Historv of the 5ituation As you aze aware through conversations with the affected residents and vazious County and City staff, spring snowmelt from LHRP and azea properties currently pools on frozen ground in the backyards of 1851 and 1855 Covington Lane, before dischazging overland toward the 1851 and 1859 Covington properties. This discharge has caused house property damage to both residences on more than one occasion. This past spring, your staff, Mr. Mike Adams in particular, kindly facilitated a meeting between the residents of 1$51, 1855, and 1859 Covington Lane, and personnel representing Dakota County, in an attempt to resolve the situation. City staff was also in attendance for technical support if needed. At the meeting, Mr. Adams stated the County's position that it the LHRP and its drainage patterns existed before the residents' houses were built, and that the current drainage issue should be resolved on their properties. All parties left that meeting feeling that the issue could be resolved by a drainage swale on the private properties, with some plan assistance from the City. Subsequent to that meeting, the property owners at 1855 Covington Lane chose not to participate in the solution by not allowing construction on their property. Unfortunately, an adequate drainage swale to address the problem cannot be built on private property without construction on the 1855 property. Requested Construction/ Easement This leads to the City's request for Dakota County's consideration of construction of the swale on LHRP property, without affect to the 1855 property. A sketch of the proposed swale grading is attached. The grading required will be minor, averaging approximately 1 foot in depth, with the deepest excavation at 1.5 feet to 2 feet. The swale will direct water westwazd to a location where it currently discharges, but slightly changes the route in which it takes. Instead of being directed in the backyazds very near the houses, the drainage will be maintained within LHRP property longer before discharging to an existing ravine which leads into properties further west along Covington Lane. Also, the7equested easement document creating public easement over the proposed swale in favor of the City for its future maintenance will be forwarded under separate cover, for the County's consideration. If approved by the County, the 1851 and 1859 Covington Lane residents plan to hire a contractor to complete the work this fall, under the inspection of City staf£ Since this property will be covered by a City easement, a City permit to work in easement will be required and administered. Disturbance to LHRP will be restored to the County's satisfaction. It is estimated that the excavation work will be completed in one day, with restoration also completed in one day. If a water heater does lime up, a cracking and rumbling noise may be heard when the burner is activated on the water heater. This noise does not mean it is not safe to operate. Here we go. irJ The Tramonte's property (1859) abuts Lebanon Hills, and several properties east and west of the Tramontes handle drainage from the park. Runoff from a north-facing slope pools in the Chodek's yard (1855) and overtlows toward the southeast corner of Tramonte's house before flowing west in the backyards of numerous houses before reaching Pond BLP-3 within Lebanon Hills. Neither of the properties were graded in accordance with their lot surveys from 1985. It is apparent that the grading was changed in the field in an attempt to reduce amount of grading and to save some trees at their common property lines. I met with Mr. Tramonte back in 2000 regarding backyard drainage and grading and the storm's impact to his house. Since his house damage was relatively minimal, he didn't want to pursue City involvement in a solution. He performed some drain tile work and regrading on his back and side yards: This has performed well until this past week. With the freezing and thawing, runoff from the Chodek's made its way over the berm the Tramontes had created and into their house, causing some carpet damage. Mr. Tramonte stopped in yesterday morning, and I visited his house yesterday afternoon. There is a steady stream coming from the park and the Chodeks from the rapid snow melt of the past few days. I told him that there are three properties involved, and the City is not one of them. I did not offer any City involvement besides possible solutions. A relatively easy solution I offered to Mr. Tramonte was to grade an overland swale from the low area on the Chodek property line with the park to the west about 150 feet, within park property, where there is a natural ravine to take the water west to BLP-3. There is very little vegetation that would be impacted. I offered to contact the County to help gain permission for the property owners to perform this grading. Lane and Russ had previously put Mr. Chodek in contact with Mike Adams from County Parks. There is a meeting with them on April 7 to discuss solutions. I will make Mr. Tramonte aware of this meeting and attend on behalf of the City. From what I hear, the two residents don't get along, hence the police involvement. As Covington Lane Turns.
