I am in receipt of your letter dated D7arch 10, 1982 wherein you indicated that you were
charged an additional $5.00 for interest when you paid off your special assessnents for
tnmk storni sEwer as approved by the City CoLmcil at thei.r meeting on February 16, 1982.
Your attached docunentation was vexy helpful in determining that you are oorrect and
that the $5.00 interest should not have been levi.ed. We sincerely regret that this mis-
take occurrnd and have enclosed a refimd in the amnimt of $5.00 to cover your overpay-
ment.
You also requested information pertaini.ng to the refimd of your interest on your origi-
nal assessnient aTroimt of $340.00 that was levied in May of 1980. When this appeal was
brought before the District Court, the judge declared that because the City did not fol-
low.the proper procedure in determining benefit prior to levying of the special assess-
ment, he vacated the original assessment amoimt and ordered the City to reftuid that
aamunt to the appellants. In his ruling, he ordered the City of Eagan to refimd $75.00
for interest. Because the court did not declare who was to receive haa much of the
court's caputed figure of $75.00, we foxwarded that amount to your collective attorney,
Mr. Ken Ketcham, so that he could diSpeL'se it to the original appellants as the actinq
attomey on your behalf in this appeal. Therefore, I suggest that you wntact your at
torney to regain your share of the interest that you may feel is due you.
I hope this helps to clarify the oonf.usion pertaining to the reftmd procedure follawed
by the City of Eagan in ompliance with the couxt order. I again apologize that there
was an error pa_rtaining to the oollection of $5.00 interest on your assessrent payment
and hope that the enclosed check for the $5.00 refund satisfacts>rily resolves your claim.
