associated with sanitary and storm sewer that were installed to service the
aforementioned property as part of the CliFf Road upgrade project. This easement
needs to be secured to provide maintenance access to the sanitary and storm sewer
near the northeast comer of the property.
Approval by the property owner is necessary for the dedication of the easement.
The notarization of the signatures of the authorized signers is required on the

capacity charges for a11 commerCial, :tistitutional and industrial
building permits and/or connection permits on the basis of the
number of SAC units to be discharged by the facility each year.
The minimum capacity reserved for a commercial, institutional
and 'andustria; permit wili be one SAC unit, To the extent possible,
allocaticr,s for commercial and institutional buildings will be based
on the standard number of SAC units set forth and discussed in the
instructians accompanying the reporting forms. All determinations
of SAC units for industrial users wiil be subject to review and
verification based on actual flow discharged from the industry after
one year of operation to determine if the SAC ass49nment was accurate.
The review will be made or.e year after the date of the :irst discha:ge

SAC unit charges for building and connection permits issued by each municipali*_y

A. Builciing Permit SAC Uni: Cha:ges:
1, All building permits issued by a municipality in accordance
with its municioal ordinance on or after January 1, 1973
sha11 be subject to the SAC unit charge.
?2. Ali buiiding permits issued by a municipality for alterations
? and/or additions to existing buildings will be subject to
a SAC unit charye if the addition or alteration w111 require
additional 5AC units of reserve capacity, The SAC unit will
? be determined :n the same manner used to determine the
SAC units for new buildings,
B. Sewer Connection Permit SAC Unit Charges:
1. AlI sewer connectien permits issued by a municipality under
its municioal ordinances for connectiens to be made on or
after Tanuary 1, 1973 will be subj2ct to a SAC unit cnarge

City levied a special assessment against the Antenna Parcel as

WHEREAS, on October 19, 1993, as part of Project No. 609, the
City levied a special assessment against the Studio Parcel as
follows:

WHEREAS, Entertainment Communications filed a Notice of Objection
to the above-described special assessments and filed an appeal in
Dakota County District Court known as Court File No. C5-93-010158;
and
WHEREAS, the parties wish to settle the dispute concerning the
special assessment of the parcels and enter into this Agreement.
NOW, THEREFORE, the parties agree as follows:
1. The special assessment for Project No. 609 against Parcel
No. 10-03100-012-03, the Studio Parcel, shall remain and be
paid as levied by the City Council.
2. The assessments levied against Parcel No. 10-03100-011-03,
the Antenna Parcel, shall remain in the suru assessed but
shall be paid as follows:
a. The assessment shall be certified to Dakota County by
November 1, 2007 and the first payment for the
assessment shall be made according to the County
payment scheduie in the year 2008, and the final
payment of the assessment shall be due in the year
2023. Payments shall be made pursuant to the attached
schedule which includes 6.5% per annum simple interest
for the 15-year period.
b. If, prior to the year 2003, [expiration of the
originally levied 10 years] the Antenna Parcel (i) is
used for anything other than an antenna site and the
antenna use is discontinued or (ii) the Antenna Parcel
gets platted, for another use and the antenna use is
discontinued (collectively the "Triggering Event") the

and to appeal the payment terms to District Court.

requirements of the City of Eagan necessary for obtaining a Conditional Use Permit.

WHEREAS, on October 19, 1993, as part of Project No. 609, the
City levied a special assessment against the Studio Parcel as
follows:

WHEREAS, Entertainment Communications filed a Notice of Objection
to the above-described special assessments and filed an appeal in
Dakota County District Court known as Court File No. C5-93-010158;
and
WHEREAS, the parties wish to settle the dispute concerning the
special assessment of the parcels and enter into this Agreement.
NOW, THEREFORE, the parties agree as follows:
1. The special assessment for Project No. 609 against Parcel
No. 10-03100-012-03, the Studio Parcel, shall remain and be
paid as levied by the City Council.
2. The assessments levied against Parcel No. 10-03100-011-03,
the Antenna Parcel, shall remain in the sum assessed but
shall be paid as follows:
a. The assessment shall be certified to Dakota County by
November 1, 2007 and the first payment for the
assessment shall be made according to the County
payment schedule in the year 2008, and the final
payment of the assessment shall be due in the year
2023. Payments shall be made pursuant to the attached
schedule which includes 6.5$ per annum simple interest
for the 15-year period.
b. If, prior to the year 2003, [expiration of the
originally levied 10 years] the Antenna Parcel (i) is
used for anything other than an antenna site and the
antenna use is discontinued or (if) the Antenna Parcel
gets platted, for another use and the antenna use is
discontinued (collectively the "Triggerinq Event") the

payments would be spread and made payable over
whichever period is longer, (i) the number of years
remaining through the year 2003, or (ii) five years
from the date of the Triggering Event. Simple interest
at 6.5$ per annum would be calculated over the payment
period.
c. If the Triggering Event occurs during or after the year
2003, the payments would be made five years from the
date of the Triqgering Event. This payment plan shall
be adopted even if payments have commenced pursuant to
Paragraph 2.a, herein. Simple interest at 6.5$ per
annum would be calculated over the payment period.
3. The City will record this Agreement with the Dakota County
Recorder's Office.
4. Entertainment Communications waives all rights granted by
Minn. Stat. Chapter 429 with respect to this assessment,
including but not limited to, the right to notice, hearing,
and to appeal the payment terms to District Court.

WHEREAS, on October 19, 1993, the City of Eagan asaessed land
identified by Property Identification Nos. 10-03100-011-03 and
10-03100-012-03 ("Subject Property") for street and utility
improvements as part of Public Improvement Project No. 609; and
WHEREAS, Entertainment Communications, Inc., the owner oP the
Subject Property, has brought an action in District Court appealing
the assessment identified as Dakota County District Court File No.
C5-93-010158; and
WHEREAS, the parties in this case have settled the assessment
dispute according to the terms described in the attached Stipulation.
NOW, THEREFORE, be it resolved, the Eaqan City Council hereby
adopts the attached Stipulation resolvinq this assessment appeal and
authorizes the Mayor and City Clerk to execute this Stipulation on
the City's behalf.

The undersigned is President of Dakota County State Bank.
Dakota County State Bank is the owner of the real property
referred to as Tax Parcel No. 10-16620-020-02. On October 4,
1993 the Bank received a notice of proposed special assessment
for Eagan City Project 1OP609. Please be advised that the Bank
objects to the proposed assessment by the City of Eagan for
Project 1OP609. It is the opinion of Bank personnel that the
project will not provide any special benefit to the property.
The Bank also believes that the improvements resulting from the
project do not increase the value of the property.
i understand the special assessment hearing will be held
October 19, 1993 at the Eagan Municipal Center. Please make sure
that this written objection to the above-referenced assessment is

Entertainment Communications, Inc. owns Pazcels Nos. 10-03100-011-03 and 10-03100-012-
03. Please take notice that pursuant to Minn. Stat. § 429.061, Entertainment
Communications, Inc. objects to the special assessments proposed to be levied against these
parcels for the above-referenced project. T'he basis of the objection is that the assessments
exceed the special benefit conferred; the assessments aze azbitrary, capricious and
unmzsonable; and the assessments deny full protection of the law and constitute a talring of
property without due process and without just compensation.
When the City of Eagan was considering these proposed improvements, Entertainment
Communications, Inc. strenuously objected to being assessed for the improvements as they
would not increase the market value of its property. The sanitary sewer and water laterals
for Pazcel No. 10-03100-0 11-03 extend into the middle of a ndio antenna field. As the
highest and best use for this land is for a radio station, the laterals and street improvements
will not increase the mazket value of such property. Furthermore, our listeners come to ns
merely by tuning in our station. Consequently, any improvement in accessibility will not
increase the market value of either parcel. In fact, the improvements have completely
eliminated the previously existing separate access for Pazcel No. 10-03100-012-03, thereby
decreasing its mazket value.
For all of these reasons, Entertainment Communicafions, Inc. objects to the proposed special
assessments.

Petitioner Entertainment Communications, Tnc. ('Entertainment Communications") states and
alleges as follows:
1. Fntertainment CommunicaGions is the owner of certain real property located at
2110 Cliff Road in the City of Fagan, Dakota County, Minnesota, ]rnown as Property
Identification Nos. 10-03100-011-03 and 10-03100-012-03 (the 'Property").
2. At a meeting of the Fagan City Council held on or about July 30, 1991, the
City Council approved maldng oertain strcet and utility improvements to Cliff Road and
Rahncliff Road, known as Project 609 (the "Improvements"). At or about the time of such
meeting, a representative of Entertainment Communications objected to any future special
assessments against the Property due w the Improvemenu.
3. By letter dated August 19, 1991, a copy of which is attached as Exhibit A and
incorponted herein, Entiertaii?ment Communications again objected to any special
assessments being levied against the Property dne to the Improvemenu.
4. On October 19, 1993, Entertainment Communications filed with the Eagan
City Clerk a NoGce of Objection to Special Assessments, a copy of which is attached as
Ezhibit B and incorpotated hetein.
5. At the Eagan G5ty Council meeHng held on October 19, 1993, Entertainment
Communications also objected to the special assessments against the Property. The Mayor of
the City of Eagan stated tha[ such objecdon was "quite meritorious" and other City Council
members-discussed the possibility of treating the Property as a different class for purposes of
apportioning the special assessments because of its unique use as a radio station and antenna
field.
6. Tle manner in which the special assessments adopted by the Eagan City
Council on October 19, 1993 have bee? apportioned to the Property allegedly benefitted by
the Improvements is unfair, unreasonable, and conhary to the requirements of Minn. Stat.
Ch. 429, and the 14th Amendment to the United States ConsHtution and Article 1, Section 7,
Article 1, Section 13, and Articie 10, Section 1 of the Constitudon of the State of Minnesota.
7. The amount of the special assessments levied by the Eagan City Council on
October 19, 1993 against the Property is unfair, unreasonable, and contrary W the
requirements of Minn. Stat. Ch. 429, and the 14th Amendment to the United States
Constitudon and Article 1, Section 7, Article 1, Section 13, and Article 10, Section 1 of the
Constitution of the State of Minnesota.
WfMREFORE, Fstertainment Communications, Inc. requests judgment as follows:
1. Setting aside the special assessments levied by the City of Eagan on October
19, 1993 against the Property and barring any further special assessments on the Pcoperty

On October 19, 1993, as part of Public Improvement Project No. 609,
the City of Eagan levied assessments for the improvement of Cliff
Road including utilities. Entertainment Communications, Inc. owns two
parcels on Cliff Road just to the west of the Department of
Transportation Driver's Training Facility. One parcel is used as the
studio of a radio station and the other larger parcel is used as the
antenna for the radio station. The parcels were assessed as follows:

As you recall, the Council directed this office to negotiate a
settlement with the radio station. For the past several months, the
radio station insisted that all assessments should be deferred until
the parcels are put to another use.
Unwilling to accept the radio station's position, we filed a Motion
to Dismiss in July, 1994, arguing that Entertainment Communication's
appeal had not been filed in time. Our argument was based on the fact
that the appeal documents had been faxed to the Dakota County
Judicial Center and had been stamped "received" by the Court staff

the day after the documents were due. The attorney for Entertainment
Communications argues, however that the documents were faxed and
arrived at the Court on time. They contend that although the
documents were not handled by a clerk on the required date, the
documents were transmitted on the correct day, and thus should be
considered to have been received on that date.
Nonetheless, after we filed the motion, Entertainment Communications
discussed reasonable settlement offers which led to the followinq
proposal:
1. The radio station would pay the levied assessments on tha
studio parcel as scheduled.
2. The assessments including principal and interest for the
antenna parcel would be paid with the first payment due
beginning in the year 2008, and payments terminating in the
year 2023.
3. If, prior to the year 2003, [expiration of the originally
levied 30 years) the antenna parcel is used for anything
other than an antenna or gets platted, the payments would be
made over whichever period is longer, (a) through the year
2003, or (b) five years from the data of platting or new
use. Interest would be calculated over the payment period.
4. If, durinq or after the year 2C03, the antenna parcel is
used for anything other than an antenna or gets platted, the
payments would be made five years from the date of platting
or new use. Interest would be calculated over the payment
period.
The settlement agreement reflects the opinion of Tom Metzen, the
City's appraiser 3n this case, as to the City's ability to prove
benefit of this project to these parcels. A copy of Mr. Metzen's
opinion letter is attached.
Enclosed -please find a proposed Settlement Agreement for your review.
if you find the Agreement satisfactory, i request that the Council
adopt the enclosed resolution authorizing the Mayor and City Clerk to
execute the Settlement Agreeanent on behalf of the City.

I have viewed the parcels located on Cliff Road,
across from Dakota County State Bank, identified as
parcel numbers 10-03100-011-03 and 10-03100-012-03, for
the purpose of determining benefit, if any, as a result
of Project No. 609, reconstruction and expansion of
Cliff Road.
It is difficult to prove benefit to parcel 10-
03100-011-03 based on the current uae and location of
the antennas. It is my opinion that the asaeasment on
this parcel be defe=red until such ti.me that the
property is eold or the uae is chanqed.
I feel that the assessments certified to parcel
012-03 are justified and fair.

IINDISPIITSD FACTS
On October 19, 1993, the Eagan City Council levied special
assessments on aPfected properties benefitted by Project No. 609, for
the widening of Cliff Road including parcels owned by Entertainment
Communications (°Petitioner°) identified as 10-03100-011-03 and
10-03100-012-03 (°Subject Property). ee A-2; A-4. On November 17,
1993, Petitioner served its Notice of Appeal of the Special
Assessments ("Notice^) upon the City Clerk. S?eg A-3. On November 29,
1993, the Notice was faxed to Distzict Court. See A-1. The fax
transmission cover sheet (°fax sheet") from Petitioner's attorney's
office is stamped ^RECD" and ^Filed" November 30, 1993. ,$ei A-1. The
Notice was stamped "Received" and °Filed^ on November 30, 1993. ,See
A-2. A December 1, 1993 lattar from Petitioner's attorney remitting

Did Petitioner file its Notice of Appeal within the time limits
established by Minn. Stat. §429.081?
ARGIIMENT
_, petitioner's filing of its Notiae was untimelp and ita appeal
should be dismieaed.
Summary judgment should be granted when there is no question of
material fact and one party is entitled to judgment as a matter of
law. Minn• R. Civ. P. 56.03. As a matter of law, the City of Eagan is
entitled to summary judgnent in the present case.
Minnesota Statutes Chapter 429 governs the special assessment
process and the procedure landowners must follow to appeal the levy
of special assessments. Minn. Stat. 5429.081 permits a property owner
to appeal the adoption of an assessment "to the district court by
serving a notice upon the mayor or clerk of the municipality. The
notice shall be filed with the court administrator of the district
court within ten days after its service." In the present case, the
tenth day after service upon the City of Eagan fell on Saturday,
November 27, therefore the required day for filing was Monday,
November 29, 1993.
This Court has previously dismissed an untimely filing of a
Notice by a property owner and that dismissal was upheld by the Court
of Appeals. ,Se? rrpP7 v Citv of Faaan, 486 N.W.2d 470 (Minn. App.
1992). In Greer, the Notice of Appeal had been mailed to District
Court. It was stamped "Received" on the eleventh day after service on
the City Clerk and stamped "Filed" on the twelfth day. The Court of
Appeals held that Minn. Stat. §429.081 °must be strictly construed
and that proper filinq with the District Court is jurisdictional."
?. at 473. The Court oP Appeals refused to waive the statutory time
limits nor would it consider the Greers' equitable arguments.
Zn the present case, Petitioner filed its Notice of Appeal by
facsimile. Rule 5.05 of the Minnesota Rules for Civil Procedure
qoverns filing by facsimile. Rule 5.05 states that "[f]iling shall be
deemed complete at the time that the facsimile transmission is
received by the court and the filed facsimile shall have the same
force and effect; as the original." (emphasis added) Rule 5.05
requires the facsimile transmission be followed by receipt of the
original document and a$5.00 fee "within 5 days after the court has
received the transmission." Sgg Rule 5.05 Minn. R. Civ. P.
According to the face of the Pax sheet and also the Notice, court
persoanel stamped both documents ^Received" and ^Filed° on November
30, 1993. Filing occwrred the same day the documents were received,
as zequired by Rule 5.05. The Notice should be regarded as received
on November 30, the day the Notice and fax sheet were so stamped. The
word "Received" is clear and unambiguous and the precise word used in
Rule 5.05 to indicate the time of filing.
The word "Received" on the Notice and in 5.05 should be given its
ordinary and common meaning as is required by general rules of
construction such as contained in Minn. Stat. 5645.08(1), applicable
to statutes. Similarly, when the language of a contract is clear and
unambiguous, no extrinsic evidence is used to alter the plain meaning
of the contract regardless of the alleged intent of the parties. ee
Starr v. Starr, 312 Minn. 561, 251 N.W.2d 341, 342 (1977)i tv of
,;rc;n;a v Northland Office Proue ies,' 465 N.W•2d 424, 427 (Minn.
App. 1991) p.at• reY• e'e (Minn. April 18, 1991). According to the
stamp on the documents, a faxed document is cansidered received when
it is so stamped by a clerk. To claim otherwise, renders the clerk's
action moot and the word "Received" on the document meaningless. If a
clerk placed the notation on the document the notation must have
meaning. Zn this; case, the stamp "Received" means precisely what it
says: The Court was for the first time in possession of the document.
The fact that the document was received on November 30, 1993, and
thus considered filed on November 30, 1993, is bolstered by the Court
Administrator's Notice that the case was opene8 on November 30, 1993.
Further °[t]he original record made by any public officer ia the
performance of official duty shall be prima facie evidence of the
Pacts required or permitted by law to be recorded by the officer.^
Minn. Stat. 5600.13. The phrase °Received Novembar 30, 1993" stamped
on a document by the court administrator's office is prima facie
evidence of the fact that the document was received on that date by
District Court.
Finally, in determining whether Petitioner followed the facsimile
procedure required by Rule 5.05, the City is forced to rely on the
^Received" stamp placed on the December 1, 1993, letter from
Petitioner's attorney transmitting the $5.00 fax fee. The December 1,
1993 letter is stamped ^Received" on December 2, 1993. It is absurd
to expect the public to accept as accurate the „Received" notation on
the December 1, 1993, letter but to ignore the "Received" notation on
the fax sheet. The "Received" notation must be qiven the same effect
for both documents.
The stamped wo;d °Received,° on the fax sheet and the Notice is a
very clear indication of when the Notice was filed with District
Court. The date of filing fs buttressed by the Court Administrator's
Notice that this case was opened November 30, 1993. According to the
words on the face of the documents, Petitioner'B Notice was filed 11
days after it had been served on the Eagan City Clerk. Pursuant to
Grggr, Minn. 5429.081 should be strictly construed and Petitioner's
assessment appeal should be dismissed as untimely.

Peationer Entertainment Communicauans, Inc. ("Entertainment Communications") states and
alleges as follows:
1. Entertainment Communications is the owner of certain real property located at
2110 Cliff Road in the Ciry of Fagaa, Dakota County, Minaesota, ]mown as Property
Identification Nos. 10-03100-011-03 and 10-03100-012-03 (the "Property')•
2. At a meeting of the Fagan Ciry Council hdd on or about July 30, 1991, the
L'ity Councu appmved ,nalang certain streu and utilitY imPrevemer:u to Ciiff Road and
Rahncliff Road, irnown as Project 609 (the 'Improvemenu"). At or about the time of such
meeting, a representative of Entertainment Communications objected w any future special
assessments against the Property due to the Improvements.
3. By letter dated August 19, 1991, a copy of which is attached as Exhibit A and
inwrporated herein, Entertainment Communications again objected to any
assessments being levied against rty due to the Improvements.

eliminaud the previously cxisting separau access for Parcel No. 10-03100-012-03, thereby
decreasing its market Value. '

It has come to our attention that the Notice of Appeal of the
epecial assessment action for Entertainment Communications was not
timely filed in Dakota County District Court. Minn. Stat. 5429.081
requires that the Notice of Appeal of a special assessment be filed
with the Court Administrator for tha District Court within 10 days
after service of the Notice on the City Clerk. The Court file
indicates Entertainment served Mr. Gene VanOverbeke, Eagan City
Clerk, on November 17, 1993. The Court file documents show that
the Notice of Appeal is stamped "received" on November 30, 1993.
The tenth day after service was actually Saturday November 27,
1993, so the filing time was extended until Monday, November 29,
1993. Rule 5.05 of the Minnesota Rules of Civil Procedure permits
filing by fax but "[f]ilinq shall be deemed complete at the time
that the facsimile transmission is received by the court ***."
(Emphasis added) The document was received on November 30, 1993,
which is not timely.
The requirement that a property owner strictly adhere to the time
limits aet out in Minn. Stat. 5429.081 was addressed by the
Minnesota Court of Appeals in Greer v. Citv of Eaaan, 486 N.W.2d
470 (1992). In that case, the landowners likewise did not file in
a timely fashion with District Court and the Court of Appeals
affirmed the District Court'e dismissal of the assessment appeal.

In our telephone conversations, we have both expressed the desire to resolve this matter
amicably and without the expenditure of much time and money by the parties involved. The
offer contained in this letter is intended to attain this goal.
As you lrnow, Entertainment Communications, Inc. owns two parcels, one consisting of an
antenna field ("Antenna Parcel") and the other consisting of a studio building ("Studio
Parcel"). The imprrnemenu constructed by the City of Eagan consist of water and sanitary
sewer laterals eztending into the antenna field and assessed against the Antenna Parcel, and
improvements to Cliff Road assessed against both parcels.
T'he station currently broadcasts on both the AM and FM bands. While this is yet to be
widely disclosed in the newspapers, Entertainment Communications recently entered into an
agreement to sell the station's FM broadcast rights. As Ron Kazda, the station's chief
engineer, ezplained in our meeting wich Mike Fcertsch, the AM signal is broadcast from
Eagan, while the FM signal is broadcast from Shoreview. The AM station is not affected by
this sale. As Ron Kazda ezplained, the four AM radio towers and accompanying
underground grid system permit a party holding this type of AM license to meet strict FCC
requirements for pattem and coverage. Consequenfly, it would be very difficult, if not
impossible, to move the AM towers without losing the license. As a result, the water and
sewer laterals and the Cliff Road improvemenu provide no special benefit to the Antenna

parcel. Additionally, the improvements provide no special benefit to the Studio Parcel-the
radio station goes to its listeners, the listeners do not go to the station property. 77ie
improvements also removed the access from the Studio Parcel to Cliff Road. The Studio
parcel now is only accessible to Cliff Road by means of access through the Antenna Parcel•
While the above states our position in li6gation, Entertainment Communications is willieg to
resolve this matter by entering into an agreement with the City providing that the full amount
of the Cliff Road impmvements be levied against both parcels, excepY that the payment of the
first installment of the assessments would be defeaed without interest until the replatting of
such parcel, as provided in Minn. Stat. § 429.061, subd. 2. The agreement would also
provide that the water and sewer laterals would not be levied against the Antenna Parcal, as
such imprpvements provide no speciai benefit W this parcel.
We believe that this offer reflects the view of the City Council ezpressed at the council
meeting held on October 19, 1993, during which it adopted the final assessment roll. Mayor
Eagan stated that the useful life of the water and sewer laterals was approximately 30 years
and that he did not see much of a possibility of a hookup within the useful life of such
improvements. Council Member Wackter stated that the assessments should be deferred until
the property is put to a different use. Finally, Council Member Hunter eacpressed his view
that a court would find that the use of these parcels for a radio station is dissimilaz from
other uses along Cliff Road, and that a court consequently would uphold the council ueating
these parcels as a different class of properry•

In the event of litigated appeal, we should get a copy of the FCC
license and in addition, have Garret Liziak or John DeBois or someone
that they recommend review the statements made by Razda. Mike
Foertsch and I believe that the front right-of-way of the property is
highly developable. However, Kazda disputes that and says that any
movement of the towers or the in-qround pattern would effect their
transmissions greatly but it was not specific as to the amount of
change.
Mike and I took the position with Kazda and Springer that we wou13
offer the same as Lakeview Trails, that is they could pay one half of
the water assessment now with the balance payable upon connection
together with the interest on the assessment or in the alternative,
at the then current water lateral rate. Mike Foertsch said that they
would take the engineering index of costs and apply that since this
is not a trunk matter but a lateral matter. Kazda asked if it did not
also make sense to do that with the sanitary sewer. While not
agreeing, we said that that was not necessarily illogical. They also
asked about the road assessment and both Mike Foertsch and I agreed
that the road assessment had to stay.
Mike and I also agreed that our fall-back position would be that they
could defer all of the sanitary or water until hook up but that the
street would have to be paid.
Springer argued that the real question on the property is highest and
best use. His argument is that it ie a radio station and as a result
no assessments are due.
Springer and Razda will check with Jack Donleavy, attorney for
Intercom which apparently owns the property. Both Mike and I expect
that the radio station company will file its appeal by Thursday.
Kazda also raised the question of the driveway access which
apparently has been taken from the building property and put on the
antenna property. Mike Foertsch said that that was probably by
agreement (coerced or otherwise) with the County and that that was
not a City issue.

On November 15, 1993, Mike Foertsch and I met with Ron Kazda,
Engineer and Joe Springer, Attorney for the radio station. The radio
station has two pieces of property as shown on the attached map;
Parcel 011-03 and Parcel 012-03. The first parcel 011-03 parcel has
466 feet of frontage and has been assessed street assessments of
$35,756.88; a sanitary sewer assessment which is one half the cost of
a stub which goes from the street to the common property line between
the antenna property and the State of Minnesota Driver's License
property. That assessment is in the amount of $7,546.14 for the
antenna piece. There is also a water lateral stub into the property
solely for this antenna property in the amount of $9,626.75.
Apparently the building property (012-03) has already paid sanitary
sewer and water lateral costs. The second parcel 012-03 has a
building on it and 263 feet of frontage. It has been assessed street
costs of $20,161.12.
The property is not platted but rather divided on a metes and bounds
description into two parcels. The total proparty composes about 19.8
acres and is zoned and comp quided Limited Business. The use is
currently an a.m. radio station with 5000 watts i.e., 5 kilowatts of
power. The four radio antennas have 120 radials each at 3 deqree
intervals. Rccording to Kazda, the radials are 220 feet in length and
6 to 8 inches deep in the ground. Kazda drew a diagram of one on our
plat map. In addition, the antennas and the building are connected
with four-inch copper strap and there are also cross pieces of
four-inch copper strap which the radials also connect to. The radials
are constructed of No. 10 copper wire. Razda estimates,that it costs
$1,000,000.00 for the towers, radials, and the in-place wire. Kazda
also states (although I am somawhat skeptical of this) that the
alignment as laid out is the only alignment with which the a.m. radio
station can get its required pattern. The patter is irregular in the
sense that it is not circular. Rather, the station is not permitted
to transmit as far in some areas since it would interfere with other
leqitimate signals. Kazda reports that the FCC license restricts this
and further, that they have monitoring stations at Stresse Lane in
Apple Valley and at the cemetery at Pilot Rnob at County Road 42 in
Apple Valley which are checked at least monthly.
