres or the Evergreen Park Addition. These areas are
uphill from lots 22 and 23 and some have been landscaped to cause
more runoff towards Pilot Knob Road.
2. Prior to the improvement of Pilot Knob Road I attended a
meeting regarding possible assessments resulting from the proposed
improvements. At that time I requested that the driveway not be
included through lot 23 if it resulted in a special assessment. I
was assured that the Pilot Knob Road improvements would not result
in any special assessments to lots 22 and 23. I explained that
lot 23 has access to Cloem Lane via a driveway easement along the
East edge of lot 22. The driveway is not being used by lot 23 now
nor will it be used by this lot if it is developed. Lots 22, 23.
24 and 25 all have access to Cloem Lane. The driveway was the
access road to the property before it was plotted. I do not feel
I should be assessed for a driveway that was included in the
improvement when I requested it not be included if there was a
special assessment involved.
Please consider this information and adjust any possible
assessments to my properties accordingly.

Dear Property Owner:
As you are aware, you recently received a notice informing you of
a proposed special assessment for the above-referenced project that
would be presented to the City Council on July 10, 1990. Several
of you contacted City staff expressing concerns over the storm
sewer lateral assessments due to the fact that the proposed
assessable portion of your property drains into an existing system
rather than into the new assessable system installed under Project
466.
The City staff subsequently researched your concerns and confirmed
your contentions. As a result, the City Council accepted the
staff's recommendations and deleted the lateral storm sewer
assessment from the final adopted assessment roll for Project 466
as it pertains tn the lateral storm sewer assessment only. If you
had a proposed assessment for other types of improvements, they
were adopted and will remain. A revised assessment notice is
enclosed for your information.
We apologize for any unnecessary concerns created by this issue and
appreciate the manner in which it was brought to our attention so
that we could respond in a timely manner. Thank you for your
patience and understanding during this process.

on or before the 9th day of August, 1990, without interest at the Eagan Municipal Center.
If you pay after the thirty (30) day period but prior to October 15, 1990 interest will be
charged from July 10, 1990 to December 31, 1940. After October 15, 1990 the first years
installments cannot be prepaid and it includes interest from July 10, 1990 to December 31,
1991.
Any unpaid portion will be collected in annual installments of principal and intezest for
the next 10 YEARS on your future property tax statements which will be issued through the
Dakota County Auditor's office. The annual installments include interest at the rate of 9.0
PER CENT per year on the unpaid balance.
