your requested curb cuts must be denied due to existing City Code
regulating off-street loading areas (Chapter 11, Section 11.10,

Due to the needs of two tenants in our Avalon-Center-complexy Opus Corparation
requests permission to add one curb cut each for access tv Building B and
Building C. The Loading needs of Glasteel, a future tenant for Building B,
and J. Rubin Co., an existing tenant in Building C, require the addition of
ground level doors on the south side of both buildings. In order to have
satisfactory maneuvering room and access to these doors, additional curb cuts
are necessary from Avalon Avenue. We feel these curb cuts can be added with-
out negatively impacting on traffic circulation within the site or the
immediate area.
Enclosed is a site plan which indicates the location of the proposed curb
cuts. Please review this plan and let me know if it meets with your approval.

Enclosed is the proposed legal description for Eagandale Court with the
triangular section outlined. The area in question is 5,927 square feet.
As we discussed, the purchaser for Lots, 14 and 15 will not buy this parcel
because it does not abut the remaining Iland. To combine it with adjoining
property would require the subdivision of the 1ot, a lengthy approval process,
and negotiations with the property owner to the north. The best and most
timely solution would 6e to include it within the roadway easement.

City of Eagan, a municipal corporation, organized under the laws of the State of Minnesota,
hereinafter referred to as the "City".
WITNESSETH:
That the Landowner, in consideration of the sum of One Dollar ($1.00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby aclrnowledged, does
hereby grant and convey unto the City, its successors and assigns, a permanent easement for
right-of-way, drainage and utility purposes, over, across and under the following described
premises, situated within Dakota County, Minnesota, to-wit:
That part of Lot 14, Block 3, EAGANDALE CENTER INDUSTRIAL PARK, according
to the recorded plat thereof, Dakota County, Minnesota, lying southerly of a line drawn
from a point on the southeasterly line of said Lot 14, distant 21.21 feet northeasterly of
the most southerly corner of said Lot 14 to a point on the southwesterly line of said Lot'
14, distant 21.21 feet northwesterly of said most southerly corner of Lot 14.
See also Exhibit "A" attached hereto and incorporated nerein.
The grant of the foregoing permanent easement for right-of-way purposes includes the right
of the City, its contractors, agents and servants to consiruct, reconstruct, inspect, repair and maintain
a roadway and erect and maintain signs in conjunction with the public's use of said roadway and
appurtenances and any signs erected in conjunction with the use of the roadway and appurtenances.
The grant of the foregoing permanent easement for drainage and utility purposes includes
the right of the City, its contractors, agents and servants to enter upon the premises at all
reasonable times to construct, reconstruct, inspect, repair and maintain pipes, conduits and
mains; and the further right to remove trees, brush, undergrowth and other obstructions. After
completion of such construction, maintenance, repair or removal, the City shall restore the

premises to the condition in which it was found prior to the commencement of such actions, save
only for the necessary removal of trees, brush, undergrowth and other obstructions.
And the Landowner, its successors and assigns, does covenant with the City, its
successors and assigns, that it is the Landowner of the premises aforesaid and has good right to
grant and convey the easement herein to the City.
IN TESTIMONY WHEREOF, the Landowner has caused this easement to be executed
as of the day and year first above written.

1. Enclosed is a list of licensed hazardous waste generators for the
specified area.
2. Enclosed are maps indicating the locations of known dump sites
within the specified area.
3. Enclosed are maps showing the locations of pipelines for the specified
area.
4. Enclosed are lists for CERCLIS, NPL and PLP sites within Dakota
Counry.
5. There are no petroleum landspread sites within the specified area.
This information was arrived at with the most current data available. In
issuing the information Dakota County assumes no responsibility as to the
activities undertaken.
The 2003 Dakota County fee schedule adopted by the County Board of
Commissioners on November 5, 2002 requires that you be billed for services
provided by this Department. Staff time for this review was 0.50 hours at
$87.00 per hour for a total cost of $43.50. Please make a check or money
order for the total amount made payable to "Dakota County Environmental
AudiY" and send to my attention. Payment must be received within 30 days.
