Dear Paul,
We have started our review of the construction documents submitted in pursuit of
obtaining a building permit for the above-referenced project. This review is not intended
to be an exhaustive and comprehensive report. Unless otherwise noted, all references are
to the 2000 I.B.C. It is our goal that this review will help you in complying with the
applicable codes and we are, therefore, requesting that the following items be addressed:
1. The contractor shall sign building permit application.
2. The designer shall sign the envelope compliance certificate, the lighting and
power compliance certificate, and the mechanical compliance certificate.
3. Specify which type III construction that is to be used.
4. Specify which NFPA sprinkler system that is to be used.
5. The enclosed parking garages shall comply with Section 406.42 I BC, which
refers you to Section 404 IMC.
6. The stairway in the exit enclosure shall have an approved bazrier at the level of
exit discharge. (Section 1005:32.3)
7. Type III construction requires that the exterior walls be of 2 HR Noncombustible
construction. (Section 602.3 and Table 601)
8. Calculate the allowable azea of protected and unprotected openings on the east
exterior wall (Section 704.8 and Table 704.8) or document compliance with Sec
704.3.
9. Revise the window schedule to include any rated glazing that may be required.
10. Specify the LTL Listing and testing designs for all rated assemblies (walls, floors
and roo fl.
11. All toilet rooms shall comply with Chapter 1341.0405, Item K, suh item (1).
12. Supply details for accessible parking signage.
13. Van accessible parking is required. The access isle shall be a minimum of 96".

Dear Paul,
This is in response to the City of Eagan's letter dated April 25, 2005, regarding permit comments for
Eagandale Business Center, 1345 Corporate Center Drive, Eagan, MN. The CiTy Plan Examiner was very
helpful in clazifying comments and providing direction to addiess all issues. The following is our reply to
these comments. The numbers refer to the sequence in the criginal letter.

Reply: Type III A construction.
5. Comment: The enclosed parking garages shall comply wi,h 406.4.2 IBC, which refers to 404 of
the IMC.
Reply: Mechanical ventilation of the garages is not required based on revised occupancy and
increased fire watl separation as stated in sepazate lettei dated May 16, 2005, and agreed in
subsequent telephone conversation of May 20, 2005.
6. Comment The stairway in the exit enclosure shall have an approved battier at the level of exit
discharge. (Section I0053.2.3)
Reply: An approved 6arrier (gate) has been included in Addendum No. 3 doeuments. See plan
sheet A110 at stairs and sheet A135/ details 5 and 9.
7. Comment: Type III construction reauires that the exterior walls be of 2HR Noncombustible
construction. (Section 6423 and Table 601).
Reply: Exterior walls will be of 2HR Noncombustible construction as stated in Addendum No. 3
under UL Listings.
8. Comment: Calculate the allowable area of protected and unprotected openings on the east exterior
wall (Section 704.8 and Table 704.8) or document compliance with Section 7043.
Reply: The assumed preperty line had been determined and the opening area has been calculated
at 19%. The table allows for 25% of the wall to be protected opening. See Addendum No. 3,
Sheet T100 for the new code summary and squaze Yootage calculations.

Dear Mr. Novaczyk,
This item states that enclosed parking gazages shall comply with Section 406.4.2. IBC, which
refers to Section 404 of the IMC (provide mechanical ventilation systems). We have
reconsidered the use classification of the gazage and would like to reclassify this space from
Crroup S-2 (3113), Low-Hazard, to Group U(312.1), Utility and Miscellaneous. This
classification allows for Private Garages, which is the intended use of the space, as the units are
privately owned and not for public use.
Section 406.1.2 (Area Increase), states that Group U occupancies used for the storage of private
or pleasure-type motor vehicles where no repair work is done ar fuel dispensed are permitted to
be 31000 square-feet when the following provisions aze met:
Far a mixed-occupancy building, the exterior wa11 and opening protection for the
Group U portion of the building shall be as required for the major occupancy of the
building. For such mixed occupancy building, the allowable floor area of the building
sha11 be as permitted for the major occupancy contained herein.
More than one 3,000-square-foot Group U occupancy shall be permitted to be in the sasne
building, provided each 3,000-square-foot area is separated by fire walls complying with Section
705.

It is our intent to classify the middle garage wall as the Fire Wall for garages. This will limit the
space to 3,000 square feet. The Firewall wi11 be constructed of 12" CMU and will have a 3-hour
IJL rating as required in table 705.5.
As allowed under 705.5, Exception 3, firewalls will terminate at the interior of the
noncombustible exteriar sheathing as the building on each side of the fire wall is protected by an
automatic sprinkler system.
Our design is for the storage of private vehicles, there is not repair work done or fuel dispensed,
and we meet the 3,000-square-foot limitation. Therefore, we do not believe that a mechanical
ventilat;on system is required as stated in 406.4.2. We would appreciate your review, and if
acceptable, aclmowledaement that our interpretation is acceptable.
iastly, we wouid appreciate approximateiy one hour of your time the week of May 16, 2005 to
discuss tenant layout changes based on new Owner requirements.

refers to Section 404 of die IMC (provide znechanical ventilation systems;. We have
reconsidered the use classification of tlie gazage and would like to reclassiiy this space from
Group S-2 (311.3), Low-Hazard, to Gr,iup U(312.1), Utility and Miscellaz:eous. This
classification allows for Private Gazage s, which is the intended use of the space, as the units are
privately owned and not for public use.

It is our intent to classify the middle g?irage wall as the Fire Wall for garai!es. This will limit the
space to 3,000 square feet. The Firew:i.ll will be constructed of 12" CMU and will have a 3-hour
UL rating as required in table 705.5.
As allowed under 705.5, Gxception 3, i_irewalls will terminate at the interioz of the
noncombustible exterior sheathing as i he building on each side of the fire wall is protected by an
autotnatic sprinkler system.
Our design is f'or the storage of private vehicles, there is not repair work done or fuel dispensed,
and we meet the 3,000-square-foot limitation. Therefore, we do not believe that a mechanical
ventilation system is required as stateci in 406.4.2. We would appreciate your review, and if
acceptable, acknowledgement that ow interpretation is acceptable.
Lastly, we would appreciate approximately one hour of your tune the wee:< of May 16, 2005 to
discuss tenant layout changes based oix new Owner requirements.

I just talked with Jeff Larson with JBL and he is aware that we put a hold on his building
permit until the negative escrow batance of $1014.50 has been paid in full and he brings in
stamped copy or receipt that he has brought the Final PD to be recorded. He is ctosing on
the July 27th and will be at that time, bring everything in to the County. I assumed he would
bring the check for his escrow and the receipt for his Final PD at the same time. 1 will let
you know as soon as I receive everything and able to take the hold off.

pipe must be insulated to 1 in.. Pipe insulation will have a conductivity of less than 0.28 Btu. W(h-ft2 °F).
4. Insulation must be provided for the first 8 ft of outlet piping for a constant temperature nonrecirwlating storage system
and for the inlet pipe between the storage tank and a heat trap in a storage system.
5. Temperature controls must be provided that allow for storage temperature adjustment from 120 °F or lower to a
maximum temperature compatible with the intended use except when the manufacturer's installation instructioos specify
a higher minimum thermostat setting to minimize condensation and resulting corrosion. Documentation of the
installation instructions must be provided to be exempted from this requirement.
6. Temperature controlling means must be provided to limit the maximum temperature of water delivered from lavatory
faucets in public facility restrooms to 110 °F.
7. Heat traps must be provided on inlet and outlet vertical pipe risers serving storage water heaters and storage tanks not
having integral heat traps and serving a nonrecirculating system. Heat traps must be installed as close as practical to the
storage tank. Acceptable heat traps are either a) a device speciFically designed for the purpose or b) an arrangement of
tubing that forms a loop of 360 °F, or c) piping that from the point of connection to the water heater (inlet or outlet)
includes a length of piping directed downwazds before connection to the vertical piping of the supply water or hot water
distribution system.
Generic Requirements: Must be met by all systems to which t6e requirement is applicable
l. Design heating and cooling loads for the building must be determined using procedures equivalent to those in Chapters
27 and 28 of the ASHRAE Handbook of Fundamentals or an approved equivalent calculation procedure.
1 Thermostats controlling both heating and cooling must be capable of maintaining a 5 degree F dead6and (a range of
temperature where no heating or cooling is provided).
- Exception: Deadband capability is not required if the thermostat does not have automatic changeover capability
between heating and cooling.
3. All pipes serving space-conditioning systems must be insulated as follows:
Hot water piping for heating systems:
1 in. for pipes <=1 1/2-in. nominal diameter
2 in. for pipes>1 1/2-in. nominal diamecer.
Chilled water, refrigerant, and brine piping systems:
1 in. insulation for pipes <=1 1/2-in. nominal diameter
1 1/2 in. insulation for pipes >1 1/2-in. nominal diameter.
Steam piping:
1 1/2 in. insulation for pipes r-1 1/2-in. nominal diameter
3 in. insulation for pipes >1 1/2-in. nominal diameter.
- Exception: Pipe insulation is not required for factory-installed piping within HVAC equipment.
- Exception: Pipe insulation is not required for piping that conveys fluids having a design operating temperature range
between 55 degrees F and 105 degrees F.
- Exception: Pipe insulation is not required for piping that conveys fluids that have not been heated or cooled through
the use of fossil fuels or electric power.
- Exception: Pipe insulation is not required for runout piping not exceeding 4 ft in length and 1 in. in diameter between
the control valve and HVAC coil.
4. Where zone heating and cooling are controlled by separate zone thermostats, means (such as limit switches, mechanical
stops, or, for DDC systems, software programming) must be provided to prevent simultaneous heating and cooling to the
zone.
5. Stair and elevator shaft vents must be equipped with motorized dampers capable of being automatically closed during
normal building operation and interlocked to open as required 6y fire and smoke detection systems. All graviry outdoor
air supply and exhaust hoods, vents, and ventilators must 6e equipped with motorized dampers that will automatically
shut whan the spaces served are not in ase.
Exceptions:
- Gravity (non-motorized) dampers are acceptable in buildings less than tlvee stories in height above grade.
- VenYilation systems serving unconditioned spaces.
6. Wbece a zone is served by a system(s) with both humidi6cation and dehumidiCica[ion capability, means (such as limit
switches, mechanical stops, or software programming) must he provided to prevent simultaneous operation of
humidification and dehumidification equipment.
- Exception: Zones served by desiccant systems, used with direct evaporative cooling in series; Systems serving
zones where specific humidity levels are required.
7. AI] freeze protection systems, including self-regulating heat tracing must include automatic controls capable of shutting
off the systems when outside a'u temperatures aze above 40 °F or when the conditions of the protected fluid wiil prevent
freezing. Snow- and ice-melting systems must include automatic controls capable of shutting off the systems when the
pavement temperature is above 50 °F and no precipitation is falling, and an automatic or manual control that will allow
shumff when the outdoor temperature is ahove 40 °F.
8. Systems with design outside air capacities >3,000 cfm serving areas having an average design occupancy densiry
exceeding 100 people per 1000 ft2 must include means to automaticalty reduce outside air intake below design rates
when spaces aze partially occupied. Ventilation controls must be in compliance with ASHRAE Standazd 62 and Iocal
standards.
9. Duct and pipe insulation exposed ro weather must be suitable for outdoor service; e.g., protected by aluminum, sheet
metal, painted canvas, or plastic cover. Cellular foam insulation must be protected as above or painted with a coating
that is water retazdant and provides shielding from solaz radiation that can cause degradation of the materiaLlnsulation
covering chilled water piping, refrigerant suction piping, or cooling ducts located outside the conditioned space must
include a vapor retardant located outside the insulation (unless the insulation is inherently vapor retardant), all
penetrations and joints of which must be sealed.
10. All supply and retum ducts and plenums installed as part of an HVAC air distribution system must be thermally
insulated:
R-6 supply and retum air duct insulation in unconditioned spaces,
R-8 supply and return air duct insulation outside the building,
R-8 insulation between ducts and the building exterior when ducu aze part oF a building assembly,
R-3 supply and return air duct insulation underground.
Exceptions:
- Factory-installed plenums, casings, or ductwork fumished as a part of HVAC equipment tested and rated in
accordance with Section 6.2.1.
- Ducts or plenums located in heated spaces, semiheated spaces, or cooled spaces.
- For runouts <10 ft in ]ength to air terminals or air outlets, the rated R-value of insulation need not exceed R-3.5.
- Backs of air outlets and ouflet plenums exposed to unconditioned or indirectly conditioned spaces with face areas
exceeding 5 ft2 need not exceed R-2; those 5 ft2 or smaller need not be insulated.
11. Duct Sealing Requirements:
- Pressure sensitive tape prohibited as the primary sealant
- Longitudinal and transverse seams for ducts in unconditioned spaces
- Longitudinal and transverse seams and duct wall penetrations for ducts outside the 6uilding
- Transverse seams on buried ducts
12. Where humidistatic controls are provided, such controls must prevent reheating, mixing of hot and cold air streams, or
other means of simultaneous heating and cooling of the same air stream.
Exceptions:
- capabiliry to fust reduce flow rate
- cooling capacity <80 kBtu/h and capability to unload cooling equipment
- cooling capacity <40 kBtu/h
. - rigid humidity requirements
- site-recovered or site-solar energy sources or
- use of a desiccant systems.
13. Individual fan systems with a design supply air capacity of 5000 cfm or greater and minimum outside air suppty of 70%
or greater of the supply air capaciry must have an energy recovery system with at least a 50% effectiveness.
Exceptions:
- Systems serving spaces that are not cooled and heated to <60 °F.
- Commercial kitchen hoods (grease) classified as Type 1 by NFPA 96
- Systems exhausting toxic, flammable, paint, or corrosive fumes or dust
If an air economizer is also required, heat recovery must be bypassed or controlled to permit air economizer operation.
14. Individual kitchen exhaust hoods larger than 5000 cfm must be provided with make-up air sized for at least 50% of
exhaust air volume that is uncooled and either unheated or heated ro no more than 60 °F
Exceptions:
- Where hoods are used to exhaust ventilation air that would otherwise exfiltrate or be exhausted by other fan systems.
- Certified grease extractor hoods that require a face velocity no >60 fpm.
15. Buildings with fume hood systems having a total exhaust rate > 15,000 cfm must either have variable air volume hood
design, exhaust air heat recovery, or sepazate make up air supply.

Subject: Correction of Fire Treated Framing at Exterior Walls
Dear Mr. Schoeppner,
As discussed with Mr. Craig Novaczyk on November 16, 2005, while inspecting the site
construction we observed that the exterior walls of the 1345 building were noY covstructed with
non-combustible materials as required to meet the 2 hour assembly rating. As non-combustible
materials may be fire-treated lumber per code, to correct this issue we proposed a two-coat
application of Albi Manufacturing's 107A fire retardant intumescent paint to the exposed
surfaces. This product is recognized as the "Standard of the Industry" due to its special
formulation of intumescent components. It is designed for maYimum protection of combustible
ox noncombustible surfaces and reacts to flame or heaY by foaming into a thick cellular insulative
blanket.
This product has been extensively tested by Underwriters' Labaratories, Inc., the Federal
Government, and is approved by major building codes and insurance rating organizations. In
addition, this product was subjected to a 30-minute extension of the ASTM-84 test procedure.
This rating provides an equivalent to pressure treated, fire retazdant lumber and is so approved by
the StaYe of California (guide 2280) when applied in two coats.
lt is our understanding that you, as the City of Eagan's Chief Building Inspector, aze willing to
accept this corrective measure with the requirement that as Architect of Record, we will certify
that the materials are installed per manufacturer's recommended installation procedures and
applied in two coats. We commit to follow this requirement and will submit a letter certifying to
these facts as observed.

extension of the ASTM E-84 test procedure. "I'his rating
provides an equivalent to pressure treated, fire retardant
lumber and is so approved by the State ofCalifornia (Guide
2280) when applied in two coats at a xate of 87.5 Sq. Ft.
per gallon per coat.

SURFACE PREYARATION: All surfaces must be clean,
dry, and free of grease or any surface contaminarion that
will impair or prevent proper adhesion. Glossy surfaces
should be dulled to provide "tooth." On previously coated
surfaces, test for compatibility as Albi 107A contains
arornatic solvents. Prime meta] surfaces with A16i 487S.
For masonry, drywall or plaster, seal surface before coating
with Albi 107A of prime with Albi 107A thinned with orie
pint of solvent per gailon of coating.
MATERIAL: Fire retardant coating sball be Albi 107A
as manufactured by Albi Manufacturing, Division of
StanChem, Inc. or approved equal. Fire retarciant coating
shall be tcsted and classified by Undenvriters' Laboratories,
lnc. offering cvidence of Class A raCing. Material shall be
applied aL ttie listed ratc of coverage to con£orm to the UL
classiticaCion and to the intent of this specification.
