Ridge 2nd Addition, I have enclosed a sheet of the approved grading plan and a copy of the plat showing James Fluqaur's lot. " As shown on the plat, James Flugaur's lot has a substantial ponding and drainage easement. This is to accommodate the pond and storm sewer system draining a portion of this development. This pipe and easement was in place at the time he purchased this lot, although he may not have been aware of the outlet due to the contractor filling over the pipe. The flared end has since been uncovered in order to restore drainage which, in.turn, disrupted Mr. Flugaur's plans for his backyard. He apparently did not realize the easement was there, much less what an easement actually was. At this time, I believe he understands that the pipe will have to remain in place, but will not be happy unless the City regrades his yard to his satisfaction. Firat, I would like to thank you £or the concern and cooperation you have ahowen me in the past. When I purchased this lot I was not in£ormed that there was a atorm sewer outlet on my land or that the swamo would be extended into my land and an easement would extend even £urthur into the property I purchased in good £aith. When I purchased this lot the swamp was 75 £eet £rom my lot line. Now the swamp has been extended to the outlet of the strom sewer pipe cauaing a 9 foot deep 90 foot long ditch £ull o£ water. Thuraday o£ this week my £ather and I calculated that the preaent ditch construction is already 15 £eet into my land. It appeara that the completed project would probably uae another 20 £eet o£ my backyard. The land that ia af£ected is choice backyard area. 2 do not want any of my land used £or a retaining wall, skirt or any other use that will de£orm my property or eliminate choice backyard area. The soloution that is currenty planned is totally unacceptahe from the atand point of my inveatment, to say nothing about the potential saftey hazard to my chlldren and the children o£ the community, 2 am convinced there are better, and pro6ably less expensive ways o£ sloving the existing problem. I inquired ahout the possiblilty o£ diverting and extending the storm sewer pipe directly into the swamp. This plan would aerve to solve all o£ the above mentioned problems. I have been in- formed that it ia legal to change the direction o£ a atorm aewer pipe by using an expoaed manhole. To help solve the probleme o£ this community, I am willing to except an exposed manhole on my property groviding the storm pipe is completely burried. I believe this method of solving the storm sewer problem would be £air to all and in addition it would: 1. Probably be lesa expenaive. 2. Eliminate the saftey hazard o£ the previous plan. 3. The city will not have to purchase or rent any o£ my land to build the retaining wall or skirt. 4. My lot and the lot adjacent to mine would be o£ greater value. 5. The storm sewer water would be directed to the main body o£ the swamp with out cutting into property purchased in good £aith. 6. The general appearence of the neighborhood would be improved. I have mentioned this plan to Craiq Knudsen but he rejected the idea. I am asking that another atudy be done to assure that a solution is £ound that ia equitable to all concerned. Also, I cannot be held responaible £or the continuing sa£tey hazard that currently exiata. 2 have previoualy (November 1985) notified Mr. Craig Knudaen, an Eagan Engineering Technician, that a saFtey hazard preatently exists. There haa been no fence or any type o£ warning as to the present dangeroua condition.
