adjacent propeRy at 1855 Covington Lane. After five years of ineetings with neighbors affected by
the water, and meetings between the City of Eagan and Dako[a County Parks we have finally
obtained a soluCion.
The four neighbors that were direcdy affected by the cunoff can finally put behind them, the unrest
that has been caused over the years. After the last meeting on Apri14, 2005 between the City of
Eagan, Dakota County Pazks, Patrice Rosinbaum, Rick Chodek, Julie Chodek, my wife Laur& and
myself, we thought we might have a solutioa Unfortunately, as it turned out the Chodek's refused to
participate once again. At this point you could have easily dropped the process and moved on, but
along with Mike Adams and his people at Dakota County Pazks you stayed with it. We appreciate the

Dear Mr. Sullivan:
Please consider this letter as a request for consideration by Dakota County of a drainage
swale construction on Lebanon Hills Regional Pazk (LHRP) property by Eagan residents
to improve spring runoff pattems in the backyards of 1851, 1855 & 1859 Covington
Lane.
Historv of the Situation
As you are awaze through conversations with the affected residents and various County
and City staff, spring snowmelt from LHRP and area properties cunently pools on frozen
ground in the backyazds of 1851 and 1855 Covington Lane, before discharging overland
towazd the 1851 and 1859 Covington properties. This discharge has caused house
property damage to both residences on more than one occasion.
This past spring, your staff, Mr. Mike Adams in particular, kindly facilitated a meeting
between the residents of 1851, 1855, and 1859 Covington Lane, and personnel
representing Dakota County, in an attempt to resolve the situation. City staff was also in
attendance for technical support if needed. At the meeting, Mr. Adams stated the
County's position that it the LHRP and its drainage patterns existed before the residents'
houses were built, and that the current drainage issue should be resolved on their
properties. All parties left that meeting feeling that the issue could be resolved by a
drainage swale on the private properties, with some plan assistance from the City.
Subsequent to that meeting, the property owners at 1855 Covington Lane chose not to
participate in the solution by not allowing construction on their property. Unfortunately,
an adequate drainage swale to address the problem cannot be built on private property
without construction on the 1855 property.

Repuested Construction/ Easement
This leads to the City's request for Dakota County's consideration of construction of the
swale on LHRP property, without affect to the 1855 property. A sketch of the proposed
swale grading is attached. The grading required will be minor, averaging approximately 1
foot in depth, with the deepest excavation at 1.5 feet to 2 feet. The swale will direct water
westward to a location where it currently dischazges, but slightly changes the route in
which it takes. Instead of being directed in the backyards very neaz the houses, the
drainage will be maintained within LHRP properiy longer before discharging to an
existing ravine which leads into properties further west along Covington Lane.
Also, the requested easement document creating public easement over the proposed swale
in favor of the City for its future maintenance will be forwazded under separate cover, for
the County's consideration.
If approved by the County, the 1851 and 1859 Covington Lane residents plan to hire a
contractor to complete the work this fall, under the inspection of City staf£ Since this
property will be covered by a City easement, a City permit to work in easement will be
required and administered. Disturbance to LHRP will be restored to the County's
satisfacrion. It is estimated that the excavation work will be completed in one day, with
restoration also completed in one day.

Enclosed is a subpoena duces tecum requesting documents that the City may have in regard to the
Super Flood of 2000 that relates to 1859 Covington Lane and 1855 Covington Lane and other
information it may have regazding disputes between the parties. This oftice represents Joseph and
Laura Tramonte in a lawsuit against the Chodeks in which my clients have made several allegations
against the Chodeks for damages they have suffered due to their conduct and behavior. My clients
have filed the lawsuit in Dakota County District Court, Court File No. 19-C2-06-7025, and the
parties are now involved in the discovery phase of this litigation. After speaking with my client, I
understand there have been ongoing meetings and correspondence between the Chodeks and the City
of Eagan regarding the Super Flood of 2000 as well as other real property disputes that Mr. Chodek
alleged. One of the main issues in this lawsuit is a boundary dispute that has arisen between the
Chodeks and the Tramontes whereby Mr. Chodek removed several trees on Mr. Tramonte's property,
claiming that the boundary that had existed between the parties for years had somehow changed and
the trees?hat Mr. Tramonte had planted were on Mr. Chntlek's property.
One of the things we are trying to leazn in this lawsuit is whether Mr. Chodek ever mentioned or
alleged to the Ciry of Eagan that there was a boundary dispute between t:ne parties and whether the
City has any information as to an alleged boundary dispute between the Tremontes and the Chodeks.
It is our position that the boundary has been well established and demazked for years and this was
an attempt by Mr. Chodek to enact some revenge against Mr. Tremonte for reasons that are unknown
at ihis rime.
The subpoena I have enclosed includes the entire file the City of Eagan may have as it relates to the
Super F'lood of 2000 and any information regarding the addresses of 1855 Covington Lane, Eagan,
Minnesota, and 1859 Covington Lane, Eagan, Minnesota. In addition, I request any and all

documents the City may have regarding any further correspondence that Mr. Chodek may have made
to the City regarding any other disputes with Mr. Tramonte or any other neighbors with whom Mr.
Chodek may have had disputes.

required for any of these documents, please so advise me and I will forward a check to cover those
costs for the Ciry of Eagan at the same time I pick the documents up from the City.

Fees to be paid ro wimesses shall be as follows (Minn. Stat. § 35722):

• For roundtrip travel estimated from the wimess's residence at 28 cents per mile. If a witness lives outside the state, travel
costs shall be estimated from the bouridary line of the sta[e where Ihe wimess crossed into Minnesota at 28 cents per mile.
(Additional fees may be available for out of state witnesses).
In any proceeding where a parent or guardian attends the proceeding with a minor witness and the parent or guardian is not a
witness, one parent or guardian shall be compensated in those cases where wimess compensation is mandatory under Minn. State. §
357.22, and may be compensated when compensation is discretionary under those sections. No more than a combined total of $60
