2. Grantee shall not construct a roaduay within or upon the Easement Proper-
ty, except Grantee may, at its sole cost, construct a roadway constructed of a
pavement material known as "grass paver" or such other pavement material as
may be agreed to in writing by Grantors. The Grantee shall perform reasonable
maintenance within the Easement Property but shall not be responsible for
mowing such Property.
3. Grantors shall have the right, but not the obligation, at any time, and
from time to time, to construet a fenee or fences across the Easement Property
without the flarther consent or approval of Grantee. Provided, however, in the
event Grantors elect to construet such fence(s), Grantors shall construet a
gateway in each such fence to permit vehicle access by Grantee over and upon
the Easement Property. Grantor may install a lock to secure each gateway
which it constructs if Grantee is provided a key to each such lock. Grantee
shall be responsible for any damage to said fence resulting from Grantees
activities.
4. The easement, rights and privileges granted hereby shall be for the bene-
fit of and be restrieted solely to Grantee, but the same is not intended for
and shall not be construed as creating any right in or for the use or benefit
of the general publie.
5. The easement, rights and privileges granted hereby shall be used for the
purpose of hereinabove described and in such a manner as to cause the lease
possible interferenee with the use and en3oyment of the Burdened Property.
6. Grantors do hereby release Grantee from any claims whieh it may have as a
result of damage to the Easement Property by reason of the construction,
maintenance and use of the easement by Grantee in aecordance with the terms
herein contained. This release shall not be effective as to any damage to any
property, except the Easement Property.
7. Grantors hereby waive the right to any and all notice for the removal of
trees or hedges, if any, located within the Easement Property and any elaim
for damages to the Easement Property on aceount thereof.
8. The easements granted hereby and the covenants herein contained shall be
easements and covenants running with the land and shall inure to the benefit
of and be binding upon Grantors and Grantee, their suecessors and assigns, and
all persons elaiming under or through them an interest in the Burdened Proper-
ty or the Easement property.
9. Any breach or threatened breach of the prrovisions of this easement
agreement may be enjoined by an appropriate suit, action or proceeding which
shall be in addition and without limitation of any other remedy available at
lax or any equitable remedy based on or by reason of any such breach.
10. This easement agreement shall be construed in aecordance with the laws of
the State of Minnesota.
