Dear Mr. Starkman:
The required number of bathrooms is based on both public and
private occupancy of a space. Specifically, the Minnesota State
Building Code (Chapter 1305.1900) requires sanitation facilities
to be provided for each occupancy (or use) in accozdance with
Table 5-E. This requirement is in addition to the proviaions of
Uniform Building Code Section 705 as amended, of which you
referred to in your request.
Notwithstanding the above, it is our determination that your
proposal to provide one toilet facility should be aufficient
based upon the proposed use of said tenant space. Should the
useage of the bathroom or use of the tenant space change in the
future, additional sanitation facilities may be required to be
provided.

an exception to USC Section 3303 SUB.B in the case of
Davanni's Pizza and Hot Hoagies' plans £or Cliff Lake Center,
Sagan.
1. The managers at Davanni's are very involvec in the
preparation of food and serviring of oei'r cu.,toaar&.
C°fice time would be 1-2 hovrs per day maxim:;m.

close the door unless to spaak to anoLher emplvpea
for a short period of time.
3. There are two windows in the office. Onc fACes
toward the front counter area whe:2 we wauld have a
cash register operator. The other faces toward the
preparation area where there would be a number of
people working in the delivery area during business
hours or ia the food prep area during non-busy
hours. Our kitchens are small enough and noise
levels low enough that communication is virtually
immediate throrghe+i± the kitr.hen.
4. TNe satire shoppirg center ±s fi:e corinkled.
5. We have no kitchen equipment that has a high
incidence of fires (eg, deep fat fryers or grills).
We have only pizza ovens and cheese melters for the
hoagies. We have grown to eleven units in the Twin
Cities in 14 years and have never had a fire.
