VAPOR FTA R' A vapor retarder, also known as a moisture barrier or vapor barrier, must be installed on the
warm side of insulated ceilings, walls and floors. Polyethylene vapor retarders must be 4-mills or thicker. The code
requires a vapor retarder to be installed only on rim joists that are susceptible to condensation from moisture diffusion.
AiR BARRTER: A 6arrier against air leakage must be installed to prevent leakage of moisture-laden sir from the

This letter is to confirm our conversation of August 22 wherein you
inquired of the City any concerns associated with constructing a
landscape retaining wall as a part of regrading the overflow
drainage swale along your south property line.
After reviewing your inquiry with our Sewer Maintenance Division,
it has been determined that there is no need to obtain access to
the catch basin in your southeast corner with any type of vehicle
that would be precluded by constructing a retaining wall within
this dedicated drainage and utility easement. The only time access
may be needed is if reconstruction were ever required which is
unforeseeable at this time. However, if you can minimize the
amount of encroachment into this drainaqe and utility easement, it
would be very helpful.
I hope this letter helps to address your concerns. Please let me
know if any further clarification is necessary.

resolution requires your participation along with the neighbors to

builder to work out an acceptable arrangement to address this
drainage concern. As the City has stated before, we will provide

I have recently received your letter of June 26 expressing your
concerns regarding the inadequacy of the common lot line drainage
swale between Lots 7 and 8 to handle the excess runoff that may
accumulate in the backyard areas of Lots 6-11. You referenced the
storm of July 28, 1990, wherein your house had 3" of water up
against the basement wall because of the high elevation of the
overland drainage swale between Lots 7 and S.
As you are aware, the City has been very much involved in reviewing
the backyard drainage c6ncerns of Lots 7-11 of Block 1, Fairway
Hills ist Addition. In a letter sent to the property owners on
December 11, 1990, the City specifically identified the need for
the property owners to have the elevation of the drainage swale
lowered between Lots 7 and 8 911-12" to eliminate any future
reoccurrence of the problems you experienced in the past.
In addition, the golf course has performed some construction
further to the south which intercepts a significant portion of the
drainaqe shed and rediverts into the pond within Ohmann Park.
While this work should minimize the potential of excessive surface
water accumulating in the backyard areas providing a reoccurrence
of your past problems, there is still a need to lower the common
lot line drainage swale between Lots 7 and'i8•
In reviewing the grading plan submitted by the developer, there is
an ambiguity along this common lot line that would indicate the
developer's elevation would be anywhere from 1028.1 to 1031.9. In
reviewing the Certificate of Survey submitted with your building
permit as well as the building permit for Lot 8, a specific minimum
elevation is not defined. Subsequently, the City is unaware of
what arrangements have been made between the developer, the
builders and/or the individual homeowners as to whose
responsibility it is to provide the fi;nal site grading and

The City has determined the specific raaximum elevation (1028.5)
that would provide the greatest level of protection to both
properties. We continue to extend our offer to piovide the
construction staking necessary to facilitate any regradinq in this

Drainage Concerns
Dear Property Owners:
At the Decemher 4, 1990 Council meeting, the City Council received and reviewed
background information pertaining to the backyard drainage concerns that have
been affecting you during the past several months and its relationship to the
Parkview Golf Course litigation.
The City is coramitted to working with the owner of the golf course either
separately or through the settlement of the litigation to redirect a significant
portion of the drainage watershed in the vicinity of the 13th green into the City
ponding area within Ohmann Park to your south. It is anticipated that this work
will be completed in early 1991 as construction weather permits.
Beyond this referenced woric addressing the "volume" drainage issue, the recent
regrading of the 6ackyard areas of Lots 9 and 10 appear to adequately handle
normal surface water runoff. Any reconfiguration or landscaping proposed by the
homeowners will be at their discretion subject to maintaining the existing
minimum flowage elevation across all backyards.
The common lot line drainage swale located between Lots 7 and 8 should be lowered
approximately 9 inches to further minimize any potential of a basement flooding
through some future unknown event. The City will provide construction stakes
identifying this new elevation when requested by the affected homeowners.
In addition, the City wants to assure the property owners that we will respond
to any drainage concerns or problems they have with the existing storm sewer
system. If there is evidence of these systems becoming blocked by debris or
freezing conditions, please feel free to contact our Sewer Utility Maintenance
Division at 454-5220 for a prompt response.

Dear Mr. Colbert:
Last year when the house was built at 4656 Fairway Hills
Drive the drainaqe swale between lots 7 and 8 was graded
incorrectly. We contacted Derrick Companies wiin our concerns
and Derrick contacted the builder remindinq him to grade the area
between lots 7 and 8 according to the subdivision grading plan.
At that time we also contacted Craig Knutson of the city staff
about insuring that the final grading was done according to the
grading plan. At the time the final grading for lot 8 was done,
the drainage swale between lot 7 and 8 was not graded according
to the grading plan.
On Suly 28, 1990 a heavy rainfall filled the backyards of
lots 6 through 11 with water because the storm sewer between lots
7 and 8 could not handle the water. Our house had water 3 inches
up the basement wall because the water could not escape through
the drainage swale due to improper grading. We have since
talked to our builder and he ensured us if the area between lots
7 and 8 was graded according to the grading plan we would have no
water problems.
I believe that the city has a responsibility to see that
grading and runoff related to this storm sewer is corrected and
would like to know what action the city can take to ensure that
Sons Construction regrades the swale between lot 7 and 8
accordir.g tc the grading pian.

Today I received the enclosed letters from Mr. Joseph J. Miller, .Tr., who is
a resident of Fairway Hills. I know that you have already received the
originals.
Mr. Miller has grave concerns about the flooding of his home due to improper
grading by Sons Construction that resulted in the filling in of the drainage
swale between Lots 7 and 8, Block 1, Fairway Hills. In addition he ie
objecting to building materials and other construction debris that has not
been cleaned up and removed.
The purpose of my letter is to get these problems resolved. If Mr. Miller's
assertions are correct, would you please take action immediately to resolve
the problems. If there is more to the story, or other inaccuracies, would
you please contact me so that we can work out a solution together.
In any event, it is obvious tha[ prohlems will only become worse if they"re
not attended to immediately. So I think it imperative that we discuss this
eituation as soon as possible. Hence I am writing to you immedia[ely after
receiving Mr. Miller"s letters.
Don, you and your company have always been extremeily cooperative over the
years we have worked together. Z look forward to hearing from you so we can
resolve this matter.

I have attached three copies of revised site plan for swimming pool, retaining wall and
pool fence enclosure for your review and approval.
Proposed swimming pool and retaining wall elevations:
• The existing elevation of the manhole cover located on the southeast corner
property line is 1033.77
• The top elevation of the new boulder retaining wall is 1031
• The bottom elevation of the new boulder retaining wall is 1027.5
• The top elevation of the new swimming pool is 1027.5
• The top elevarion of the house Foundation is 1028.5
Proposed swimming pool location:
• Swimming pool concrete pool deck is 13' from the north property line.
• Swimming pool concrete pool deck is 10' from the existing deck.
• Swimming pool concrete pool deck is 25' from the house foundation.
• Swimming pool concrete pool deck is 8' from the new retaining wall.
• Swimming pool concrete pool deck is 27' from the south property line.
Note: Pool owner may elect to add up to 10' of exh-a concrete pool deck area on
the south end of the swimming pool. This would make the concrete pool deck 17'
from the south property line.
Proposed retaining walllocation:
• Boulder retaining wall is 15' from the east property line.
Boulder retaining wall is approximately 3.5' high.
Boulder retaining wall meets exisring retaining wall at both ends.
Proposed fence enclosure around swimming pool:
• Existing chain link fence on the east side next to the golf course will remain.
• New 4' high chain link fence will be installed next to the north property line and
attached to both the north and south sides of the house.
• New 4' high chain link fence will be installed within the 10' easement on the
south property line. Property owners are willing to sign papers that state they are
responsible to move the new fence if the city of Eagan needs to use the 10'
easement.
Proposed water drainage:
• Earth berms will be installed on the north side of property to help direct rain water
towazds the east side of the swimming pool.
• Earth will be shaped between the new houlder retaining wall and the swimming
pool to allow for the rain water to flow towards the existing catch basin located on
the southeast property comer.
The swimming pool will be 8.5' deep at one end and includes an electric operated safety
pool cover. The concrete pool deck is a minimum of 5' wide around the swimming pool.
