As you are aware, the feasibility report for the above-referenced
project held on September 6, 1988, identified your property as
having the potential to be split into two buildable single-family
lots in conformance with City codes. Correspondingly, the
preliminary assessment roll was prepared allocating two "lot
equivalents" attributable to your

in detail by a Special Assessment Committee comprised of the City
Administrator, City Attorney, Director of Finance and Director of
Public Works. During this review, your concerns were truly
recognized. However, with no City funds available to finance these
type of local improvements, any policy had to take into
consideration an equitable distribution of the total construction
cost to the benefitted properties. If the City were to defer your
second lot equivalent assessment obligation and your property never
subdivided, the City would not have the Punds to carry that
unassessed cost. If the costs were to be deferred with continnous
interest accrual, the total financial obligation could potentially
exceed any benefit to the property.

The alternative of not recognizing the potential of the lot split
and dividing the total cost among the existing number of lots would
create an inequitable situation should one of these large lots
subdivide at a later date, creating a buildable lot that would not
have then paid its fair share for its benefit received from these
street improvements.
After evaluating these different alternatives, we are proposing
that the second lot equivalent special assessment allocation be
deferred with interest for a maximum period of five years or a
subdivision of your existing lot, whichever would occur first. In
order to provide this option, it would be necessary for you to
enter into a Special Assessment Deferral Agreement. A draft copy
of such an Agreement is enclosed for your information and review.
I would also like to remind you of the neighborhood meeting
scheduled for 6:30 p.m., Tuesday, October 10, at the Eagan City
Hall, where I will be available to discuss in further detail any
questions or concerns pertaining to the final assessments prior to
the formal final assessment public hearing scheduled to be held
with the City Council on October 17, 1989, at 7:00 p.m.

SPECIAL ASSESSMENT DEFERRAL AGREEMENT
Special assessment deferral agreement between the undersigned
property owners and the City of Eagan in connection with City
Project No. 545, Clearview Addition, Dakota County, Minnesota.
WHEREAS, are the owners of certain
real property situated in the City of Eagan, Dakota County,
Minnesota, as further described on the attached Exhibit "A"; and
WHEREAB, The City of Eagan proposes to assess the owners
pursuant to Minnesota Statute Section 429; and
WHEREAS, it has been determined by the City that the special
assessments will be allocated on a per lot basis; and
WHEREAS, it was further determined that Lots 1 and 9 of Block
3, and Lot 14 of Block 2, Clearview Addition, have the ability to
further subdivide their property to create two buildable sites; and
t+7HEREAS, these subdividable lots would be allocated a special
assessment based on two lot equivalents.
NOW, THEREFORE, the City of Eagan and the undersigned property
owners do hereby resolve and agree as follows:
1. The undersigned hereby authorize the City of Eagan to levy
special assessment against their property in the amount of
$7,374.86 (hereinafter referred to as the "Total Assessment").
2. The City aqrees to defer payment on the principle of half
of the Total Assessment, that amount being $3,187.43. This
deferment would be for a period of five years. Interest would
continue to be due and payable at the rate of 9% per annum.
3. At the end of the five year deferment period or upon

interest amount would become due and payable within 30 days or
