As you are aware, the feasibility report for the above-referenced
project held on September 6, 1988, identified your property as
having the potential to be split into two buildable single-family
lots in conformance with City codes. Correspondingly, the
preliminary assessment roll was prepared allocating two "lot
equivalents" attributable to your property in deterntining the total
numher of lots to share equally in the total cost of the recent
street improvements.
You have expressed concerns regarding receiving a"double
assessment" under this project. Your specific concern was reviewed
in detail by a Special Assessment Committee comprised of the City
Administrator, City Attorney, Director of Finance and Director of
Public Works. During this review, your concerns were truly
recognized. However, with no City funds available to finance these
type of local improvements, any policy had to take into
consideration an equitable distribution of the total construction
cost to the benefitted properties. If the City were to defer your
second lot equivalent assessment obligation and your property never
subdivided, the City would not have the funds to carry that
unassessed cost. If the costs were to be deferred with continuous
interest accrual, the total financial obligation could potentially
exceed any benefit to the property.

The alternative of not recognizing the potential of the lot split
and dividing the total cost among the existing number of lots would
create an inequitable situation should one of these large lots
subdivide at a later date, creating a buildable lot that would not
have then paid its fair share for its benefit received from these
street improvements.
After evaluating these different alternatives, we are proposing
that the second lot equivalent special assessment allocation be
deferred with interest for a maximum period of five years or a
subdivision of your existing lot, whichever would occur first. In
order to provide this option, it would be necessary for you to
enter into a Special Assessment Deferral Agreement. A draft copy
of such an Agreement is enclosed for your information and review.
I would also like to remind you of the neighborhood meeting
scheduled for 6:30 p.m., Tuesday, October 10, at the Eagan City
Hall, where I will be available to discuss in further detail any
questions or concerns pertaining to the final assessments prior to
the formal final assessment public hearing scheduled to be held
with the City Council on October 17, 1989, at 7:00 p.m.

property owners and the City of Eagan in connection with City
Proiect No. 545, Clearview Addition, Dakota County, Minnesota.

person
of the fee owners of certain real property situated in the City of
Eagan, Dakota County, Minnesota, generally described as
Clearview Addition. Lot 14 Block 2 ; 371d
WHEREAS, The City of Eagan proposes to assess the owners
pursuant to Minnesota Statute Section 429; and
WHEREAS, it has been determined by the City that the special
assessments will be allocated on a per lot basis and;
WHEREAS it was further determined that Clearview Addition
,
Loc 14 Block 2 have the ability to further subdivide
their property to create two buildable sites; and
WfiEREAS, these subdividable lots would be allocated a special
assessment based on two lot equivalents.
NOW, TAEREFORE, the City of Eagan and the undersigned property
owners do hereby resolve and agree as follows:
1. The undersigned hereby authorize the City of Eagan to
levy special assessment agai_nst their pronPrty in the amount of
$6,374.86 (hereinafter refbrred to as the "Total Assessment").
2. The City agrees to defer payment on that part of the
principal assessment allocated to future buildable lots presently
calculated at $3,187.43. This deferment would be for a maximum
period of five years from the date of the adoption of the final
assessment roll for the above-referenced project by City Council
action. Interest would continue to accrue and be due and payable
at the rate of 9% annum.
3. At the end of the five year deferment period or upon
formal Council action approving a lot split or subdivision of this
property (whichever occurs first), the deferred principle and
interest amount would become due and payable within 30 days or
spread over a subsequent twentv year period as a special assessment
against this property or newly created lot, depending upon which
occurrence precipitated its payment.
4. That the undersigned hereby acknowledge that the public
improvements will benefit the above property and hereby
specifically waive any and all rights to contest the amount of the
special assessment and the deferred special assessment pursuant to
Minnesota Statute Section 429.

information available to the City of Eagan pertaining to the
easement referenced in your letter. After checking the Certificate
of Survey submitted with building permit application, the recorded
plat of the Clearview Addition and the City's zoning and section
maps, I cannot find any record or indication of such an easement
existing.
Therefore, I am not able to provide you with the information
describing the location of this easement nor any impact it may have
on Ms. VanBeck's ability to further subdivide her property.
If you could provide information pertaining to this easement to the
attention of our City Planner, Mr. Jim Sturm, he can assist you
with the codes and regulations associated with subdividing property
within our community.
Sorry I cannot provide you with the information you requested in
your letter but hope that we still may be able to do so upon
receipt of additional information.

Please be advised that Pamela Van Beck is a client of this
office. I recently met with Ms. Van Beck to review this City's
tax assessment surrounding project 545. I have taken tile
opportunity to review your correspondence dated October 6, 19891
which discusses how Ms. Van Beck's property has the potential to
be split into two buildable single-family lots in conformance
with City Codes.
Ms. Van Beck has expressed her concern regarding the presence of
an easement in the area held by the Great Lakes Pipeline Company
which is recorded of record.
I would appreciate if you would provide me with information
describing the location of the pipeline and easement in
connection with Ms. Van Beck's property and how the presence of
the pipeline and easement impacts upon Ms. Van Beck's ability to
split her property into two lots.

Upon receiving and filing the Report of the Examiner of
Titles in the above entitled matter,
IT IS ORDERED, That you, and all persons interested,
appeaz before this Court in the Dakota County Government Center,
Hastinqs, Minnesota, on Wednesday, the 12thday of June ,
1985, at 9:00 a.m., or as soon thereafter as said matter can
be heard, and then show cause, if any there be, why this Court
should not enter an order cancellinq Certificate of Title No.
55823 and enter a new Certificate of Title for the land therein
described in favor of U.S. Home Corporation free from the following
restrictions: .
"The covenants herein are to run with the land
and shall he binding upon the parties and all
persons claiming under them.
No business, trade or manufacture of any sort
or nature shall be conducted on the premises,
hereby conveyed; no building shall be erected
thereon, except one private dwellinq house for
one family, with a garaqe appurtenant thereto.
That said dwelling house and garage to be built
thereon shall not cost less than $20,000.00"
but said Certificate of Title shall contain the following easement
in the body of the Certificate:
"Subject to the following: an easement held by

recorded in Book 39 of Miscellaneous Records,

service o£ summons in a civil action; that it be served at
least 11 days prior to such hearinq upon any of the above named
