TO: City of Eagan, its mayor, city council and other
officials:
NOTZCE IS HEREBY GIVEN THAT pursuant to Minn.
Stat. Section 429.081 and all other applicable law,
appellants hereby appeal to the District Court from the
determination and adoption of assessments by the City of
Eagan on September 16, 1991, which adopted and ratified the
assessments concerning the City of Eaqan's Special
Assessment Project No. 1OP592 for a storm sewer. This
appeal is of those assessments levied against the property
of appellants George Stertz and Jeanette Stertz which is
identified in the Special Assessment Project 10P592 records
as property No. 10-03200-050-1, and of those assessments
levied against the property of appellants Steven and Gail
Marstad which is identified in the Special Assessments
Project 1OP592 records as property No. 10-03200••060-1. This
appeal is on the grounds that:
1. Appellants are each residents of the City of Eagan, in
Dakota County, Minnesota.
2. Respondent is a municipal corporation organized under
the laws of the State of Minnesota, and is located within
Dakota County, Minnesota.
3. On September 16, 1991, respondent, by its City Council
adopted special assessments as part of Special Assessment
Project No. 1OP592, which assessments are against
petitioners property as further described herein. These
assessments are apportioned for costs of a special
improvement for a storm sewer.

4. Appell.ant George Stertz and appellant Steven Marstad
each interposed siqned wrftten objections of the proposed
special asessments at the hearing to adopt and approve the
special assessments.
5. Appellants Georqe Stertz and Jeanette Stertz are the
owners of property identified in the records of this special
assessment project as No. 10-03200-050-1 (hereinafter
referred to as the stertz property). The Stertz property
was assessed for special improvement costs in the sum of
$6391.39.
6. Appellants Steven and Gail Marstad are the owners of
property identified in the records of this special
assessment project as No. 10-03200-060-1 (hereina#ter
referred to as the Marstad property). The Marstad property
was assessed for special improvement costs in the sum of
$4193.56. '
7. Respondent has violated appellants' constitutional
rights under both the Fourteenth amendment of the Federal
Constitution and the Minnesota Constitution, Article X,
Section 1 and Article XIII, Section 4, in that the special
assessments exceed the special benefits conferred, and,

NOTICE IS HEREBY GIVEN THAT pursuant to Hinn.
5tat. Section 429.081 and all other applicable law,
appellants hereby appeal to the District Court from the
determination and adoption of assessments by the City of
Eagan on September 16, 1991, which adopted and ratified the
assessments concerning the City of Eagan's Special
Assessment Project No. 1OP592 for a storm sewer. This
appeal is of those assessments levied against the property
of appellants George Stertz and Jeanette Stertz which is
identified in the Special Assessment Project 10P592 records
as property No. 10-03200-050-1, and of those assessments
levied against the property of appellants Steven and Gail
Marstad which is identified in the Special Assessments
Project 1OP592 records as property No. 10-03200••060-1. This
appeal is on the grounds that:
1. Appellants are each residents of the City of Eaqan, in
Dakota County, Minnesota.
2. Respondent is a municipal corporation organized under
the laws of the State of Minnesota, and is located within
Dakota County, Minnesota.
3. On September 16, 1991, respondent, by ita City Council
adopted special assessments as part of Special Assessment
Project No. 1OP592, which assessments are against
petitioners property as further described herein. These
assessments are apportioned for costs of a special
improvement for a storm sewer.
4. Appell.ant Georqe Stertz and appellant Steven Marstad
each interposed signed written objections of the proposed
special asessments at the hearing to adopt and approve the
special assessments.
5. Appellants Georqe Stertz and Jeanette Stertz are the
owners of property identified in the records of this special
assessment project as No. 10-03200-050-1 (hereinafter
referred to as the Stertz property). The Stertz property
was assessed for special improvement costs in the Bum of
$6391.39. • ,
6. Appellants Steven and Gail Marstad are the owners of
property identified in the records of this special
assessment project as No. 10-03200-060-1 (hereinafter
referred to as the Marstad property). The Marstad property
was assessed for special improvement costs in the sum of
$4193.56.
7. Respondent has violated appellants? constitutional
rights under both the Fourteenth amendment of the Federal
Constitution and the Minnesota Constitution, Article X,
Section 1 and Article XIII, Section 4, in that the special
assessments exceed the special benefits conferred, and,
therefore, as to such excess, constitute takinq without just
compensation.

Respondent.
WHEREAS, Appellants Steven Marstad and Gail Marstad ("Owners")
are the Owners of a parcel of land in the City of Eagan with the
property identification number of 10-03200-060-01 ("Subject
Property"); and
WHEREAS, on September 16, 1991, Respondent City of Eagan ("City")
assessed the Subject Property in the sum of $4,193.56 for storm trunk
as part of Project No. 592; and
WHEREAS, Owners brought an action in District Court appealing the
sum of the assessments for Project No. 592, known as Georae Stertz,
et al., Court File No. C6-91-8544; and
WHEREAS, the parties have resolved all dispute over the
assessments against the Subject Property.
NOW, THEREFORE, the parties do hereby agree as follows:
1. The assessment levied against the Subject Property for
Project No. 592 in the sum of $4,193.56 shall be reassessed in the
amount of $0.
2. This settlement is made without prejudice to the City's
assertion of any rights it may have in the future to claim storm
sewer connection charges if and when the Subject Property connects to
City utilities. The settlement is also without prejudice to the
owners' right to contest any such connection charges in the event the
same were made by the City.
3. The City shall direct the Dakota County Treasurer to
recompute Owners' real estate tax statement using the new assessment
figure of $0.
4. The Owners waive Notice of Hearing and Hearing on the
reassessment of the Subject Property.
5. Upon the execution of this Stipulation, the Owners shall
cause this action, Court File No. C6-91-8544 to be dismissed with
prejudice.
