Dear Mr Corburt:
Than you for stopping by last night to explain the cause of the
flooding of our driveway.
As you are aware, the driveway was flooded on August 19 and 20 to
a peak depth of 18 inches. This is too much for an ordinary car
to drive through so we were stranded without our own transporation.
This is not the first time. The driveway was a2so flooded in the
fall of 1991.
This driveway was constructed in 1963 and never flooded until the
City of Eagan put in a storm sewer pond adjacent to it.
I wrote a letter to the city's engineering firm with copy to the
• city when this storm sewer project was proposed in 1986. A copy
is attached. It describes my concern over exactly the problems we
are seeing now. The only response was a phone call from Bonestroo
saying not to worry: it could never happen.
The city chose to ignore my request when the sewer project was
built. Now experience has shown that these problems are real.
It is time to take action to correct them. The only sure way to
prevent flooding in the future is to fill in the dip in the
driveway.
I am requesting that the city raise the level of the driveway
so the mininum elevation is as hiqh as Cliff Road.
I hope you will voluntarily cooperate and avoid the expense of
litigation.

Driveway Flooding
Dear Mr. Urban:
{n response to your earfier concerns regarding the intermittent flooding of your driveway
from the pond to the west controiled by the City's Holland Lake Storm Sewer Lift Station,
the City of Eagan's Maintenance Division raised the lowest elevation of your driveway
from 877.25 to 879.25 with a 1% grade from both directions for approximately 150'. This
work was completed on October 8, 1993, at a cost of approximately $655 in materiais and
approximately $3,000 in Ciry equipment and labor.
I hope that the finished product meets your approval and should certainly minimize 'rf not
eliminate the potential for your driveway being flooded in the future. Also, the City of
Eagan is pursuing an agreement with Dakota County to provide for an emergency
overflow outlet from this ponding area directly into Holland Lake at an elevation that would
help to ensure that water would not fiood your driveway again in the future.
I apologize for the inconvenience that you have suffered in the past and hope that these
actions assure you that the City is committed to providing you with the service and
protection that you would expect.

The-grant of the foregoing temporary construction easement for drainage and site grading
puiposes includes the right of the City, its contractors, agents and servants to enter upon the
premises at all reasonable times to construct, reconstruct and inspect drainage improvements and
site grading and the fiuther right to remove trees, brush, undergrowth and other obstructions. After
completion of such construction, maintenance, repair or removal, the City shall restore the premises
to the condition in which it was found prior to the commencement of such actions, save only for the
necessary removal of trees, brush, undergrowth and other obshuctions, subject only to permanent
easement alterations.
The Landowner, their heirs and assigns, does covenant with the City, its successors and
