Zn my letter of March 17, 1981 I mentioned that the Eagan staff is prepared
to recoumend to the City Council that the following special assessments
covering the Richard Scherer praject be cancelled under the conditions that
were outlined. Iour letter of March 23 is essentially correct with just a
fem changes.
1. The follow±ng assessments were Ievied by the City in the years mentioned
and are not affected by the current proposal foz cancellation:
a. Sanitary sewer trunk, 1975, 8304, original amount $3,046.10, 1980
paymeat $365.54;
b. Water area, 1979, /t422, original amount $4,330.60, 1980 payment
$612.06;
c. Storm sewer trunk, 1980, #442, original amount $7,180.43, 1981
payment $1,426.50.
2. The following assessments were levied in September of 1980 and vill be
cancelled under the proposal:
a. Stom sewer lateral, 1960, N492, original amount $913.50, 1981 pay-
ment $182.70.
b. Sanitary sewer lateral, 1480, #515, original amount $2,675.00, 1961
payment $479.16.
c. Watermain Iateral, 1980. fi491, original emount $3,915.00, 1981 pay-
ment $783.00.
d. Street assessments, 1979, not levied.
Total amount is $9,916.00.

3. It is understood that the io_"egoing assessments would be canceiled under
paragraph 2 above with the understanding that the assessments against the
property will be assessed at [he then existing rate at such time as:
a. The Scherezs or their successors or assigns subdivide or plat the
pzoperty.
b. That such parties petition for and are granted a revision in the
zoning of the property.
c. That the parties apply for and obtain an additional building permit for
other than an accessory building on the propertq.
d. That the parties convert the use of the property to any other purpose
- than the presently existing purpose.
4. In the event that the Scherers, their successors or assigns request that
any building on the Scherer property be connected to municipal sanitary sewer
or water, the lateral benefit for sanitary sewer or water as connected will
then be assessed against the property at the then existing rate.
I forvarded a Stipulation of Dismissal of the appeal to you earlier and if
the provisions of this letter are agreeable please have your client sign and
return two fully executed copies to me so that I can arrange to have the City
officials also execute a copy of the letter. If there are any revisions

On May 27, 1980, the City Administrator, Tiir. Tom Hedges,and myself, met with
you to discuss several questions you had regarding.the special assessment
levied against your parcel (10 02800 O11 84), located in the northeast quad-
rant of the intersection of Cli£f Road and Thomas Lake Road. Calculations
used to compute the area of your property for assessment purposes are as fol-
lows:
Original Described Pareel 11.10 Acres
Property Transfer to Lake Park Addition 1.72 Acres
Remaining Dedicated Ponding Easement 0.20 Acres
Gross Assessable Area 9.18 Acres
20% Credit for future Road Right of Way 1.84 Acres
Net Assessable Area 7.34 Acres
This remaining acreage (7.34 acres) was used to compute your area assesament for
the most recent trunk storm sewer improvement. 7.34 acres (319,730) assessed
at the rate of 2.6¢ per square feet equals $5,312.98. Additional research
indieates that the area assessed for this trvnk storm sewer improvement, did
include the fi£ty (50) foot half right of way for Cliff Road and the thirty
(30) foot partial right of way for Thomas Lake Road. Talfl.ng this new informa-
tion into consideration, your assessment will be, adjusted according to the
following calculations:

This assessment can be pai'd in full by June 6, 1980 without accruing any
interest. If you so choose, you may elect to have this assessment spread
against the property as a special assessment over a fifteen (15) year period
with 8.0% interest on any remaining unpaid balance.
As uve also discussed during our meeting with you, I am enclosing a copy of
Ordinance #66 along with an application form. This is the method used to
consider deferrment of special assessments, if the applicable criteria is
met by the affected property owner.

Gentlemen:
We have been attempting during the past two weeks to acquire an easement
from Mr. and Mrs. Richard Scherer for sanitary sewer leading westerly
from Lake Park Addition to the Zoo sanitary sewer trunk for a distance
of about 350 feet across the North end of the Scherer property along the
South edge of Thomas Lake. The Scherers want to connect their house on
Cliff Road to the sanitary sewer line and we have been attempting through
the Eagan contractor, Knutson Contracting Company, to help install a 100
foot sewer service to the Scherer property. We have explained that the
service cost will have to be negotiated directly between the Scherers
and Knutson and could not be assessed by the City.
Ann Goers has given us figures on the assessments as follows:
1. 150 feet of sewer lateral at $11.50 a foot totaling $1,725.00.
2. Sac charge of $525.00
Mr. Scherer has asked for payment for crossing the property and the normal
payment would be as follows:
1. 350 feet of permanent easement times 20 feet in width equals 7,000
square feet at $2,000 per acre or approximately $350.00.
2. 350 feet of temporary easement times 80 feet equals about 25,000
square feet at $1,000 per acre or approximately $550.
Payment chargeable against the project would be $900.
If the Council agrees with the payment, I expect we will be able to nego-
tiate the easement.

Dear Mr. Connor:
I sent you on November lst a letter together with a proposed Agreement between
tiorthern Natural Gas Company and the City of Eagan regarding the James Barker and
Richard Sherer properties in the City of Eagan.
Since that time, Tom Colbert, Eagan City Public Works ?irector, has reviewed the
Agreement and has made two additional suggestions that should be included in the
Agreement as follows:
1. "In the event that the City of Eagan must repair its sanitary seo;er
trunk that is in place and adjzcent to the location of the proposed Northern Natural
Gas main running across the Sherer property, that Northern shall be responsible for
the protection of Northern's proposed gas main lying adjacent thereto and shall be
solely responsible for the costs of such protection that may be occasioned by the
necessary and reasonable maintenance of Eagan's sanitary sewer trunk hy Eagan."
2. Paragraph 1 of the Agreement should be amended by as follows:
"Eagan hereby grants to Northern the right to install a 16 inch natural
gas main adjacent to and within the easement acquired by the City of Eagan from, over
and through the Richard Sherer property described on Exhibit "B" including the right
to maintain and repair such gas main that location, however, such gas main shall.be
located no closer than 10 feet from the outside diameter of the Eagan sanitary sewer
trunk lying across and through such property."

The City Council has now arrived at an understanding with Mr. and Mrs. James Barker
concerning the grant of a 30 foot easement along the West line of their property
and, therefore, we are suggesting comparable terms be granted both to the Richard
SmiThs and to you in order to acquire the necessary road easements.
Therefore, coe are suggesting the following in respect to your property:
l. That you will grant a 30 foot permanent and necessary slope easement
according to the survey done for the improvement of Thomas Lake Road by the City
of Eap,an.
2. That the City will defer the assessments for road improvements against your
property, but will assess at the then existing rate at such time as you or your
purchaser or assigns shall acquire a change in the zoning of the property, request a
building permit for an additional major structures for the property, or convert tlie
use of the property to another purpose, or subdivide the land. The deferred road
assessments of $13.20 per front foot for 484.88 feet frontage amounts to 56,400.42 ?•

and $1,000 per net acre for temporary easement right-of-way upon execution and delivery
of the permanent and temporary easement to the City. The amounts are approximately
$680 for permanent easement and $580 for temporary easement, for a total of $1,260.
If the terms of this letter are agreeable with you, then I would appreciate if you
would arrange to sign the easement and you can either send it to me or we will arrange
to stop and pick it up. It is expected that the contractor will start construction
early in the Spring and it is, therefore, important to attempt to complete the easements
as soon as possible. Also, if you appr.ove please sign and return a copy of this letter.
