WHEREAS, Appellants Krista K. Nelson and Craig A. Nelson, wife
and husband, own property described as Lot 1, Block 3, Twin View
Manor lst Addition, PID No. 10-78200-010-03 ("Subject Property"); and
WHEREAS, the Subject Property was assessed by the City of Eagan
on July 10, 1990 in the sum of $1,900.00 for storm sewer improvement
through Public Improvement Project No. 466; and
WHEREAS, Appellants brought an action in District Court,
appealing the sum of the assessments, known as Krista K. Nelson, et
al. v. Citv of Eaaan, Court File No. C3-90-7812; and
WHEREAS, the parties have resolved the assessment dispute; and
WHEREAS, the parties have agreed to reduce the assessment against
the Subject Property to the total amount of $900.00.
NOW THEREFORE, the parties do hereby enter into the following:
1. The storm sewer assessment against the Subject Property in
the amount of $1,900.00 shall be reassessed in the amount of $900.00.

Settlement Agreement resolving your assessment appeal and asked you
to sign and return those originals to this office so I could obtain
the City's signatures. Until the Settlement Aqreement is signed, the
City cannot ask the County to remove the assessment from your tax
bill. We also need to send a copy of the signed Stipulation to the
Court so the Court can order that this case be dismissed. Please sign
the two originals and return them to this office as soon as possible
so we may put an end to this matter.

As you know, this case was scheduled for Court trial on March 20,
1991. Krista, representing herself, informed the Court that she
intended to call no witnesses but that she would testify as to the
market value of her house and wanted to introduce as evidence of
market value her 1991 tax bill which shows that Dakota county has
reduced the assessed value of her home as evidence of the market
value. I objected to the introduction of this tax bill as I wanted to
be able to cross-examine the assessor who revalued her property.
Judge Pavlak recommended that this case be continued so that Ms.
Nelson could arrange to have additional witnesses present to testify
as to the market value of her property.
The Court trial date has now been set for April 3, 1991, at 9:00
a.m., down at the Dakota County Judicial Center in Hastings. This
continuance also will permit Ray Connelly to appear. Please note this
date on your calendar so you will be available to testify if need be.
After we left the Judge's chambers, I made an offer of settlement to
Krista for $950.00, half the current assessed value. I will keep you

PLEASE TAKE NOTICE that the Respondent City of Eagan requests
Appellant to answer under oath the following interrogatories within
thirty (30) days from the date of service. These interrogatories are
to be deemed continuing so as to require supplemental answers if
Appellant obtains additional information between the time answers are
served and the time of trial.
Definitions
1. "Documents" as used in this request include:

addressees, the name of the signer or signers, the title or heading

the identity of the persons to whom the original and all copies were
sent; and (3) the present or last known location or possessor of the
original of the document and of each copy thereof.
3. Wherever in these interrogatories Appellant is asked to
identify a document which is deemed by Appellant to be properly
withheld from production for inspection or copying on the ground of
privilege, the listing thereof by title or subject heading, date,
author, addressee, and persons copies is nevertheless required.

inquired about in these interrogatories.
1. Describe in detail the nature and. extent of Appellant's
ownership interest in the real estate which is the subject of this
assessment appeal, including the following information for each
parcel:
a. Date on which acquired;
b. Nature of ownership interest (whether fee title or other, if
other, specify);
c. Person or persons from whom acquired;
d. Price paid. Specify the handling in the purchase agreement:
(1) special assessments levied but unpaid, all special
assessments pending but not yet levied or adopted;
e. Name and address of real estate salesperson, institution,
appraiser or real estate consultant and/or anyone else who
appraised the property at the time of acquisition;
f. Allocation of appraised value of property at the time of
acquisition between real estate and the then existing
developments and improvements.

real estate since acquisition, including the following: ,

c. Date completed;
d. Name and address of contractors or builders who constructed;
e. Total cost.
3. Did you personally appear or were you represented at any of
the public hearings held by the City in connection with the
establishment of the local improvements and special improvements at
issue herein? If so, state the date of your attendance and state
whether or not you objected to either the improvements to be
constructed or the special assessments to be levied.
4. As to each separate parcel of land upon which you are
questioning the assessment, state your opinion, if any, as to the
market value of the property immediately prior to the improvement.
5. State fully all facts supporting your opinion as to market
value set forth in your answer to Interrogatory Number 4, including:
a. Identification of each document relating to the alleged
market value;
b. Identification of each person having knowledqe of the facts
relating to the alleged market value.

1. Pursuant to Minnesota Statute 429.081, the aboved-named Appellant
hereby appeals fran the assessments adopted July 10, 1990 for special
assessments levied by Respondent against the following described property:

2. The assessment was levied by Respondent for special assessments
in the following atnount plus:
$1900.00
3. Appellant did not receive notice of a hearing on the amounts
actually assessed.
4. This appeal is taken on the following grounds: (A) the property
is not benefited by the project; (B) the assessment exceeds the benefit to
the property; (C) the assessment is contrary to Minnesota Statutes g 429:
the assessnqent is discriminatory and violates appealants' rnnstitutional
right of equal protection and due process of the law; (D) the Plaintiff
was never notified of special assessment prior to construction and were
not included on the origianl feaseability report.
In accordance with the above cited statement, please furnish the
undersigned with certified copies of objections filed, the assessment
role, exact minutes authorizing the assessments, affidavits of public
noticea involved herein, copies of resolutions, contracts or other
instunents involving the project and agreements with other govecments
for participating in the cost of the project.

This letter is in regards to filing my appeal and objection for assessments you
are charging for storm sewer lateral to my property.
We are very uoset in regards to this matter and how it's been handled. Before
construction on Pilot Knob Road had started my husband went to a city meeting to
check to see if we would be charged for any assessments in regards to Pilot Knob
Road improvements. He as well as our tax preparer poris Wilkins, and his parents
Wally and Delores Nelson looked at the list of properties to be assessed and we
were not on that list. we were told the assessments stopped with the property
owned by Mr. and Mrs. Villelli which ia north of us 4 properties. I have a copy
of that feaseability report which has storm sewer and su[i¢nary report which dces
not include our property.
A week and a half ago I recieved this first letter fran the city that we would be
charged a storm sewer assessment.
We are still paying the enormous asaessment bill we were charged in 182 for storm
sewer, sanitary sewer, water, streets, curbf gutters, and who knows what else. Now
I have sat in on many city council meetings and I deal with the city on a regular
basis with my business. I have heard many times from the council you can not
be charged for storm sewer more than once. I've also heard them say if an assessment
does not benifit your property it can not be charged. My hane is currently assessed
for more than I could sell it for today.(but that is another matter I am taking care
of) A four lane road nor another assessment will not benefit the value of my
property in any way what so ever.
However, what is really upsetting is uofront the city told us that no asses_4ments
would be charged. as well as the problens and changes made during construction
that were not what they said they would be. I have called the city to discuss
this matter after receiving notice and asked why to many questions, did not
receive very many answers but to file an appeal and that the Engineers calculated
my property has 10,000 sf of run off. That is 1/3 the size of our lot which is
totally wrong. My lot is perfectly level, the water drains down, not off. The
county property behind mine does have a slight slope to the street(but which atill
is hard to believe is 10,000. sf.) My lot in no way would drain that much water
into the street. When i water my grass I've not had drainage into the street.
I feel this is a very unfair assessment and by no means worth $1900. worth.

I've been assessed and am currently paying for a storm sewer systern which I am
not sure is even being used by my lot in the first place. I don't want to pay
for one again. The storm sewer I've previously been paying for is mostly used
by my neighbors hanes which run down the street to the drains in front of my home.
I want to meet the so called Engineers at my home and have them show me where their
10,000 sf calculations came from before I sit down with my attorney to file my
appeal to the city and county. I would like the city to please get back to me in
regards to this matter. My nwnber is 452-2194 or work is 454-3410. There should
be no assessment to my property.
