We the undersinned are petitioning the City of Eagan to correct the
storm sewer problem in the $econ Hill Development. The problem exists
on and around the streets,.-froperties and homes on Covington Lane,
Covington court, and Covington Circle, within the Becon Hill Develop-
ment. The flooding that occured August 7th, 1984, and on several other
preceeding occasions, resulted in damage to several of the residents in
this Eagan area. Each time heavy rains occur basements are flooded,
yards and homes are damaged.
The purpose of this petition is to corrent thia problem. The current
storm sewer system is inadequate, due to no fault of the residents..
We feel the city should assume full responsibility for this situation,
and act immediately to correct the problem by installing an adequate
and proper storm sewer system in this area. The funding for this
installation should come from city funds, as it occurred through no
fault of the residents:

Dear Tom:
You have asked that I provide you with further clarification
and supportive information related to our request for de£erment
of assessments on Beacon Hill until October 1, 1981. I am
happy to respond. Hopefully, my observations will clarify and
substantiate the purpose of this request.
A brief background on the project and its make-up: In late
1978, Dunn & Curry entered into a development and purchase
agreement with Centex Homes Midwest. The contract provided
that Dunn F, Curry would build and sell a total of 192 finished
single family lots to Centex. The first phase (100 lots) were
to be completed and ready for purchase by July 1, 1979.
Simultaneously with the arrangement of the purchase, Dunn & Curry
entered into a development agreement with the City of Eagan re-
lated to the development of these 192 lots. This project was
known as Beacon Hill. The development agreement provided that
the developer would undertake all the grading work on the site.
The city, in turn, contracted to design and build all of the
public utilities and streets within the project.
Site grading and utilities for the model houses were done in late
1978. The bulk of the grading was completed by years end.
Construction in 1979 was a different story. As we all are aware,
the weather conditions of 1979 summer building season were dismal
at best. The utility work was to be phased but done all within
1979. What with the weather conditions, only Phase One was
able to be completely installed in the 1979 construction season.
The onset of the housing recession of last year coupled with
the slower pace of development activity has postponed the impact
of this project by a good year to 18 months.
Proposal: We have proposed to the city that in light of the
status of the project (which is still not complete in terms of
roads, sewers and final boulevard grading) that the levying of
assessments against all the utilities and streets in this pro-
ject be deferred for one year. We would propose that in the city's
so deferring this assessment that a commitment would be given now
by Dunn & Curry to accepting the assessments for sewer and water
effective the end of September 1981.
This offer is coupled with a commitment from us to pay by May
lst of 1981, the first year's assessments that would be due had
the assessments been levied this fall. We propose to enter an
agreement with the city backed up by a letter of credit in the
amount of the monies owed. We would agree with the city to the
stipulation of next year's assessments today.
Reasons for deferral: We have requested this delay in levying of
assessments ecause of a financing arrangement which will permit
us to lessen the extreme cost impact of this project that has re-
sulted from a year's delay. Initially, when we first contracted
with Centex to build and deliver these lots, we priced the product
at well below market. We did so at the urging of the city who
had given us the ability to deliver to the market some lower cost
lots. We committed by contract to Centex a price which reflects
a substantial savings. (The lots today of comparable size would
be selling for 40$ more than the contract price presently in force
with Centex.) This project is not part of out Title X financing
in Eagan. It was created and developed prior to that financing.
The present state of the project is that the first phase (100 lots)
have been sold to Centex. We, in turn, have received full payment
on those first lots. The second phase is due to close at the end
of March in 1981. A substantial amount of income from the first
sale is presently in escrow at our bank to cover the costs of the
utilities which are being installed.
The purchase agreement with Centex and their subsequent sales
agreements with individual home buyers requires that when pending
assessments become levied, those levied assessments must be paid.
However, while the assessments are still pending, only the obliga-
tion still exists on such assessments and the developer continues
to keep in force his letter of credit for the costs of the assess-
ments.

Dear Tom:
The following is background and a concept proposal which
we have advanced to your office regarding assessment pro-
cedure and payments on the Beacon Hill project.
On July 21st, I met with the City Director of Public Works,
Tom Colbert, and the Finance Director, Gene Van Overbeke to
discuss our proposal on levying the assessments for Beacon
Hill public improvements.
Our proposal to the city is that the city waive the public
hearings this fall on the assessing of the public improve-
ments that have been installed in Beacon Hill (storm sewer,
sanitary sewer and water), iye have asked that these assess-

This outline covers the major points of our proposal. We
would request that you give thorough consideration to this

7he Park Ccnmittee requested that the developrent subcannittee review the
three alternative sites presented in the Neighborhood 31 Study ard report
back to the Park Ccnmittee with their rearmmndation. The develogrent
oanrittee reoomended that the most northeastern site be the locatian for
the active area within Neighborhood 31.
4he Park Camittee then made the rewmpndation to acoept a cash.donation
on a per lot basis for the 191 lots within the Beaoon Hills plat. Rhe
cash ontribution should be at the currnnt rate in effect with the City of
Fagan and payable to the City at the time of final plat approval. The
reason for this re=mresidation was, there is a 15 acre area east of the
Beac.ron Hills plat which would appear to be more suitable for active park

The Dakota County Plat Commission met on November 7, 1978 to
consider the proposed plat of1E? ACO?. Said plat is adjacent
to Cliff Road or County Road 32 therefore subject to the Dakota
County Contiguous Plat Ordinance.
After review of the plat it was the opinion of the commission
that said plat does satisfy the obligations of the Contiguous
Plat Ordinance with the following exceptions.
There shall be a restricted access dedicated to the county of
Dakota on the final plat adjacent to said County Road No. 32.
On the preliminary plat that we received it was impossible to tell
exactly how wide the right-of-way was indedicated for County Road
32. If this is in fact seventy-five feet as the plat scales,

at a regular meeting held on Tuesday, August 7, 1979, a
clarification was made to allow a 30 foot setback for
Covington Lane located in the Beacon Hills Addition within

granted for all future residential construction on
Covington Lane within your addition per a 30 foot setback
instead of the normal 40 foot setback realizing Covington
Lane is a minor thoroughfare.

Dear Tom:
Would you kindly request the City Council at its next
meeting to authorize the city engineer to prepare the
final engineering documents for all of the utilities
and roads in our Beacon Hill development. This is re-
ferred to as Improvement Project 262.
At the present time, it is our intent to have the city's
engineers design the utility and street layouts. We then
propose to contract privately for the construction of all
these utilities and street improvements and to provide
under our Development Agreement with the city the neces-
sary letter of credits for us to undertake such work.
The only exception to our program will most likely be
that we will request the city to install the trunk water
main that will cross our property. Any final decision
on that will be forthcoming after the engineers have de-
signed and costed out that particular utility.
It is our understanding that we will be billed directly
by the city for the costs incurred on undertaking the
engineering work for this project. We are prepared to
accept such costs in the event.that the utilities are
eventually installed under a private contract rather by
the city and charged back by assessment to the project.
As time is of the essence, we would appreciate your
reviewing this matter at your earliest possible convenience.

Re: Beacon [-Iill Utility Improvement Project #262.
Dear Tom:
It is our understanding that the Beacon Hill utility
improvements for the above referenced project are to
be presented at a public hearing on Tuesday, January
16, 1979. We should like to go on record at this
time ef requesting that the utilities be approved and
that the city authorize the installation of utilities
to serve the model home area at the earliest possible
time. We are prepared to stand behind and guarantee
±he assessments that will be levied as a result of the
installation of these improvements.
We are requesting such installation at this time recog-
nizing that the final P.U.D. agreement has not been fully
executed. We should like te point eut, however, that
we have been working on the preparation of such a docu-
ment. The final plat for Beacon Hill is presently being
reviewed by the county and should be ready for final ap-
proval within the next two weeks. Ry installing the
initial utilities as part of the model homa program,the
project's builder will be in a good posture to begin its
full scale marketing early this spring. As the city is
probably aware, Dunn & Curry have a purchase agreement
for the entire subdivision with Centex Flomes Midwest, Inc.
This purchase agreement calls for the early delivery of
model homes so that the entire project may be markete3
this spring from the model home program.
As a result of these above conditions and in light of
the fact that we are finalizing both the final plat and
the Development/P.U.D. agreement, we would request that
the city authorize the installation of those utilities
to serve the model home sites at the earliest possible

Dear Tom:
This letter is to request that you place on the February
ZOth Agenda of the City Council the approval of the Final
Plat for Beacon Hill. A copy of the Final Plat has been
forwarded to the City Engineer by Mr. Delmar Schwanz, our
surveyor. We should also like the City Council to approve
at the February 20th meeting the Development/PD Agreement,
a draft of which :•ae have been working on with the City
Attorney, Mr. Hauge.
As part of our Final Plat approval, we hereby request that
the city so authorize the issuance of building permits for
model homes on Lots 1 through 8, Block 1, of Beacon Hill.
We propose that these building permits be issued for model
homes only with the stipulation that the houses would
neither be sold by the builder nor occupied by residents
until the utilities serving these houses have been installed
and approved by the city.

City Council denied the approval of the change on-ier petitioned for by your
Ccuq.any to pmvide sewer and water services to your proposed model hane area
in the Beacon Hills Addition. This change oYder was denied due to the fact
that no develognent agreement had yet been appmved and that the final plat
has not yet been approved for this parcel. It is my understancling that your
firm still wishes to continue with the oonstruction and placennent of these
utilities and will assimie the responsibility of paying 100% of ttle cost of
these installations.
For any utility or street construction that is being perfoxned by a private
party and not included as part of public iffproveuent project must meet certain
criteria before these facilities will be accepted for perpetual City maintenance.
1. Plans and specifications must be prepared by a pmfessional engineer
and sutnnitted to the City for approval prior to oonstruction being
i ni ti.ated.
2. Application must be made to the City Council for apemm;t for excavation
and fills Lmder existing Ordinance #8. A requiresrent of this perniit will
be the execution of a contract development agreement whereby the owner
agrees to bond for 125% of the estimated oost of the irrprovement proposed.
3. ?he condition of the develognent agrearent will be the submittal of a
one year, 100% warranty maintenance bond which shall run fran the date

The proposed subdivision, Beacon Hill, to be located in Eagan,
will consist of 191 single-family lots. The lots will sell for
$12,000 each.
Eagan's comprehensive plan has not been reviewed by the Metro-
' politan Council. The project is compatible with Eagan's
comprehensive sewer plans and the community has given this
project preliminary approval. Final approval from the City
Council is yet pending. The site is within the Metropolitan
Urban Service Area.
The proposed subdivision will be serviced by central sewer and
water and other services appear accessible to the site.
No major adverse environmental impact is anticipated. The
project will not meet the most urgent need in terms of providing
housing for low- and moderate-income persons and it will not diversify
housing cost or type of housing in Eagan.
Recommendation
The project involves no major conflict with areawide plans and
goals.

address at 8601 Darnel Road, Eden Prairie, Minnesota, 55344 (Buyer) and DUNN & CURRY
REAL ESTATE MANAGEMENT, INC:, with address at 4940 Viking Drive, Edina, Minnesota,
55435 (Owner).
W I T N E S S E T H:
wHERFAS, Owner, Buyer and the City have executed the Beacon Hill Planned De-
velopment Agreement (Agreement) dated February 28, 1979, regarding a Planned Develop-
ment in Eagan to be known as Beacon Hill (the Development); and
WHEREAS, Paragraph 13 of the Agreement provided that except for deviations
specifically permitted therein, building sethacks shall be those established by the
Eagan Zoning Ordinance attached thereto as Exhibit D; and
WHEREAS, neither Paragranh 13 nor the ilgreement in general specifically referred
to building setbacks along Covington Lane which is defined as a minor thoroughfare in
the Eagan Zoning Ordinanr_e; and
WHEREAS, the parties desire to amend Paragraph 13 of the Agreement to establish
building setbacks specifically applicable to all yards in the Development which have
frontage along Covington Lane;
NOW, THEREFORE, it is hereby agreed by and between the parties hereto as follows:
ARTICLE lAl.
AMENDMENT TO PARAGRAPH 13 (01)
lAl:l) Pargraph 13 (01) is hereby amended to read as follows:

"1.3). Building Setbacks - Building setbacks shall be those established by the
Eagan Zoning Ordinance attached hereto as Exh.ibit D, except that the following deviations
shall.be permitted:
(01) Setbacks along all public streets, except major thoroughfares but including
Covington Lane, notwithstanding the fact that said public street is a minor -
thoroughfare imder the Eagan Zoning Ordinance, shall be at least thirty (30)
feet from the abutting right-of-way line except where topography or the location of
existing trees require a lesser setback, in which case the setback may be re-
duced upon iuritten authorization of the Building Inspector to twenty (20) feet.
Any additional setback of less than twenty (20) feet shall require the approval
of the Eagan City Council." 1

Rod Hardy has contacted me regarding the Beacon Hill final plat. Accorrlina
to the developffient agreanent which he sutxnitted with the final plat, that it
only indicated a 30' setback on the collector streets within the subdivision.
According to the zoning ordinance, any street which has an 80' rightrof-way
should have a 40' setback. Haaever, it is not the case with the Beacron Hill
plat. Dunn & Curry are proceeding with the understanding that they only have
tA setback the 30' on the interior collectors within Beacon Hill. The Meadaalarxi
plat had the same type of situation alon_q Beaver Dam RDad which is also an 80'
wide interior collector. Zhe Planning Camdssion and Council granted a 10'
variance and allawed houses to be built within 30' of the right-of-,*ay. It
appears to me that the precedent has been set and maybe it is an ac3ni.nistrative
effort to get it in the minutes indicating that the interior collectors within
Beacon Hills kie allowed the same type of variance.

I am requesting that your firm make a final inspection of Beacon
Ai11 Court so that the city vill accept the court for perpetual
maintenance purposes. The stop boxes on all lots except 1 and 2
have been adjusted to finish grade. It is our intent to raise
the stop boxes on Lots 1 and 2 after we build houses on these
lots, thus avoiding damage during cons[ruction.
