There have been complaints of pool backwash from Donald Gueltzow's pool at
3908 Palisade Way (Lot 10, Block 6, Cedar Grove 8th Addition). The poo2
backwash travels down the slope to the drainage easement and then moves slowly
to the storm sewer catch basin on the east edge of both lots.
Mr. Kuhn purchased and occupied the dwellinq on or about April lst, 1979 and
the first complaint was received during June of 1982.
Mr. Gueltzow had the pool installed in September of 1976.

Re: Swimming Pool Discharge
On August 19, 1983, I met with Mr. DonaldGueltzow of 3908 Palisade
Way, and discussed the pool filter, backwash water problem with
him. He assured me that he would place an extension on the existing
discharge pipe and when he backwashes his pool, he would discharge
the water onto his own property away from property lines.
I also explained to him that if he did not properly discharge the
water when he backwashed his pool filter, the City would have to
construct a drainage system and all benefitting property owners
would be assessed for its cost.
I believe that you will get full cooperation from Mr. Gueltzaw
in resolving this matter.
Please let me know if you have any further problems in this regard
and we will have to resolve it as I have explained above.

problem. Ihave checked with several landscaping companys and
the Eagan city engineers. They have given me ideas of
either tilling or landscaping with additional dirt to get
the water to the nearest storm sewer which is in my neighbors
back yard. Right now the water drains to my yard and stays
there.

A swimming pool ordinance was considered by the City Council at the regular
meeting on Tuesday, April 19, 1983. The City Council decided not to adopt
the ordinance; however, the proposed legislation was to be retained on
file and considered in the future if required. The City Council did, how-
ever, direct the staFf to perform a study regarding direct drainage from
swimming pools.
As you recall, the direct drainage relates to swimming pool backwash,
cleaning and drainage onto private property, utility easements and adjoining
property. I would like you to perform a study regarding the direct
drainage of swimming pools, and if you need any further clarification,
please make reference to the April 19 minutes when they are prepared or
we will follow with some additional questions for the City Council at the
May 3 meeting for further clarification.

Thank you for your appearance and comments at the last regular City Coun-
cil meeting regarding proposed swim ming pool regulations. It was the deci-
sion of the City Council to retain on file and consider in the future if
the need is evident this ordinance. The City Council did, however, direct
the Director of Public Works to perform a study regarding direct drainage
of swimming poots as it relates to surrounding property to include drainage
easements. The Director of Public Works, Mr. Tom Colbert, will be per-
forming this study, and when a copy is ready for review by the City Council
you will be notified.
Thanks again for your input and consideration. Please understand that
the proposed swimming pool ordinance was not adopted and therefore is
not enforceable. However, it will be retained on file and possibly con-
sidered in the future.

POLICS DEPAATMENT
Chief DesLauriers appeared and discussed with the Couneil the problems
that were experieneed by the Police Department regarding the operating of five
Diesel squad cars purchased through General Motors Corporation. A letter from
City Attorney Paul Hauge and alternatives concerning the potential recovery by
the City of Eagan of its loss dve to the problems with the squad cars were
discussed in detail. Council had also diseussed this at earlier meetings,
correspondence had taken place and discussions with representatives of General
Motors Corporation and local dealers. Egan moved, Smith seconded the motion
to authorize the City Attorney to commenee an action against General Motors
and the appropriate dealers from whom these diesel squad cars were purchased
for recovery of damages incurred on behalf of the City due to the defects in
the squad cars experienced by the City Police Department; that negotiations
continue, however, with General Motors and the dealers concerning the claimed
damages; further, that the Couneil be apprised of the progress of the action
and that also the costs incurred by the City in pursuit of the lattsuit. All
voted in favor, except Waehter who voted no.
FIAH DEPARIMENT
The Mayor made presentations to six firefighters who retired from the
Eagan Volunteer Fire Department in recent months. Special presentations were
made to Dean Jensen who was on the Fire Department from July 1, 1963 to
December 31, 1981, James (Bud) Malaske from July 1, 1963 to July 2, 1982,
Mervin (Mae) Carll from 3uly 1, 1963 to July 2, 1982, Duane Gaudette Prom July
24, 1967 to August 1, 1982, Donn Smith from July 1, 1963 to July 3, 1982, and
Jay Berthe from July 1, 1963 to July 2, 1982. The Mayor and Council thanked
the retired Firefighters for their long service to the City. All the retired
Firefighters were present except Dean Jensen.

A letter was received From Mr. and Mrs. Gerald Kuhn, 1722 Cochrane Avenue
complaining about the inconvenience and damages caused by water drained on to
their property from the backwash of the neighbors swimming pool. Mrs. Kuhn
was present and urged the Council to adopt an Ordinance that would require the
adjoining property owners who install swimming pools to install dry wells or
pump water to the storm sewer to reduce any impact from water run-off on
adjoining property. Smith moved, Wachter seconded the motion to 3irect the
staFf to investigate the possibility of such regulations or ordinance covering
the request made by the Kuhns in similar situations and report to the Council.
All voted in favor.
