DRAINAGE AND UTILITY EASEMENT
THIS DRAINAGE AND UTILITY EASEMENT is made this 26th day of
September , 2006, between EAGANDALE BUSINESS CENTER, LLC, a Minnesota
limited liability company, (hereinafter referred to as °Landowner"), and the CITY OF EAGAN, a
municipal corporation, organized under the laws of the State of Minnesota, (hereinafter referred

That the Landowner, in consideration of the sum of One Dollar ($1.00) and other good

hereby grant and convey unto the City, its successors and assigns, a permanent drainage and
utility easement, over, across and under the following described premises, situated within Dakota
County, Minnesota, to-wit:

recorded plat thereof, Dakota County, Minnesota, described as follows:
Commencing at the northwest corner of said Lot 2; thence North 89 degrees 59
minutes 37 seconds East, assumed bearing, along the northerly line of said Lot 2,
a distance of 290.02 feet to a point of curvature on said northerly line of Lot 2
thence southeasterly a distance of 13792 feet on a tangential curve, concave to the
south, having a radius of 58230 feet and a central angle of 13 degrees 34 minutes
15 seconds, and along said northerly line of Lot 2, to the point of beginning of the
easement to be described; thence continuing along said 58230 foot radius curve,
being said northerly line of Lot 2, a distance of 73.94 feet and central angle of 7
degrees 16 minutes 31 seconds;thence South 64 degrees 43 minutes 21 seconds
East, not tangent to said curve, a distance of 77.98 feet; thence South 53 degrees

The grant of the foregoing permanent easement for drainage and utility purposes includes
the right of the City, its contractors, agents and servants to enter upon the premises at all
reasonable times to construct, reconstruct, inspect, repair and maintain pipes, conduits and mains;
and the further right to remove trees, brush, undergrowth and other obstrucUons. After
completion of such construction, maintenance, repair or removal, the City shall restore the
premises to the condition in which it was found prior to the commencement of such actions, save
only for the necessaxy removal of trees, brush, undergrowth and other obstructions.
And the Landowner, iis successors and assigns, does covenant with the City, its
successors and assigns, that it is the Landowner of the premises aforesaid and has good right to
grant and convey the easement herein to the City.
IN TESTIMONY WHEREOF, the Landowner has caused this easement to be executed

We have started our review of the construction documents submitted in pursuit of obtaining a building
permit for the above -referenced project. This review is not intended to be an exhaustive and
comprehensive report. Unless otherwise noted, all references are to the 2000 I.B.C. It is our goal that
this review will help you in complying with the applicable codes and we are, therefore, requesting that
the following items be addressed:
1. Even though some of these submittal requirements may seem redundant, please provide the
following with all four buildings:
a) Special Inspection & test schedule. (signed and dated)
b) Energy Calculations
c) Fire stopping submittals for all possible situations
2. Stair risers shall be 7" maximum (SEC.1003.3.3.3)
3. Please provide UL listed and tested wall, floor and roof assembly diagrams to compliment
listings provided in the code analysis.
4. Specify which NFPA sprinkler system will be used. Address concealed spaces. (floor ceiling
and roof ceiling)
5. Provide details for elevator lobbies and/or elevator draft curtains. (chapter 1307 2003 MSBC)
6. Provide or identify details for fire barrier continuity complying with SEC 706.4.
7. Provide second floor & roof framing plans.
8. Provide or identify framing details for stair landing connection to rated stair enclosure
barriers.

Dear Mr. Novaczyk,
We have re-evaluated the construction classification of the 1335 and 1345 buildings, and based
on Table 503, determined that the appropriate type of construction should be V A. We are
comfortably within the allowable range of square footage and height limitations with this
classification. This change allows construction in which the structural elements, exterior walls
and interior walls may be of any material allowed by the code. The only significant difference is
that the exterior walls may now be of 1 -hour construction.
As such we have modified the title page and appropriate details on sheets A140 and A141 to
reflect this change. It is our intention to eliminate the future use of intumescent paint and the
double layer of gypsum board on exterior walls, as these elements are no longer required.
Please advise if you have any comments regarding this change of classification.

Subject: Elimination of vent at elevator
Dear Mr. Novaczyk,
This is to request that the smoke vent noted on 2/S141A be eliminated. This vent is not required
due to an amendment to ASME in the elevator code. 1307.0065 Amendments to ASME A17.1-
1996 Subpartl. Rule 1004 states that shafts (hoistways) housing elevators having a travel
distance of 25 feet or more shall be vented to the outside. Our travel distance is 20'-4 3/4", which
is under the 25' requirement, and therefore, not required.
Unless exception is taken to this letter, we will proceed as noted above.

Subp. 17. Additional doors. Doors other
than the hoistway door and the elevator car
door shall be prohibited at the point of access
to an elevator car.
1307.0065 AMENDMENTS TO ASME
A17.1-1996.
Subpart 1. Rule 100.4. Rule 100.4 is
amended by deleting the first paragraph and
replacing it with the following: Hoistway
venting. Shafts (hoistways) housing elevators
having a travel distance of 25 feet or more
shall be vented to the outside. The area of the
vent shall be not less than 3-1/2 percent of the
area of the elevator shaft, provided a
minimum of three square feet per elevator is
provided. The venting of each individual
hoistway must be independent from any other
hoistway venting, and the interconnection of
separate hoistways for the purpose of venting
is prohibited. Keyed manual remote devices
must operate vents. Keyed manual remote
devices must be provided with visual
indicators for open or closed status and must
be located adjacent to the fire control panel, if
provided, or the elevator lobby on a
designated floor. Vents must not be of

automatic operation such as by fusible links
or smoke or fire detection. Vents must be
located in the side of the hoistway enclosure
directly below the floor or floors at the top of
the hoistway, and must open either directly to
the outer air or through noncombustible ducts
to the outer air; or in the wall or roof of the
penthouse or overhead machinery space
above the roof when the openings have a total
area not less than the minimum specified in
this part. Vents passing through machine
rooms must be in noncombustible ducts and
must provide and maintain access around
electrical and mechanical equipment. When a
vent is installed in the roof of the hoistway, a
protective grille must be provided to prevent
persons from falling into the hoistway.
Subp. 2. Rule 101.5b. Rule 101.5b is
amended to read as follows: When relay
logic or solid state equipment is used to
operate the elevators, the elevator equipment
room and hoistways must be provided with
independent natural or mechanical equipment
to maintain an ambient temperature of 50
degrees to 90 degrees Fahrenheit or as
otherwise permitted by the manufacturer of
the listed equipment. When standby power
is connected to elevators, the machine room
and hoistway ventilation or air conditioning
must be connected to standby power.
Subp. 3_ Rule 102.2(c)(3). Rule 102.2(c)(3)
is amended by adding an exception to read as
follows:
Exception: If sprinlders are added in an
existing elevator machine room or hoistway,
automatic disconnect of the main power
supply is not required if the existing elevator
is hydraulic, installed prior to the adoption of
ASME A17.1-1996, and equipped with Phase
I and Phase II firefighter's service in
compliance with Rules 211.3 through 211.9.
This exception does not apply to elevators
being altered.
Subp. 4. Rule 106.1b(3). Rule 106.1b(3) is
amended by adding a paragraph to read as

Subject: Correction of Fire Treated Framing at Exterior Walls
Dear Mr. Schoeppner,
As discussed with Mr. Craig Novaczyk on November 16, 2005, while inspecting the site
construction we observed that the exterior walls of the 1345 building were not constructed with
non-combustible materials as required to meet the 2 hour assembly rating. As non-combustible
materials may be fire -treated lumber per code, to correct this issue we proposed a two -coat
application of Albi Manufacturing's 107A fire retardant intumescent paint to the exposed
surfaces. This product is recognized as the "Standard of the Industry" due to its special
formulation of intumescent components. It is designed for maximum protection of combustible
or noncombustible surfaces and reacts to flame or heat by foaming into a thick cellular insulative
blanket.
This product has been extensively tested by Underwriters' Laboratories, Inc., the Federal
Government, and is approved by major building codes and insurance rating organizations. In
addition, this product was subjected to a 30 -minute extension of the ASTM -84 test procedure.
This rating provides an equivalent to pressure treated, fire retardant lumber and is so approved by
the State of California (guide 2280) when applied in two coats.
It is our understanding that you, as the City of Eagan's Chief Building Inspector, are willing to
accept this corrective measure with the requirement that as Architect of Record, we will certify
that the materials are installed per manufacturer's recommended installation procedures and
applied in two coats. We commit to follow this requirement and will submit a letter certifying to
these facts as observed.

PRODUCT DESCRIPTION:
Albi 107A is a solvent based synthetic coating. Recognized
as the "standard of the industry," Albi 107A provides
excellent fire retardant properties due to its special
formulation of intumescent components.
Designed for maximum protection of all combustible or
noncombustible surfaces, it reacts to flame or heat at 300
degrees F by foaming into a thick cellular insulative
blanket. This carbonaceous foam sharply limits the spread.
RECOMMENDED USES:
of flame and insulates the surface to which it is applied.
Albi 107A reduces smoke development to low levels,
critically important in assuring rapid escape from fire.
Applied like conventional paint, this intumescent coating
provides excellent durability and wear resistance as
evidenced by wash, leaching and scrub ability tests.
Interior Applications: Combustible surfaces such as
wood framing and paneling, trim, doors, cellulose fiber
tile, insulation board and decorative displays.
Noncombustible surfaces such as plaster and masonry
corridors, stairwells, electrical control panels,
supplementary protection to metal ducts and fire dampers.
Exterior Applications: Albi 107A may be used for
exterior applications by over coating with Albi 144 Fire -
Inert Semi -Gloss Finish Coating to provide effective
weather ability characteristics (See Albi 144 Data Sheet).
Weatherometer test exposures of the Albi 107A1144 system
for 1000 hours (equivalent to 3 years) of exterior exposure
TEST DATA & APPROVALS:
have shown excellent durability with no significant loss in
fire protection. The Albi 107A/144 System may be used
for the following applications:
Combustible Surfaces: Wood framing, siding soffit areas,
enclosures, wooden fire escapes, job site offices, temporary
partitions, scaffolding, etc. (The Albi 107A/144 System
is not recommended for application to roof shingles.
Noncombustible Surfaces: Electrical control panels,
ductwork, light steel framing.
Albi 107A has been extensively tested by Underwriters'

SURFACE PREPARATION: All surfaces must be clean,
dry, and free of grease or any surface contamination that
will impair or prevent proper adhesion. Glossy surfaces
should be dulled to provide "tooth." On previously coated
surfaces, test for compatibility as Albi 107A contains
arotnatic solvents. Prime metal surfaces with. Albi 487S.
For masonry, drywall or plaster, seal surface before coating
with Albi 107A of prime with Albi 107A thinned with one
pint of solvent per gallon of coating.
MATERIAL: Fire retardant coating shall be Albi 1.07A
as manufactured by Albi Manufacturing, Division of
StanChem, Inc. or approved equal. Fire retardant coating
shall be tested and classified by Underwriters' Laboratories,
Inc. offering evidence of Class A rating. Material shall be
applied at the listed rate of coverage to conform to the UL
classification and to the intent of this specification.

Site Establishment Responsibilities
Dear Bob:
You were previously notified by certified mail in a letter dated October 6, 2005, of your
responsibilities to have the referenced site meet all applicable Land Disturbance and Erosion
Control criteria established by the City of Eagan and the State of Minnesota. I am writing to
confirm our telephone conversation that occurred earlier today with regard to these
responsibilities.
Presently, you are in the process of constructing office condominiums within the City of Eagan
under a building permit issued by the city. Your development activities include grading or
disturbance of this site. As detailed in the previous letter, in order for this site to comply with the
regulations of the City Code and the City's MS4 General Permit issued by the Minnesota
Pollution Control Agency, the site must be properly prepared for the winter.
This preparation includes the placement of seed and mulch/erosion blanket or sodding on all
exposed/disturbed soil surfaces. Placement of silt fence is also required throughout the portions
of the site without established turf, as well as the completion of any deficient site specific grading
or erosion and sediment control measures.
The following schedule was established as a result of our telephone conversation today.
• Remove all excess earthen material from the site: November 28 -December 2
• Seed and mulch the entire site: December 5-9
• City staff to perform site inspection: December 12, 2005
Appropriate maintenance of the site and adjacent public streets is still required throughout this
schedule. There will be no additional time extensions for this work.
After the inspection on December 12, anything not in compliance with the city ordinance and
MS4 General Permit requirements or anything deemed inappropriate by city staff will be ordered
corrected by city staff or a private contractor. The cost of this work will be invoiced to the
building permit holder. At that time, all building inspections will be put on hold and a hold will
be placed on the issuance of a Certificate of Occupancy. These holds will only be removed with
the full payment of all relevant invoices.
Your anticipated cooperation will be appreciated by City staff. Please contact me with any
questions.

Bob Forsberg, Watson Forsberg, called me in response to Leon's discussion on erosion control with the
contractor on site. The plan is to have all excess material removed from the site next week (Nov 28 -Dec
2); a landscaper is scheduled to seed and mulch the entire site the week of Dec 5. City staff will perform
an Erosion Control Inspection on Dec 12.
After the inspection on Dec 12, anything not incompliance with the city ordinance/NPDES Phase II
requirements or anything deemed inappropriate by city staff will be ordered corrected by city staff and
the cost will be invoiced to the building permit holder. At that time all inspections would be put on hold
as well as a hold placed on the issuance of a Certificate of Occupancy. These holds would only be
removed with the full payment of the invoice.
I ensured Bob we will allow the additional time for site restoration as previously stated, but will still
require appropriate maintenance of the site and adjacent street. I informed Bob that there would be no
additional time extensions. I will send Bob a letter restating the aforementioned information.

Subject: Modification of "T}pe of Construction" from III A to V A
Dear Mr. Novaczyk,
We have re-evaluated the construction classification of the 1335 and 1345 buildings, and based
on Table 503, determined that the appropriate type of construction should be V A. We aze
comfortably within the allowable range of square footage and height limitations with this
classification. This change allows construction in which the structural elements, exterior walls
and interior walls may be of any material allowed by the code. The only significant difference is
dhat the exterior walls may now be of 1-hour construction.
As such we have modified the title page and appropriate details on sheets A140 and A141 to
reflect this change. It is our intention to eliminate the future use of intumescent paint and the
double layer of gypsum board on exterior walls, as these elements aze no longer required.
Please advise if you have any comments regarding this change of classification.

Dear Mr. Larson:
Enclosed is an invoice from the City of Eagan for site development work completed at
1345 Corporate Center Curve in December 2005 during the building constmction and site
development. The work was successfully completed by City hired farces after the
owner's failure to respond to multiple requests by the City of Eagan to properly address
the erosion and sediment control needs of the site. Also enclosed is conespondence
addressing the failure to properly address the site which provides the basis for the
invoice.
The City of Eagan expended in excess of $8,500 to bring your property in to compliance
with state and federal requirements obligated by the building permit. The responsibility
for these erosion control and turf establishment measures belonged to the owner or
owner's representative, contractor, at the time of the building construction activity.
Due to the lack of success with the turf establishment efforts by the City's forces, the cost
associated with the hydro seed and mulch, $7,725.00, has been subtracted from the
current invoice. The remaining cost of $934.94 was all relevant to the site's construction
activities and for measures that should have been completed by the owner neariy two
yeazs ago.
A lack of full payment for the enclosed invoice will leave the city with no options other
than the use of a collection agency to recover said costs. Please contact me with any

Site Establishment Responsibilities

You were previously notified by certified mai] in a letter dated October 6, 2005, of your
responsibi]ities to have the referenced site meet all applicable Land Disturbance and Erosion
Contml criteria established by the City of Eagan and the State of Minnesota. I am writing to
confirm our telephone conversation that occurred earlier today with regard to these
responsibilities.
Presently, you are in the process of constructing office condominiums within the City of Eagan
under a building permit issued by the city. Your development activities include grading or
disturbance of this site. As detailed in the previous letter, in order for this site to comply with the
regulations of the City Code and the City's M54 General Permit issued by the Minnesota
Pollution Control Agency, the site must be properly prepared for the winter.
This preparation includes the placement of seed and mulch/erosion blanket or sodding on all
exposed/disturbed soil surfaces. Placement of silt fence is also required throughout the portions
of the site without established turf; as well as the completion of any deficient site specific grading
or erosion and sediment control measures.
The following schedule was established as a result of our telephone conversation today.
• Remove all excess earthen material from the site: November 28-December 2
• Seed and mulch the entire site: December 5-9
• City staff to perform site inspection: December 12, 2005
Appropriate maintenance of the site and adjacent public streets is still required throughout this
schedule. There will be no additional time extensions for this work.
After the inspection on December 12, anything not in compliance with the city ordinance and
M54 General Permit requirements or anything deemed inappropriate by city staff will be ordered
conected by city staff or a private contractor. The cost of this work will be invoiced to the
building permit holder. At that time, ali building inspections will be put on hold and a hold will
be placed on the issuance of a Certificate of Occupancy. These holds will only be removed with
the full payment of all relevant invoices.
