Fiow Do You Pay a Judgment?
• Payment may be made directly to the party that wins the case (prevailing party) or payment
may be made through the Conciliation Court.
i If the prevailing party is paid directly, obtain a statement of payment from the party
(satisfaction oi judgmen#) and file this with the Court. Special forms for this procedure are
available at the Conciliation Caurt office.
• If the Court is not properly notified of payment, you will have an unsatisfied judgment on your
record and your credit rating may be affected.
How Do Yau Collect e Judgment?
Although a case is decided in your favor, a Conciliation Court judgment does not create a lien
against the debtor's property unless the procedure outlined below is followed. You can try to
collect the judgment yaurselt if it has not been paid within the required 20-day period, and if the
other party has not filed an appeal. The judgment is good for 10 ysars and may be renewed for
another 10 years. ff fhe party is declared bankrupt following a judgment, you may receive part af
your payment if assets are divided among the party's creditors, or the debt may be diseharged
and you cannot coliect.
The following information may help you in collecting the amount of the judgment:
• In order to collect on yourjudgment you must obtain a transcript (record) of yourjudgment from
the Conciliation Court and file it in District Court together with an Affidavit of Identification. The
judgment will then be "docketed". There is a $5 fee for obtaining that transcript.
0 Upon docketing, yau may obtain an Execution from the Court Adm+rtrstrator. Rrr Execution rs a
legal paper authorizing the sheriff to levy (collect) on a debtor's assets. The most common
assets that can be levied upon are bank accounts and wages. You must be able to prqvide
detailed informatlon regarding the assets before the sheriff can make a levy. The fee for an Ex-
ecution is $5. Fees expended for the Execution process may be recovered from the Debtor.
•!t you do noE know what assets the judgment debtor has, you may request the Court to arder
the debtor to tell you what those asseis are. You can make that request only if:
1. The judgment has been docketed for 30 days.
2. You have not received payment of the judgment.
3. You and the debtor have not agreed to some other method of settlement.
If those provisions can be met, the Requesi for Order for Q'rsclosure form can be abtained irom
the Court Administrator. A fee is required. If the request is granted, the debtor will be ordered to
complste and mail to you a listing of his assets within 10 days. Once you have that Infiorma-
tion, you can give the Execution to the sheriff, adviss him of the debtor's assets and ask him to
collect your judgment.
How Do You Appeal a Judgment?
• Any party who was not present at the trial, and who has good reason for not having been pre-
sent, may apply to the Court, not later than the date indicated on the "Notice of JudgmenY"
(on the front of this form) for permission of the Court to re-open the case for another trial. {f the
Court grants another trial, the judge rrray requ+re payment of costs to the oiher party, absolute
or conditional, not to exceed $25.
• Any party who believes this judgment to be incarrect may appeal to the District Court for a
completely new trial, by a diffierent judge or by a jury if desired. The statutory requirements for
such an appeal must be complied with not later than the date inclicated on the °Notice af
Judgment" (on the front of this form). Such requirements are time-consuming and it is
suggested that such inquiries be made well in advance of the date indicated.

James Unker. The City attorneys' have a few questions regarding
the form of these easements. In the enclosed letter from our
attorneys to us, you will find the questions we have. Of concern
is the lack of a"Drafted By" designation that may hold up
recording of the easements. Also, the naming of the Unkers as
both Grantees and Grantors on one easement should be changed. We
would like your firm to please revise these easements so that
they satisfy City requirements. We are also waiting to see a
revised copy of a fourth easement, a Restricted Access Easement
between Dakota County and the Unkers.

Dear Bruce:
Enclosed please find three Easements in regard to the Unker property
which I do not believe were prepared by our office, in addition,
I m not sure what the terms should be.
Your note indicates that we should obtain signatures for the lines
under "In the Presence of:" and in our opinion, these lines do not
have to be signed since the Easements are properly acknowledged.
However, it is our understanding that in order to be recorded, the
Easements must have a"Drafted By" designation from the attorney who
prepared them. I also note that the easements do not have the usual
hold-harmless wording, although it may not be necessary in this
situation. The Utility Easement provides for the replacement of
shrubs. The Utility and Driveway Easement names the Dnkers as both
the grantors and grantees, and yet provides for a signature by the
rlayor on behalf of the City as grantee.
Perhaps there is to be a Utility
Declaration of Driveway or Access
properties created after the lot
Easement in favor of the City and a
Easement in regard to the
split.
We would suggest that you forward the Utility Easement and Drainage
Easement to the draftor to add the "Drafted By" designation and also

THIS INDENTURE, made and entered into this day

UNKER, husband and wife, as Grantors, and the CITY OF EAGAN, Dakota
County, Minnesota, as Grantee.
WITNESSETH WHEREAS, said Grantors axe the ownecs of the tracts of
land in the City of Eagan, Dakota County, Minnesota, legally
desccibed as follows:
A 20.00 foot wide perpetual easement for utility puxposes over
under and aczoss that part of Lot 10, Block 3, CLEARVIEW, lying
East of the West 90.00 feet thereof, the centezline of said
easement is described as beginning at a point on the south line
of said Lot 10, distant 25.00 feet Westerly of the southeast
corner theceof; thence NorthwesteLly to a point 45.00 feet North
and 90.00 feet East of the southwest corner of said Lot 10 and
thete tetminating. The side lines of said easement are to be
lengthened or shortened so as to terminate on the south line of
said Lot 10 and the east line of the West 90.00 feet of said Lot
10.
Also, a 30.00 foot wide perpetual easement for utility purposes

according to the cecocded plat thereof, Dakota County, Minnesota,
the centerline of which is described as beginning at a point on

NOW, THEREFORE, the said Grantors in consideration of ONE DOLLAR
($1.00) and other qood and valuable consideration to them paid by
Grantee, receipt whereof is hereby acknowledge, hereby grant an
easement to the above premises to said Grantee, its heirs and
assigns, for utility line purposes.
The Grantee shall have the right to do whatever is necessary foc
the enjoyment of the rights herein granted, including the right of

DRAINAGE EASEMENT
THIS INDENTURE, made and entered into this day
of /rIlle7CW , 1988, by and between JAMES T. UNKER and NANCY A.
UNKER, husband and wife, as Grantocs, and the CITY OF EAGAN, Dakota
County, Minnesota, as Grantee.
WITNESSETH WHEREAS, said Grantois ace the owners of the tracts of
land in the City of Eagan, Dakota County, Minnesota, legally
desczibed as Eollows:
A 10.00 foot wide easement for drainage purposes over and across
that part of Lot 10, Block 3, CLEARVIEW, according to the
recorded plat theceoP, Dakota County, Minnesota, the centerline
of said easement is described as follows: Commencing at the
northwest cocner of said Lot 10; thence SOUTH along the west line
thereof, 115.00 feet to the point of beginning of the centerline
to be described; thence N 450 E, 125.00 feet and Lhere
terminating.
NOW, THEREFORE, the said Grantors in consideration of ONE DOLLAR
($1.00) and other good and valuable consideration to them paid by
Grantee, receipt whezeoE is heceby acknowledge, hereby grants an
easement to the above premises to said Grantee, its heics and
assigns, for permanent dxainage purnoses, including the normal
pzactice of filling with watec the above-described premises from
stocro sewer zunoff.
By acceptance of these easements, the Grantee agrees that it
shall restore the propeLty located outside the anticipated perimeter
of moving water to as near the existing grade as is ceasonably
possible and further agrees to replace existing cultivated shcubs or
sod and to seed all other areas not covered with moving water.

UTILITY AND DRIVEWAY EASEMENT
THIS INDENTURE, made and entered into this 021-1 day

CLEARVIEW, according to the recorded plat thereof, Dakota County,
Minnesota, and JAMES T. UNKFR and NANCY A. UNKER, Grantees, owners of
that part of Lot 10, Block 3, CLEARVIEW, according to the recorded
plat thereof, Dakota County, Minnesota, lying east of the west 90
feet thereof.
WITNESSETH WHEREAS, said Grantors are the owners of the tracts of
land in the City of Eagan, Dakota County, Minnesota, legally
described as follows:
A 30.00 foot wide perpetual easement for utility and driveway
purposes over and across that part of Lot 10, Block 3. CLEARVIEW,
according to the recorded plat thereof, Dakota County, Minnesota,
the centerline of which is described as beginning at a point on
the south line of said Lot 10, distant 48.00 feet East of the
southwest corner thereof; thence Northeasterly 107.00 feet to a
point 94.00 feet North of the south line o£ said Lot 10 and there
terminating.
NOW, THEREFORE, the said Grantors in consideration of ONE DOLLAR
($1.00) and other good and valuable consideration to them paid by
Grantee, receipt whereof is hereby acknowledge, hereby grants an
easement to the above premises to said Grantee, its heirs and
ass,igns, for permanent utility and driveway purposes, includinq the
right of ingress and egress to and from the property of Grantees,
with or without automobiles.
The Grantee shall have the right to do whatever is necessary for
the enjoyment of the rights herein granted, includinq the riqht of
clearing the easement area to allow for the use of the land as stated
herein and for ingress and egress to and from said tract of land and
over and across said easement only for the purpose of constructing,
maintaining, operating and repairing said utility and driveway
facilities.
It is furtY,er understood and agreed tha*_ the easements,granted
herein are to be held by the respective Grantees, their heirs and
assigns, as appurtenant to the land owned by the Grantees.
It is further understood and agreed that the parties of the first
part will and do hereby assume and agree to pay one-half, and the
parties 'of the second part will and do hereby assume and agree to pay
one-half of the cost of constructing and maintaining driveway
facilities over the easement herein granted.

It is my understanding that Dakota County has rights to a 25 ft.
road easement across the south portion of the above-referenced lot
in the City of Eagan. In response to a request from the property
owner, the City Council took formal action at their regular
meeting on November 19, 1985, to release any interest by the City
in this existing easement currently held by the County. A copy of
the appropriate minutes reflecting this action is included for
your information.
It is my understanding that as a result of this action by the
City, you will recommend to the County Board that this easement be
reverted to the City of Eagan to allow the initiation of a formal
vacation of public interest. Once this action has been completed,
please forward the appropriate information to my attention so that
we can proceed with the notification and public hearing process to
formally vacate this easement.
If there is any additional action required by the City of Eaqan in
response to Mr. Unker's request, please let me know.

Dear Tom,
Recently, I have been attenpting to remove an easement from my property
located at 1775 Cliff Road in Faqan. Discussions with my attorney Brad
Smith and Ken Malvey (ASSistant County Attorney) have led m to your door -
I'll try to be short.
My property has 2 easements running aLong Cliff Road. The first is 50
feet from the centerline, the second is an additional 25 feet beyond the
oriqinal 50 feet. The 25 feet was added when the lot was split, for the
potential expansion of County Road 32. Here is my problem.
, According to my attorney and the concerned county officials, there is
no problem renoving the easement, because, at this point on 32, no expansion
of the magnitude to require an additional 25 feet will occur. So, the
problem in removing the easement is merely technical. 'Ib renove an easement
in Minnesota, one must have it "revoked" not "vacated.
According to my attorney, the Attorney General's opinion to "revoke" an
easement requires that both the county board and the city give approval.
For the county to proceed, a letter from sonieone representing the city of
Fagan is needed to show possible or good chances of approval at the city
level. Obviously, a CATCH - 22 situation could occur if the city cannot
provide the letter, as the coutny board will most likely not move without
it.
I anticipate your response as favorable. My intent here is to build a
garaqe as close as possible to County 32 to block out the terrific amount of
noise. I have met with Joe Conally of the City of Eagan Water Department
and he has given me preliminaiy approval regarding the qarage, with the
water and sewer lines which are involved. I hope this shaws to you that
there is a good possibility I will be able to build a garage on my property
and not consiune a larqe portion of my back yard.

Dear Mr. Colbert:
Because of the extensive discussion concerning conditions on the
Unker waiver of plat, both at the Planning Commission and City
Council level, I thought it might be prudent to put in writing my
understanding of the conditions that the City Council placed on the
approval of the waiver of plat. The remaining items of controversy at
the City Council level were the storm sewer assessments and the
requirement that sanitary sewer and water services be installed to
the lot line as a condition of approval rather than allowing their
installation at a later date. It is my understanding that on both of
those issues the City Council agreed with city staff and required
immediate assessment oP storm sewer trunk, as well as installation of
sanitary sewer and water services to the lot line prior to recording
of the lot split.
The only other areas that were discussed were that conditions 7, 9,
and 10 in the Planning Commission minutes inadvertently followed the
original staff report of February 13, 1987 rather than the revised
staff report of March 19, 1987, as was intended. The revised staff
report accepted our proposed language at those three paragraphs, and
proposed a revision to our proposed paragraph 6 to require that
either a storm sewer easement be dedicated or fill be provided to the
west part of the lot prior to recording of the lot split rather than
prior to time of building construction. As we indicated, this change
proposed by staff is acceptable to us.
Consequently it is my undexstanding that the conditions agreed to by
the Council are as follows:
1. All applicable code requirements shall be adhered to.
2. Any further divisions of Lot 10 will require a replatting
process.
3. This waiver shall be subject to a parks dedication fee.

4. Either a pezmanent and/or construction easement shall be
obtained, if necessary, f rom Lot 9, or a county utility
permit shall be obtained to allow construction of the
required water service fo r the newly created lot.
5. A sanitary sewer service easement shall be dedicated over
the southeast portion of Lot 10 as required to provide
sanitary sewer service to the newly cteated parcel (west
half).
?6. A drainage and utility ea sement shall be dedicated and a
`-? storm sewer outlet shall be constructed from the existing
low drainage basin on the west side of Lot 10 to Woodgate
pond (BP-22) to the north , or in the alternative, the
property shall be filled and graded as a condition of
approval, according to a grading plan acceptable to.the City
to provide natural storm water drainage into the pond to the
north.
? A restxictive access control easement shall be dedicated to
the County Highway Department across the entire frontage of
Lot 10, with the exception of the existing driveway access
location, with the allowed access to be up to 20' wide,
subject to County approval.
8. A cross easement shall be provided allowing common use of
the existing driveway for both newly created parcels.

?-? at 940.0, if a gravity line is installed. In the
alternative, if a pumped line is installed, there shall be
no minimum floor elevation. The sanitary sewer service
construction shall be properly insulated.

adequate soils to accommodate a new building site, prior to
construction.
11. This development shall be responsible for any outstanding,
unlevied or deferred assessments, or other financial
obligations associated with this development at the rates in
effect at the time of final approval.
12. Sanitary sewer and water services shall be installed to the
lot line of the newly created lot as a condition of
approval.

COLDWELL BANKER - SPECIAL PERMIT - DIRECTIONAL SIGN
V An application of Coldwell Banker to allow two 4 foot by 8 foot
rdirectional signs, located adjacent to Cliff Road directly across
^ltom Ches Mar Drive was brought to the Council. Mr. Hedges
'iadicated that at the March 31, 1987 special council workshop
pssion, direction was given that no additional advertisinq signs

`6gan moved, Ellison seconded the motion to deny the application,

CLEARVIEW ADDITION - JAMES UNKER - WAIVER OF PLAT
An application of Mr, and Mrs. James Unker for waiver of plat to
Oplit Lot 10, Block 3, Clearview Addition into two separate one-half
oc[e parcels next came to the Council for its ceview. The Advisory
Flanning Commission recommended approval of the lot with certain
lodiEications. Dale Runkle described the application and stated
tAat he understood the engineering issues had been resolved. Mr.
Colbert recommended the trunk area storm sewer assessment be levied
1nd that sanitary sewer and water services be installed to the lot
line of the newly created lot. Mr. Unker agreed with the storm
Iewer assessment and attorney erad Smith was present on behalf of
the Unkers, stating that the applicant was uncertain as to where the
house would be located and preferred to install the secvices at a
later time but would allow permission to bring the sewer and water
Gnder Cliff Road to the lot line. He discussed conditions 6, 7, 9,
end 10 and stated they were agreeable with the soil condition
lnvestigation report.
r Mr. Colbect was concerned about future sale of the lot without
Aotice to a new property owner and possibility of a requirement of

luggested an easement be required through the Amundson property on

THIS INDENTURE, made and enteced into this day
of 1988, by and between JAMES T. UNKER and NANCY A.
UNKER, Grantozs, as owners of the West 90 feet of Lot 10, Block 3,
CLEARVIEW, according to the recorded plat thereof, Dakota County,
Minnesota, and JAMES T. UNRER and NANCY A. UNKER, Grantees, owners of
that part of Lot 10, Block 3, CLEARVIEW, according to the recorded
plat thereof, Dakota County, Minnesota, lying east of the west 90
feet thereof.
WITNESSETH WHEREAS, said Grantors are the owners of the tracts of
land in the City of Eagan, Dakot-a County, Minnesota, legally
described as follows:
A 30.00 foot wide pecpetual easement foc utility and driveway
purposes over and across that part of Lot 10, Block 3, CLEARVIEW,
accocding to the zecorded plat thereof, Dakota County, Minnesota,
the centerline of which is described as beginning at a point on
the south line of said Lot 10, distant 48.00 feet East of the
southwest corner thereof; thence Northeasterly 107.00 feet to a
point 94.00 feet North of the south line of said Lot 10 and there
terminating.
NOW, THEREFORE, the said Grantors in consideration of ONE DOLLAR
($1.00) and othec good and valuable consideration to them paid by
Grantee, receipt whezeof is hexeby acknowledge, hereby grants an
easement to the above premises to said Grantee, its heirs and
assigns, foz pecmanent utility and dciveway purposes, including the
right of ingress and egxess to and fcom the property of Grantees,
with oc without automobiles.
The Grantee shall have the right to do whatever is necessary for
the enjoyment of the rights herein granted, including the right of
clearing the easement area to allow for the use of the land as stated
herein and for ingress and egcess to and from said tract of land and
over and accoss said easement only fot the puzpose of constructing,
maintaining, operating and repairing said utility and driveway
£acilities.
It is further understood and agreed that the easements gcanted
herein ace to be held by the respective Grantees, their heics and
assigns, as apputtenant to the land owned by the Gzantees.
It is further understood and agreed that the pacties of the first
part will and do hereby assume and agree to pay one-half, and the
parties of the second part will and do heceby assume and agree to pay
one-half of the cost of constructing and maintaining driveway
facilities over the easement herein granted.

As you are aware, a large portion of the deck on the west elevation of your newly purchased home was built (by a
previous owner) without a building permit or any inspections by the City of Eagan's protective inspections department.
There are many unknowns with this portion of your deck. When we last spoke (on 7/15/2013), I mentioned that there is
no way of knowing whether any of the structural columns are supported by adequate footings (it appears that they are
not), and that the structural framing doesn't appear to adequate either.
Based on what we know, and what we don't know about this portion of your deck, I strongly recommend that you not
use it until such time that it can be fixed or reconstructed to meet the requirements of the Building Code. Of course, as
we discussed in an earlier conversation, a building permit would have to be acquired prior to any work being started.
If you decide to demolish any portion of the existing deck, a demolition permit will be required. However a demolition
permit would not be required if you were in for permit to reconstruct the deck. In that case, the demolition would be
considered part of the new building permit.

Good morning Jerry and Josh,
First let me make it clear, the City Of Eagan does not get involved in any contractual disputes between homeowners and
his their contractors.
Josh,
According to our records the address for this property is 1775 Cliff Rd. The siding permit that was issued on 4/23/13 has
yet to have its final inspection. It is the responsibility of the permit holder (contractor of record) to schedule the final
inspection. We strongly suggest that the contractor of record be present during the final inspection.
I visited this property on 7/3/13 at the request of the present owner (Jerry), to look at some structural framing that was
recently completed on his existing deck. The work, I was told, was performed by Right Away Construction Corp. Any
work done to the supporting structure, guards, hand railings, and stairs of a deck (existing or new) shall not be
preformed prior to the contractor applying for and receiving a building permit for that work. According to our records
there was no building permit applied for or issued for the work that was performed on this existing deck. Performing
this work without a building permit is a violation of the State Building Code. Violation of the Code is a misdemeanor
under Minnesota Statutes, section 16B.69. Please contact me ASAP at (651) 675-5683.
FYI to both Jerry and Josh,
I have pulled the original survey for this property and it appears as though the original deck extended only 4' on the
west elevation of the house. At some point someone added considerable square footage to the deck on that side of the
house. That work, according to our records, was also done without a building permit. Per my observation of the existing
deck during my site visit, the construction of the extension of the deck on the west elevation of the house was not
consistent with the Building Code(s) (past or present). Therefore any repair(s) to that portion of the deck would require
plans that show how the entire deck can be brought into compliance with the current Building Code. These plans shall
be submitted with the required building permit application.
