COUNTY OF DAKOTA, a political suhdit:sion of the State of Minneseta, (hereinafter refened
to as "Landowner"), and the CTTY OF EAGAN, a municipal corporation, organized under the
laws of the State of Minnesota, (hereinafter referred to as the "City").
WITNESSETH:
That the Landowner, in consideration of the sum of One Dollar ($1.00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does
hereby grant and convey unto the City, its successors and assigns, a permanent drainage easement
to allow for [he construction of a drainage swale, over, under and across the following described

Commencing at the southwest corner of Lot 13, Block 1, Park
Ridge 2"6 Addition, Dakota County, Minnesota, thence easterly
along the South line of said Lot 13, a distance of 30.00 feet, thence

in which it was found prior to the commencement of such actions including the restoration of the
disturbed area with native plantings, save only for the necessary removal of trees, brush,
undergrowth and other obstructions.
The City shall be responsible for all costs associated with the conshuction and
maintenance of the drainage swale.
And the Landowner, its successors and assigns, does covenant with the City, its
successors and assigns, that it is the Landowner of the premises aforesaid and has good right to
g-ant and convey the easement herein to the City.

Authorization To Execute Easement Agreement With The City Of Eagan For Construcfion And Maintenance
Of Water Management Swale in Lebanon Hills Regiortal Park
WHEREAS, the Lebanon Hilis Regional Park borders private property along Covington Lane within the City of
Eagan (city), Mirtnesota; and
WHEREAS, water runoff from Lebanon Hills Regional ?ark spong snowmelt currently pools on frozen ground in the
private backyards of 1851 and 1855 Covington Lane, before discharging overiand; and
WHEREAS, ciiy and Dakota County Parks Depaftent staff have met with cif¢ens residing in the affected and
adjacent addresses to discuss solution altematives; and
WHEREAS, the city prepared an engineered plan which proposes a dreinage swale to intercept and divert flows
away from the affected houses; and
WHEREAS, the preferred location of the drainage swale is inside the boundaries of the Lebanon Hills Regional
Park; and
WHEREAS, the construction of the drainage swale presents an opportunity for ecological restoration of ttie area
disturbed by construction at no expense to the County; and
1NHEREAS, th>re is no nagative impact to"recreational use of the park; and
WHEREAS, the city has requested that Dakota County grant the city an easement to allow for the maintenance of-
the swale and has agreed to be responsible for all costs for design, construction, land restoration, and on-going
maintenance; and
WHEREAS, an easement agreement is required to allow the city to construct and maintain the swale within -
Lebanon Hiils Regional Park.
NOW, THEREFORE, BE IT RESOLVED, That the Dakata County Board of Commissioners. hereby authorizes the
Counry Board Chair and the Clerk to the Board to execute an easement with the City of Eagan to construct and
maintain a drainage swale in Lebanon Hills Regional Park adjacent to 1851 and 1855 Covington Lane, including the
restoration of the construction site to native vegetation, subject to approval by the County Attomey's Office as to
form.

swale construction on Lebanon Hills Regional Park (LHRP) property by Eagan residents
to improve spring runoff pattems in the backyards of 1851, 1855 & 1859 Covington
Lane.
Historv of the Situation
As you are awaze through conversations with the affected residents and vazious County
and City stafF, spring snowmelt from LHRP and area properties currently pools on frozen
ground in the backyazds of 1851 and 1855 Covington Lane, before dischazging overland
toward the 1851 and 1859 Covington properties. This discharge has caused house
property damage to both residences on more than one occasion.
This past spring, your staff, Mr. Mike Adams in particulaz, kindly facilitated a meeting
between the residents of 1851, 1855, and 1859 Covington Lane, and personnel
representing Dakota County, in an attempt to resolve the situation. City staff was also in
attendance for technical support if needed. At the meeting, Mr. Adams stated the
County's position that it the LHRP and its drainage patterns existed before the residents'
houses were built, and that the current drainage issue should be resolved on their
properties. All parties left that meeting feeling that the issue could be resolved by a
drainage swale on the private properties, with some plan assistance from the CiTy.
Subsequent to that meeting, the property owners at 1855 Covington Lane chose not to
participate in the solution by not allowing construction on their property. Unfortunately,
an adequate drainage swale to address the problem cannot be built on private property
without conshuction on the 1855 property.
Requested Construction/ Easement
This leads to the City's request for Dakota County's consideration of construction of the
swale on LHRP property, without afFect to the 1855 property. A sketch of the proposed
swale grading is attached. The grading required will be minor, averaging approximately 1
foot in depth, with the deepest excavation at 1.5 feet to 2 feet. The swale will direct water
westwazd to a location where it currently dischazges, but slightly changes the route in
which it takes. Instead of being directed in the backyazds very near the houses, the
drainage will be maintained within LHRP properiy longer before dischazging to an
existing ravine which leads into properties further west along Covington Lane.
Also, the requested easement document creating public easement over the proposed swale
in favor of the City for its future maintenance will be forwazded under separate cover, for
the County's consideration.
If approved by the County, the 1851 and 1859 Covington Lane residents plan to hire a
contractor to complete the work this fall, under the inspection of City staf£ Since this
property will be covered by a City easement, a City permit to work in easement will be
required and administered. Disturbance to LHRP will be restored to the County's
satisfaction. It is estimated that the excavation work will be completed in one day, with
restoration also completed in one day.
