We have completed our review of the construction documents submitted in pursuit of
obtaining a building permit for the above-referenced project. The comments listed below
are limited in scope to selected areas of special concern and are not intended to
comprise a complete and exhaustive report. This report confirms our prior conversation
regarding several of these items and also includes a few additional items for your
attention. It is our hope that this report will be of benefit to you in achieving a project that
complies with the various state and local codes, laws, and ordinances.
The structural engineer of record must complete the enclosed Special Inspection
and Testing Schedule form. Please return the form to our office after obtaining all
of the proper acknowledgement signatures. Each special inspector, fabricator, and
testing agent must submit a Final Inspection/Test Report or Certificate of
Compliance, as applicable, to our division before a Certificate of Occupancy will
be issued for the building. Guidelines for special inspection and testing
accompany the schedule--Uniform Building Code (UBC), sections 302(c) and
306(c) and (g).
Please note that the Uniform Building Code Standards referenced in the building
code (a list occurs in chapter 60) are a part of the code. Other standards
providing equivalent pertormance may be used oniy when such alternates are
approved by the buiiding official under the provisions of Section 105 of the building
code--UBC, section 6001.
Provide verification tfiat the proposed lighting power budget complies with the
Model Energy Code (MEC), section 505 as amended by Minnesota Rules, part
7670.0800, subpart 2. Piease note that this amendment requires, with certain
modifications, the budget to be calculated in accordance with 1993 criteria as
specified in the Code of Federal Regulations, title 10, part 435.103.

6. The structural design aspects of sheets A1C, A1D, and A13 should be certified by
a structural engineer. The project specifications (sheets S1 through S9 and MPE)
must be certified by the respective design professionals responsible for their
preparation--Minnesota Rules, part 1800.5200 and UBC, section 302.
7. Please submit ca(culations substantiating that the buiiding overall thermal envelope
is in compliance with the Minnesota Energy Code (Minnesota Rules, chapter
7670)--MEC, section 104.2
8. In reference to the notes on sheet M-1, please be advised that Minnesota Rules,
part 7670.0450 adopts the 1989 edition of ASHRAE Standard 62.
9. In reference to the notes on sheet P-1, handicap accessible lavatories shall have
a clear access width of not less than 31 inches--Minnesota Rules, part 1340.0500,
subpart 3.
10. Please verify that the dumpster and container locations comply with Section
11.201(d) of the Minnesota Uniform Fire Code.
11. A weather-resistive barrier must be provided oyer the plywood sheathing prior to

RE: PARK CENTER 3RD ADDITION - TACO BELL CORPORATION
The Advisory Parks, ftecreation and Natural Resources Commission reviewed the above
referenced proposal at their December 3, 1992 meeting and make the following
recommendations to the City Council:
That this proposal be subject to a cash parks dedication.
2. That this proposal be subject to the costs of the bituminous trail along Cliff
Road based on the lot frontage at the City's current trail rate. The cost shall
be 254 frontage feet at $12.05 per foot obligating the applicant to a total trails
cost of $3060.70. This amount shall be paid at the time of building permit
application.
3. The water quality treatment requirements for the entire Park Center Plan
Development have been met with the construction of Pond AP-50. Therefore,
neither additional ponding requirements nor cash dedications are
recommended.

SCOPE: This examination is limited to the design of this particular project only insofar as the provisions of the
Minnesota Plumbing Code, as amended, apply, and does not cover the vrater supply or sewerage system to
which this plumbing system is connected. The examination of plans is based upon the supposition that the data
on which the design is based are correct, and that necessary legal authority has been obtained to construct the
project. The responsibility for the design of structural features and the efficiency of equipment must be taken by
the project designer. Approval is contingent upon satisfactory disposition of any requirements included in this
report.
INSPECfIONS: Special care should be taken to insure that the material and Installation of the plumbing system
are in accorclance with the prwisions of the Minnesota Plumbing Code. It is necessary that the State Health
Department make roughing-in and final inspections of the plumbing system to determine whether it complies
with the code. Provisions should be made for applying an av test at the time of the roughing-in inspection as
outlined in Minn. Rules, p. 4715.2820, of the code. In order to facilitate this work, a self-addressed card is
attached which should be returned to this office. The name of the plumbing contractor should be indicated so
arrangements can be made for the contractor to notify the State Health Department that the installation will be
ready for a test and inspection.
No acceptance of the plumbing installation can be given until inspection and testing of the roughing-in work
(Minn. Rules, p. 4715.2820, subp. 2), finished piumbing (Minn. Rules, p. 4715.2820, subp. 3), and inspection of
the completed installation by a representative of the State Health Department indicates compliance with the
provisions of the code.
REQUIREMENTS:
1. The three-compartment sink should be trapped and vented before the grease trap.
2. If high-temperature water is used in the sanitizing compartment of the three-compartment sink, this
compartment must not discharge through the grease trap.
3. Provide a vent for Fixture S-5.
4. The lawn irrigation system must be provided with an approved backFlow preventer.
5. Sillcocks and wall hydrants shall be provided with a separate inside valve connection (see Minn. Rules,
p. 4715.1800, subp. 7).
6. The maximum water volume per flush of a floor-mounted water closet shall 6e 1.6 gallons. Water closets
shall comply with American National Standarcis Institute At 1219.6--1990 (see Minnesota Statutes,
Section 326.37, subp. 2).
7. Exterior grease traps are prohibited.
8. All plumbing shall be installed in accordance with the Minnesota Plumbing Code.
9. Materials used for the plumbing system shall comply with the standards set in the Minnesota Plumbing
Code. , '
10. The water piping system shall be disinfected in accorciance with Minn. Rules, p. 4715.2250.
11. The plumbing system shall be tested in accordance with Minn. Rules, p. 4715.2820

72. Plastic pipe must be installed in accordance with Minn. Rules, p. 4715.0580(f) and p. 4715.0600. Horizontal
runs of plastic waste and vent pipe above-grade cannot exceed 35 feet in total length. Vertical runs of
plastic waste and vent pipe above-grade may only exceed 35 feet in total height with an approved
expansion joint.
13. Solvent weld joints in PVC and CPVC pipe must Include use of a primer which is of contrasting color to the
pipe and cement (see Minn. Rules, p. 4715.0810, subp. 2).
14. All kitchen plumbing fixtures, except those used for the storage of food or drink, shall be directly connected
to the sanitary sewer.
15. All underground sections of sewer pipe located within 70 feet of water supply pipe shall be constructed in
accordance with Minn. Rules, p. 4715.1770, subp. 2.
16. Provide a cleanout near the building drain connection to the building sewer.
Authorization for construction in accordance with the approved plans may be withdrawn if construction is not
undertaken within a period of two years. The fact that the plans have been approved does not necessarily mean
that recommendations or requirements for change will not be made at some later time when changed
conditions, additional information, or advanced knowledge make improvements necessary.

conformity with the standards of this Department. However, some changes
are necessary and the enclosed report lists these.

Management for review of the plumbing system. You should hear from them

The following are corrections or requests for additional information necessary
before construction of your project:
1. All food and beverage service equipment must meet the applicable
standards of NSF International.
2. Custom food and beverage service equipment shall be designed,
fabricated, located and installed to NSF International requirements.
3. a. Primary food preparation surfaces (tables/counters) must be of
stainless steel construction in compliance with Standard No. 2 of
NSF International.
b. Plastic laminate (formica) surfaces are not acceptable on counters or
tables in food preparation areas.
4. a. Provide a ventilation hood over cooking equipment which eliminates
condensation, vapors, smoke, fumes or excessive odors.
b. Canopy and hood construction must meet the applicable standards of
NSF International. Additionally, the requirements of the Minnesota
Uniform Mechanical Code (Section 2000) covering commercial kitchen
ventilation systems must also be met.
5. Provide and routinely use a chemical test kit to determine the strength
of the sanitizing agent in the final rinse water of tlie three-
compartment utensil washing sink.
6. Wall surfaces in food preparation, dishwashing and storage areas shall
6e smooth, light colored, easily cleanable and nonabsorbent to the
highest level of splash or spray.
a. Sheetrock with an enamel paint finish meets the minimum standards for
nonsplash and dry storage areas.

b. Wall surfaces in splash zones or high moisture areas such as
dishwashing, hand and janitorial sink areas, etc., must 6e finished
with durable, nonabsorbent materials such as:
1) a fiber glass reinforced panel (such as Glasbord or similar
product),
2) ceramic tile, or 3) epoxy resin over waterproof sheetrock.
c. $tainless steel, galvanized metal or equivalent materials shouid 6e
installed behind the cooking line.
7. All equipment must be installed so that it is easily cleanable, that is,
either easily movable, sealed in place or having sufficient space
surrounding the unit to clean in place.
8. a. A11 artificial lighting fixtures ]ocated in food preparation areas,
food storage areas, dishwashing areas and walk-ins shall be
effectively shielded to prevent glass breakage onto food or food
contact surfaces.
b. Install a sufficient number of vapor-proof light fixtures in the
walk-in cooler and/or freezer to provide a minimum of
10 foot-candles of light throughout the unit(s).
9. The doors to the restrooms must be self-closing.
10. The outside doors must be self-closing.
11. A sign must be posted at all public entrances to the establishment
stating that smoking is prohibited except in designated areas. Thirty
percent of the seating capacity in your establishment must be provided
for nonsmokers. Post this area with signs and separate from the
smoking-permitted area by either:
1) a 4-foot wide buffer zone,
2) a physical barrier 56 inches in height, or
3) six complete air changes per hour in the room.
12. A separate on-site inspection will be conducted by the State plumbing
inspector to determine compliance with the Minnesota Plumbing Code.

13. All hot water generating equipment (water heaters) must comply with
Standard No. 5 of NSF International, and be of adequate capacity to meet
the anticipated demand of the establishment.

Minnesota Energy Code
2. We could reduce the quantity of lighting fixtures, thereby
reducing both lighting levels and energy consumption. The
project lighting levels, as currently designed, just meet
the requirements imposed by the board of health. To utilize
this option the board of health requirements would have to
be waived.
We commend the states effort towards energy conservation. We
feel, however, that the current statues do not recognize how the
qua.lity of the visual environment is impanted.
At this time, we can not recommend either of the alternatives
available to us. We are asking, therefore, that the requirement
to meet the energy codes be waived for this project, unless
another cost effective alternative be presented.

WHEREAS, Net Lease Development LLC is or is to become the owner of certain real
property legally described as 2000 Cliff Road, Eagan, Dakota County, Minnesota (the
"Property") on which is operated a"Taco Bell" quick service restaurant.
WHEREAS, title to the Property is subject to a certain Planned Development Agreement
Park Center Addition dated August 15, 1989 recorded as Document No. 906361 by and between
the City of Eagan and Federal Land Company, a[rue and correct copy of which is attached hereto
(collectively, the "Agreement").
WHEREAS, the Agreement imposed certain obligations upon the Property and the other
land therein described.
NOW, THEREFORE, the City of Eagan does hereby state that, except as provided herein,
the Agreement has not been amended or modified, all of the obligations contained in the
Agreement have been fully performed and satisfied, and the sole remaining purpose of the
Agreement is to provide notice of the zoning standards applicable to the property subject to the
Agreement, and the Property and the use thereof as a Taco Bell "quick service" restaurant is in
full compliance with such zoning standards.
This Certificate is provided for the benefit of Net I.ease Development LLC, BNC
National Bank, Commercial Partners Title LLC and Border Foods, Inc., their respective
successors and assigns to induce the purchase, leasing and financing of the Property.
