Thank you for taking the time to write about the storage of a roll-off container on
your neighbor's property.
A Code Enforcement staff person has visited the site in question and noted that
all refuse visible in the dumpster was construction or demo related, that there
was no odor emanating from the dumpster and that there was no trash or debris
surrounding it. The container is also properly placed in the driveway with the
dumpster rails sitting on boards to prevent damage to the driveway. Our staff
person was told today by a person working on the house that they intend to
begin having public showings within a week and the roll-off will be gone by that
point.
While the City Code does not specify time limits for dumpsters, it does speak to
ternporary enclosures (intended to contain construction or demolition debris)
which cannot be on a lot for more than 6 months during any 12 month period.
Because roll-off containers are used for various projects ranging from a re-roof,
as you mentioned, to a large remodeling project, the amount of time a container
is needed can range from a day or two to several months. As such, it would be
very difficult to set a reasonable timeframe for storage of a roll-off across the
board when the scope of any given project can vary so significantly.
While we are pleased that an ugly neighborhood situation is being resolved and

reinvestment in a problem property is occurring, I do appreciate your concerns.

I live in the City of Eagan in the Fairway Hilis development at the corner of Pilot Knob and Cliff Road. The
neighbor south of ine is moving after living in our neighborhood for 5 years. Her home is in foreclosure
and it was bought by a realty that is fixing it up and selling it. They are on the third trash bin in an effort to
remove the garbage from her house. She has had mice living in her garage for quite some time because
of piled up boxes, so now that the garage has been cleaned up, we now have mice in our yard. This
latest dumpster (No. 3) has been in the driveway now for a good 3+ weeks. It takes up the whole
driveway. Not only is it an eyesore, but the mice problem is now more of an issue with me. I called your
Code Enforcement Section this morning and spoke with Mr. Marshall. He informs that the City of Eagan
has no ordinance on the books as to how long this trash bin can sit in her driveway.
I find it inexcusable that there is nothing on the books that allows for removal of this trash bin after a
designated period of time. Even if someone is having shingles replaced on their roof, it would never sit in
the driveway for this long. This is the pertect "mouse haven" and now this woman's neighbors are being
forced to deal with something that has never been a problem before.
I think the City Council should institute an ordinance that addresses this issue and come up with some
sort of deadline as to how long a trash bin (or other large, unsightlylunsanitary items) can sit on
someone's property in the City of Eagan.
