I am writing to appeal the City of FJ?gan's recent denial of a building permit for structures
numbered 16 and 18 on Lots 3 an5 o Eagan Heights Phase 2. Town and Country Homes fully
understands the risk of constructing t iese buildings, with the pending condemnation of the
sanitary sewer easement to permit that hookup.
To provide assurance to you that we will hold the City of Eagan harmless of any claims, we
would like to offer the following for your consideration:
A. We hereby reaffirm and acknowledge the statements included within the
Development Agreement between Town and Country Homes and the City of
Eagan, which state that no certificates of occupancy will be requested or granted
until the full sanitary sewer connection off site is made.
B. We reaffirm ow commitment to hold the City harmless of any and all claims
related to this matter.
C. To provide further assurance that the sanitary system will not be used during the
interim, when the buildings are under construction, no plumbing fixtures, with the
exception of showers and tubs, will be installed until the off site sanitary hookup
is made. We are only asking for the waiver on tubs and showers because of where
they fit into the construction framing process. By our agreeing to not install the
other plumbing fixtures, this certainly precludes sanitary sewer use and makes the
building incomplete in response to the comment in the first pazagraph of Gerald
E. Deloss' June 30th Memorandum.

MEMORANDUM
This Memo is in response to your question regardingthe issuance of a building permit for a house
which may not receive sanitary sewer until well past the date of completion of construction. Based
upon my review of the Eagan City Code, State Statute and Minnesota Regulations, I do not
believe the City can or should issue the permit. The building permit(s) should not be issued until
the development is in compliance with State and local laws.
The Eagan Code, Section I 1.40, Subd. 7, provides that before the City shall issue a Building
Permit, it shall review the plans and determine whether the application complies with the Building
Code and other applicable laws. Thus, under the code, the obligation is on the City to determine
whether the application complies with the Code and State and local laws.
Under Section 4.01 of the Eagan Code, the Minnesota Building Code, Minnesota Plumbing Code
and Minnesota Pollution Control Agency Regulations conceming individual sewage systems are
adopted.
Under the Minnesota Plumbing Code, a public sewer must be utilized if available and accessible.
If the public sewer system is not accessible, an individual sewage disposal system, conforming to
the published standards of the City, must be provided. The Eagan Code provides that the use
of an individual sewage systems is prohibited when the lot area is less than one acre.
It is clearthat the townhome units will not have lots exceeding one acre in size. Therefore, they
are prohibited by the City Code from utilizing individual sewage systems. Accordingly, Building
Permits should not be issued because the development would not be in compliance with the
State Building Code or State Plumbing Code.
