Correspondingly, the preliminary assessment roll was prepared allocating two "lot equivalents" attributable to your number of lots to share equally street improvements. property in determining the total in the total cost of the recent You have expressed concerns regarding receiving a"double assessment" under this project. If the City were to defer your second lot equivalent assessment obligation and your property never subdivided, the City would not have the Punds to carry that unassessed cost. If the costs were to be deferred with continnous interest accrual, the total financial obligation could potentially exceed any benefit to the property. The alternative of not recognizing the potential of the lot split and dividing the total cost among the existing number of lots would create an inequitable situation should one of these large lots subdivide at a later date, creating a buildable lot that would not have then paid its fair share for its benefit received from these street improvements. After evaluating these different alternatives, we are proposing that the second lot equivalent special assessment allocation be deferred with interest for a maximum period of five years or a subdivision of your existing lot, whichever would occur first. WHEREAS, are the owners of certain real property situated in the City of Eagan, Dakota County, Minnesota, as further described on the attached Exhibit "A"; and WHEREAB, The City of Eagan proposes to assess the owners pursuant to Minnesota Statute Section 429; and WHEREAS, it has been determined by the City that the special assessments will be allocated on a per lot basis; and WHEREAS, it was further determined that Lots 1 and 9 of Block 3, and Lot 14 of Block 2, Clearview Addition, have the ability to further subdivide their property to create two buildable sites; and t+7HEREAS, these subdividable lots would be allocated a special assessment based on two lot equivalents.
