Based upon the fact that the original citizen complainant did not wish the matter to be pursued, the active community involvement against the prosecution of this matter, and the fact that the defendant was obviously well aware of the problem and that it was likely that future reoccurrences would be avoided, tlvs matter has been dismissed. There have been a number of discussions regazding the Eagan City Ordinance as a result of this case and I wanted to simply provide you with our input in the event that the Ordinance language is revisited. I have reviewed the memo to you £rom Sharon 101s dated November 4, 1996 and I am ir. agreement with it. Sharon concludes her memo, however, with the statement, "The term `habitual' has well accepted, generally understood meaning and is not subject to subje,ctive interpretation as the terms `disturbed' or `annoy'". I believe this comment "begs the question". In this case, Animal Controt Officer Kathleen Gilbertson had been out to the property due to a contact by an anonymous citizen. Ms. Gilbertson did not hear the bazking of the dog, however, she warned the Lancettes that the dog should be kept inside when they were away at work. About a month later, Ms. Gilbertson was agaia asked to go to the properry due to the request of a complainant who wished to remain anonymous. Ms. Gilbertson responded to the property and listened to the dog bark for about five minutes. Approximately two hours later, Officer Gilbertson returned to the property with the intent to remove the dog if it was still barking. Instead, the dog did not emit any loud noises, but was found to have wrapped itself around a post, and the dog was removed due to the fear that it might strangle itsel£ W. 7ames Sheridan November 11, 1996 Page Two Where a citizen complainant is not willing to come forwazd, and the city must rely solely upon the testimony of the Animal Control Officer or other police officer, is five minutes of consecutive baridng sufficient for the State to meet its burden to prove "habitual" baddng7 After reflection on the ordinance, I am concerned with going forward on a case such as tlvs. Where the citizen complainant is not willing to come foiward, I believe it is appropriate to recommend to the Department that the officer retum an hour or two later and only issue the citation if the dog again continues to bark, or, perhaps preferably, that the officer only issue a wazning and then issue a citation only if the Department is again called back to that location and the dog is actually heard to be bazking on two or more occasions. The Washington Supreme Court does not really define "habitual" in Citv of Spokane vs. Fischer. The Edina City Ordinance in Edina vs. Dreher does not use the term "habitual" or something similaz. One other deSnition of "habit" was found in State of Arizona vs. Cole. 501 P.2nd 413, 414(Ariz. Ct. App. 1972). The word "habit" was found not to be unconstitu6onally vague and was defined as "settled tendency of bebavior or normal manor of procedure: custom, practice; ....a behavior pattem required by frequent repetirion." Cole ai 415. We ran a Westlaw search for Mnnesota Statutes and found that the term "habitual" is used in 48 differern statutes. See for example Mmn. Stat. §260.015, Subd. 19, deEning "habitual truant" (copy is attached) or Mmn. Stat. §253B.02, Subd. 2, where a chemically dependant person is defined as "any person (a) detetrnined as being incapable of self-management or management of personal affairs by reason of the habitual and eaccessive use of alcohol or drugs...". In conclusion, I believe the Eagan City Ordinance is constitutional and is probabiy quite satisfactory as it is currendy written. However, I believe the enforcement of the ordinance requires proof of some repetition of barking. Where a citizen comQlainant is not willing to come forward to testify as to the repetition, Eagan officers will have to establish this repetition through at least two, and preferably more than two visits to the home. If a re-draft of the ordinance is considered, I would appreciate the opportunity to participate in the discussion regarding the new ordinance. As you are aware, the cruelty to animal citation was dropped and we were proceeding with the barking dog complaint and a jury trial was scheduled for November 18, 1996. The complaint was initiated by a neighbor and our animal control officer had filed a formal complaint based on that initial complaint. Our Animal Control Officer, Kathleen Gilbertson, spoke with Mrs. Lancette on November 7, 1996, and as a result of that discussion, felt it would be in the best interest of everyone to use this most recent complaint as a waming with the understanding that, if there is a further complaint, it would be charged and previous contacts would be used to establish the habitual barking of the dog. I spoke with Mrs. Lancette on November 8, 1996, and she was in concurrence with that negotiated settlement. I have also contacted our City Prosecutor, Kevin Eide, and he will draft a letter to Lancette's documenting our conversation. When I spoke with Mrs. Lancette this moming, she reiterated her concerns about the definition of "habitual" barking dog definition. I told her that, based on the City Council direction, we would take a look at that definition after the first of the year. Mrs. Lancette asked to be contacted for their input when that occurs. We apologize for taking so long, but am convinced that we were not able to convey in a meaningful manner the tremendous expense the Ciry is undergoing to pay the Prosecuting Attomey's firm to prosecute cases which, with a properly written ordinance, or, with some common sense, would never have to be tried in the first place. My wife and I get the impression from Shawn Hunter that he fully understood the situation, or had heazd enough to make a decision as to future action. We aze not convinced he is awaze of the indignity and feeling of violation we underwent at the hands of the Prosecuting Attorney's office, as a result of the "carte blanche" wording of the ordinance. We think he missed the most important point of having the opporiunity to stop this taxpayer waste of thousands of dollazs now by suspending the ordinauce in ihe face of common sense and constitutionality regardless of my case. The ordinance is demonstrably vague and unconstitutional and my trial should never even begin. None the less, you gave us the opportunity. We oniy wish we had lmown the amount of time allocated us for our presentation. We may have been able to revise our presentation in to highlighu (low lights) and $otten ihe point across. Next time, if there is one, we will prepare for a 5 minute presentation. By the way, the Council's decision to take my concem under advisement wasn't ezcactly a vote of action in the neaz future. What will be done now, and who will decide what happens? How do we latow that the Council wiil not consider tius IightIy seeing as we've been the only party to complain? In your defense of this case, you have argued that the State cannot meet its burden to prove that your dog has habitually bazked. I believe in your discussion with Chief Patrick Geagan, Chief Geagan indicated to you that the City will prosecute future complaints, by Eagan Officers or by neighboring land owners, and will utilize the prior complaints, warnings and actual findings that your dog was barking if future charges must be pursued. While you and I have been in an adversarial position in the prosecution and defense of this case, and we have not seen eye-to-eye regazding several issues, I persona(ly, and on behalf of the City, genuinely appreciate your concern and input regarding the manner in which the Eagan Ordinance is drafted and the mannec in which it is enforced. As a resuit of these discussions and your appearance before the City Council, I do believe that the City will review the manner in which the Ordinance is drafted and the Police Department will review the manner in which the Ordinance is enforced.
