The Bank was assessed $6,511.00 for reconstruction of Cliff Road. Through the discovery process, the Bank has obtained the City's documents concerning calculation and adoption of the assessments. Examination of those documents shows the City used various assessment methods to assess different roads built through the Project. After lengthy negotiations the Bank is offering to settle this dispute for a reduction in the assessment to $5,500.00. This office recommends accepting the Bank's offer and authorizing the Mayor and City Clerk to execute the attached Stipulation of Settlement. ANALYSIS Project 609 involved the widening a Road from Nichols Road to 35E and Rahn Cliff Road widening and reconstruction commercial parcels on a front-foot basis See the attached map A. The widening Cliff was assessed on an area basis at acre. See the attached map B. The asses commercial properties that abut one of Cliff. nd reconstruction of Cliff Cliff Road. The cost of was assessed to abutting at $76.60 per front foot. and reconstruction of Rahn the rate of $3,339.91 per sed area consists of those roads that feed onto Rahn The question arises whether the Bank was assessed the same as other commercial parcels assessed in the Project. Article 10, Section 1 of the Minnesota Constitution requires that "taxes shall be uniform upon the same class of subjects...". Generally, within special assessment taxation, the requirement of uniformity is further defined to mean that the properties must be assessed an amount proportionate to the benefits each property receives from the improvements. See Anderson v. Citv of Bemidii, 295 NW2d 555, 559 (Minn. 1980). The City must be able to demonstrate that the benefit received by the commercial properties abutting Cliff Road differs from the benefit received by the properties abutting, and in the vicinity of, Rahn Cliff Road, thus justifying different assessment classifications. The City's use of front-foot and area assessments has been upheld in the past when the City constructed Skyline Drive and assessed the abutting parcels both on a front-foot and an area basis. The City also assessed on an area basis three subdivisions that take access from roads that fed onto Skyline Drive. The City's assessment method was upheld by Dakota County District Court Judge Lynch in the Delosh case. Project 609, however, is distinguishable from the Skyline project. In 609, the parcels were either assessed by front foot, as along Cliff Road, or by area, as with Rahn Cliff. It is arguable that the parcels along the roads that feed onto Rahn Cliff were assessed on an area basis, therefore, parcels that feed onto Cliff Road should also have been assessed on an area basis, or those parcels that abutted Rahn Cliff should have been assessed on a front-foot basis. There is the possibility that a judge could rule that the assessments in Project 609 did not treat parcels receiving similar benefits the same way, and throw out the entire assessment. The special assessment herein appealed is for the reCOnetruction of Cliff Road from Nicols Road to I-35E, City of Eagan Project No. 1OP609. 2. The special assessment against the Subject Property is $6,511.00. 3. Appellant filed a written objection to the proposed assessment on october 13, 1993, prior to the assessment hearing at which the assessment was adopted. 4. Appellant is now an aggrieved person as the result of the adoption of the assessment. 10138 _ 5. That Respondent lacked authority to levy the assessment because of failure to comply with the statutory requirements of Minnesota Statute Chapter 429, and other statutory and constitutional requirements for due process. 6. That the assessment was adopted in an arbitrary and capricious manner without regard to the special benefits conferred, without rational support in the record for any determination of benefit conferred and without proper findings. 7. That the assessment was improperly apportioned and calculated in an arbitrary and capricious manner in that a standard formula was applied uniformly to properties not similarly situated and not in the same class, without regard to actual benefit conferred or other proper restrictions on the amount which properly can be assessed. 8. That the total project costs, upon which the assessment was based, were in part based upon estimated costs, not actual costs, resulting in an excessive and unfair assessment. 9. That the assessment exceeds the special benefits conferred and is excessive and arbitrary, and constitutes a taking of the 5ubject Property without just compensation therefor, in violation of the United States Constitution and Minnesota Constitution, Article 1, Section 13. 10. That the assessment ia discriminatory and violates Appellant's constitutional rights of equal protection and due process. 10138 -2- , 11.
