Mr. Voels: I have field verified that all fire dampers and combination fire/smoke dampers were ?..? installed by the Contractor at a11 loeations indicated on the ConTract Drawings. Installation was performed in accordance with all govcming codes, SMACNA Standards fONSULIING EXGINEEAS and manufacturer's recommendations. Testing of the combination smoke/fire damper operation will be performed and verified by Simplex Company when they test their firc alarm system installaUOn. Fire alarm system testing may be witnessed by a representative of che local fire departmcnt. Fire damper operation is not usually tested because damper closure is from a"fire link" similar to , the operation of sprinkler heads. Fire dampers are provided with an integral factory sleeve which is field installed with duct connections and access panels. Unless the sleeve is bent, factory tesung should be sufficient to confirm damper operation. October 22, 1997 Mr. Joe Voels, Conshvction Analyst City of Egan 3830 Pilot Knob Road Egan, Minnesota 55122-1897 Re: Building Code jurisdiction on Claire Bridge and Woven Hearts projects which are propc;sed and being built by Alternative Living Services within Minnesota. Dear Joe, We have been asked to document whether the State Building Codes Division is the jurisdiction for Building Code enforcement under Minnesota Statute 16B.61 on these projects. The use of "State Licenced Facilities" in MN16B.61 as defined in MN1613.60 Subd. 11. "..means a building and its grounds that are licenced by the state as a hospital, nursing home, supervised living facility, free-standing outpatient surgical center, or correctional facility." At our meeting Mr. Alexender presantad a well thpught through UBC compliant dasign, but noted some rescrictions under the UBC which he felt negatively cfficted somc of the progrnnt sg&ce, compared ta how it was allowed to be built many times under the BOCA code. We discussed with him mechaniBinS wnder the USC to eliminate portions of rate3 aorridors and it was within this discusalon that we discussed the classifioation and oacupancy separation of the centez portian of 1'he building. The largast portion of this area, as presented to us, would be adruinistrative and associated circulatinn, in addition, there is a'streeC' cotridor of 'storefronrs' to pmvide some generic servires. ie. beauty shop and sweets shops. Use of these generic services would not be unlike these residences being buseed to a local str.ip mall or restaurant: the strip mall ar reatautant would nvt become an'I' or'R' occupancy based on use hy these residences. Therefore, the 'mbreet' portion of this area can be a'B' aaoupanay, which is a portion of this predominentty administrakive use area. The reasons as [ understand them are as follows: This facility must be licensed with the State (State Statute 1302.0400, Subp. 7) or must have bathing and cooking facilities provided in each individual living unit to qualify as "senior housing" (and not be required to obtain State licensing). 2. Please contact Chuck Olsoo directly at (612) 215-0856 for clarifications I also became aware today that on July 30, 1997, Dale Schoeppner, Senior Inspector for the Ciry of Eagan, met with Michael McGovern of your office and requested that a letter from the State be submitted to us verifying licensing requirements for this building. To my knowledge, we have not received any such letter as of this writing. Based on the above discussion, and as I stated to you on the telephone today, no plumbing activiry (i.e. underground rough-in, site plumbing, etcJ may occur for this project until a plumbing pemtit is issued. Said plumbing permit will not be issued before above stated issues have been resolved. [f you have any further questions or I can be of assistance to you, please feel free to contact me at 681-4683. BOND RELEASE (GRADING AND FILLING) LOT 1, BLOCK 1, PILOT KNOB HEIGHTS FIRST ADDITION This permit was issued by Council action August 1, 1978. The permit was issued to fill a former gravel mining pit that had not been required to be regraded. This was done with excess earth material from the Duckwood and St. Francis Wood additions. Ordinance 8, Section 8.05, Subdivision 10: Ceasing Operations requires minimum finished slope areas of 3 horizontal to 1 vertical. 8.05, Sub- division 17: Topsoil requires topsoil or other approved cover to minimize erosion. 8.06, b., permits the Council to impose any necessary controls deemed necessary before or after the granting of the permit to protect the Public from danger and erosion or unsafe conditions. At this time there are some short slopes that are steeper than 3 to 1 and no cover to minimize erosion. The proposed future development is the reason given for not spreading topsoil and reseeding the site. DSP:tlp C:: - xlv?ti. The Eagan facility, Alterra Clare Bridge of Eagan, is marketed as a"memory cate ceater" which specializes in elderly residents who have memory disorders such as Alzheimer's disease. Consumers pay between $3,400 to $4,000 per month to live at Alterra. The suit alleges that Alterra misrepresented to consumas that it would: •. Have nursing staff available 24-hours per day; • Provide a staff/resident ratio of one staff inember for every 7 residents; . Provide necessary staff for dressing, grooming> nutririon needs, bathing and recreational services; employ a staff specifically trained to work with memory-impaired individuals; . And, that the staff provides "life enrichment activities" tailored to a residenY s needs. • Alteira's brochures and staff addirionally represented to fatnily members that the Center can provide all necessary hospice caze "to the end," if necessary. -More- Faaimile: (651) 297A193 • TPY: (651) 297-7206 • To1113ee Linwa: (BOD) 657-3797 (Voice). The Deparhnent received a telephone call from Fairview Ridges Hospital saying that it was unable to contact anyone at Alterra to inquire about one of the center's patients who was admitted to the Hospital on January 1, 2000 as a result of an ambulance call. The Eagan Police then went to Alterra, but were unable to enter the building because it was locked. After pounding on the door for some rime, Alterra's cook, who could not coherently speak English, answered the door. The cook told police officers she had not been shown how to use the telephone. The police then inspected the premises and found two other staff people at the facility, neither of whom could speak English very well. The Eagan Police Depattment advised the Attorney General's Office that in 1999 it had received over fifty 911 calls finm Alteira, the bullc of which were requests to assist the facility's staff in giving service to the residents. Based upon affidavits from family members of residents, a former employee and the police department, there aze a number of allegations of patient neglect. In addition to filing a civil complaint, Attomey General Fiatch also seeks a temporary restraining order to require that Alterra provide services as represented in the brochures and to adequately pmvide care to the residents. The Attorney General notes that Alterra is not licensed as a nursing home, but rather operates as an "assisted living facility." The morion for Temporary Restraining Order seeks the appoiniment of a third party to oversee the operation of Alterra in order to assure that minimum standazds of caze aze being administered to the residents. T'he facility is located at 1365 Cresh-idge Lane, Eagan, Minnesota. -30- PLEASE NOTE: A summary af a,fJSdavits from concerned family rnembers regarding treatment af Alierra Ctare Bridge Facility in Eagan is aitached to this press release Please contact Leslie Sandberg @(65I)Z96-2069 if there is interest in interviewing family Members ofAlterra residents. 03/07/00 1'UE 12:04 [T%/R% NO 93161 0:1:07/00 13:02 FAX 651 282 5801 MN MFCU AGO 191004/005 Snmmary of Affidavits From Concerned Family Members Regarding Treatatent at the Alterra Clare Bridge Facility 1. A grandson of an Alterra resident states that the facility represented to him that it would provide his 89-year old grandmother-in-law with nutritious meals, housekeeping, bathing, and "life sldll activities" six times per day. He stated Alterra also represented that it would admuuster her medications, which included Vicodin for pain and Xanax for her anxiety disorder. Three days after placing her in Alteira, the family member was surprised by a phone call from Fairview Hospital asking him to bring his grandmother-in-law back to Alterra. Fairview advised him that his grandmother-in-law had been admitted due to shaking and tremors suffered because her medications had not been administered. When confronted with this allegation, the staff at Alterra stated they could not find a nurse to administer the medicarion and sent the patient to Fairview. Thereafter, her grandson witnessed several occasions where his grandmother suffered tremors and/or anxiety attacks because her medicarion dosage was not given. He also observed a lack of nutririon and a lack of any attempt to give her recreational activity. 2. A faznily member stated that Alterra represented to her that it would provide one staff member on duty for every seven residents. She was told that it would supply the necessary nutrition, medical, recreational and hospice services necessary "to the end" for her 70-year old mother who was stricken with Alzheimer's disease. The woman's mother was admitted on January 29, 1999. Over the next several months, the daughter observed that her mother's meals were inadequate, for example, one meal was only one-half an egg salad sandwich. She noriced her mother lost 10 pounds and that other residents were always hungry. She noticed that the staff/resident ratio appeazed to be as low as one staff inember to 26 parients and there never seemed to be a nurse on duty. The daughter is convinced her mother's daily healthcaze needs were not met, because she discovered that her mother got a yeast infecrion from sitting in urine soaked pants, blisters on her buttocks &om siriing in feces, dehydration from lack of water, blisters from not chartging a heating pad, and Rosacea from not taldng her out of the sun. -More- 03/07/00 TUE 12:04 [TX/R% NO 93161 03/07/00 13:02 FA7C 651 282 5801 MN MFCU AGO Smnmary of Affidavits from the Aitecra Caze Case 1uesday, Mazch 6, 2000 Page 2 3. Please be advised that, as the Eagan City Attorney, 2 will not recommend to the City that it reduce the special assessments levied against your client's property. The assessments date back to the 1970's. An attempt to reconstruct the activities and actions that took place and the basis for the assessments is, in this case, almost impossible. Accordingly, it is appropriate that the City follow its long standing policy and the policies upon which the legislatively imposed statute of limitations are based, thereby requiring the assessments to remain without any change. VUKELICH Re: City of Eagan Assessments on Lot 1, Block 12, Pilot Knob Heights First Addition Dear Tom: Mr. Meyerson, attorney for the property owner, has reviewed the City's assessment file in detail with Jerry Wobschall and, as you can see from the Ietter, has requested that the City retroactively revise the assessments to his client's property. I have not reviewed the property assessment file in detail but have advised Mr. Meyerson that I will not recommend action to the City. The assessments date from the 1970's. To try and reconstruct now the activities and actions that took place at that time, the basis for the assessments and all of the historical data is almost impossible. Based on that I think it is appropriate that we rely on the City's long standing policy and the legislatively imposed statute of limitations and keep the matter as it is. We can only surmise that if the situation were reversed, the landowner would do likewise. If you would like me to further review this, I will do so. However, it will involved some time, some expense, and I am concerned that we will not be able to ascertain accurate facts back to that date. Please contact me if you have any questions. The Minneapolis Federation for Jewish 5ervice, the property owner, is concerned that the property has borne more than its fair share of speaial assessments. As an example, on Project 502 the Federation's property was assessed on a lateral foot basis, even though the adjacent Kinder Care parcel was not charged on a lateral foot basis. Similarly, on Project 530, the Federation's property bore a substantial portion of the costs associated with a water line, even though the Federation's property already had been assessed for water line services in the 1970s (Project 175). I met with the City staff in November, 1992, looking for answers to these and other questions. I did not receive any explanations for the different treatment. While it is difficult to recreate what occurred after the fact, I do know that the Federation's property has been assessed for a total amount of approximately $18,600 per acre, while the Kinder Care Parcel, a one acre parcel, has been assessed in total for about $12,819. 9?7 -- 3.? f c7 Y1?'?c?v?? ? ' Tli t, c??ev no ? s?or,J ar? ea.,f James. F. Sheldon, Esq. February 25, 1993 Page 2 I would also like you to be aware that a portion of the funds on Project 530 were used to route the water lines around the above ground gas relay stations used by Peoples Gas. These stations are located prominently in front of the Federation's property; they are unsightly and restrict access to the Federation's property. These gas relay stations are, I understand, for the benefit of the general service area, and are of no particular benefit to the Federation's property. Notwithstanding this, the Federation is burdened both by the assessment of routing the water lines around the gas relay stations, as well as the substantial diminution in value presented by their location prominently on the property's frontage. I am writing to repeat my request from a year ago that, pursuant to Minn. Stat. § 429.071, the City Attorney advise the City to reduce the special assessments for the Federation's property. I recognize that you are under no legal obligation to do so, but I believe it is the fair response, and within your authority under Section 429.071. If you have questions, please give me a call. I can provide evidence regarding the foregoing; however, all of the information I have gathered comes from the City's own special assessment records. I would appreciate a response in all events at your earliest convenience. Sincerely, LEONARD, STREET AND DEINARD ? / UG+'7 By Ti-mothy R. Meye son 6ep) TRM\rp SEVERSON, WILCOX & SHELDON, P.A. Sheldon, Esq. 7300 West 147th Street Suite 600 Apple Valley, MN 55124 Re; City of Eagan Assessments on Lot 1, Slock 12, Pilot Knob Heiahts First Addition Dear Mr. Sheldon: Thank you for discussing the above-referenced matter with me. At your suqgestion, I have summarized the issues in this letter. I represent the Minneapolis Faderation for Jewish 5ervice, which owns the above-referenced property. The property was assessed substantially in the early 1970s for storm sewer, sanitary sewer and water lines, primarily running on the westerly and southerly edges of the property. These assessments have been paid off. In the late 1980s, another round of assessments occurred for storm sewer and water lines. These lines run on the westerly and northerly edges of the property. It appears that the property was over-assessed. First, the basis assessments in both the early 1970s and late 1980s is not clear, since it appears that it assumes that the property fully benefits from both improvements. Secondly, on Project 502, the property was assessed on both a lateral foot and benefitted area of basis, even though adjacent properties were treated quite differently. Base$ on the project summary for Project 502, there is no apparent reason for the difference in treatment. I have enclosed a aopy of Project 502 and an area map to assist your review of the foregoing. t James. F. Sheldon, Esq. February 17, 1992 Page 2 We fully recognize that the period for appealing assessments under Minn. Stat. § 429.081 has long since passed. However, we would urge the City to review the circumstances to determine if a reassessment, on advice of the City Attorney as provided in Minn. Stat. $.429.071 is appropriate. After you have had a chance to review the enclosed and consult with the City, I would appreciate having a meeting with you at your earliest convenience to see;if something can be done about this matter. Thank you for your attention. Sincerely, LEONARD, STREET AND DEINARD B ??---- Y Timothy R. Meyerson Enclosures TRM\rp ?
