As requested, ve have investigated the drainage situation at 741 Havenhill
Road and our findings are presented herein.
Our understanding of the issue is that Centex Homes believes that the city
created a drainage problem by constructing a trail approzimately 10" higher
than the design grade at the location as shovn on the attached photo copy of
the developer's grading plan. The following comments summarize our findings
and response to this.
* Our interpretation of the grading plan is that the drainage was not
intended to flov from east to west as Centes believes. The attached copy
of the developer's grading plan shovs a southwesterly drainage pattern.
From this we do not think that the elevation of the trail at the point in
question is a critical elevation control point and therefore the
deviation of the trail at the point in question is not unacceptable
especially considering the other circumstances described in the following
points.
* Zt was the developer's site grading contractor vho was, by the terms of
the development agreement between the City and the developer, responsible
for grading the development and the right of vay at this location.
* The city's project involved constructing the trail upon the grade
provided by the developer.
? Matching the trail grade with the grade provided at the point in question
matched the adjacent grade within the development and wae consistent vith
public works policy of "floating" the trails to match the adjacent
terrain.
* We believe that the final grading of the lots could have accommodated the
change in elevation of the trail without undue difficulty.

In consideration of our understanding of the circumstances as outlined herein
we do not think the city is responsible to expend its funds to remedy this
matter. To summarize our position:
The primary responsibility for the elevation of the trail vas not the
City's.
The trail elevation as it eaists blended vell with the adjacent eleva-
tions as graded by the developer.
The esisting trail elevation does not conflict with our interpretation of
the intent of grading plan.
Tha trail grade could have been accommodated by the final grading of the
lots.

Dear Mr. Clark:
On August 6 and 17, you submitted letters to the City of Eagan
pertaining to the current drainage problem being experienced at the
above-referenced property currently owned by Mr. and Mrs. William
Tillery. You have submitted copies of the concept development
drainage plan which shows the drainage from the rear lot areas of
Block 9 being conveyed westerly onto Northview Park Road. It
appears that this concept in the subdivision drainage has been
fairly well complied with, with the exception of the area of the
Tillery's property. As we are all aware, at the northwest corner
of their property, the drainaqe swale does not continue and
subsequently the drainage turns to the southwest along the western
side of their house. This current drainage pattern has wiped out
much of the landscaping that has been performed in this area.
In your letters and past discussions with City staff, you feel that
the City is responsible due to the fact that the trailway along
Northview Park Road at the northwest corner is approximately 10"
higher than was originally planned. The City does not feel that
it is responsible for a bituminous surface that was placed on top
of a graded bench provided by the developer. This trailway was
installed on the grades provided by the developer during the summer
of 1989. This was prior to the final site grading for the
Tillery's property on Lot 7, as well as Lot 6 adjacent to and north
of the Tillery's property.

Consideration has to be given to the fact that approximately 300
acres of land were under massive grading and development at the
same time that City trunk utilities and collector streets were
being constructed. In addition, the overall development grading
and individual house construction was occurring in accordance with
a grading plan that shows 2' interval contours. Subsequently, a
10" differential at any particular point is certainly not unusual
and is usually accommodated for in the final site grading.
The City feels that each particular lot, as it is being developed,
must take into consideration not only the overall concept drainage
plan, but also the existing conditions and perform whatever onsite
modifications are necessary to ensure that the overall drainage
system concept continues to work as originally proposed. This
backyard drainage swale and trail elevation should have been
recognized in the design and construction of the final lot grading
and landscaping plans for Mr. and Mrs. Tillery. This drainage
could easily have been accommodated by providing additional berming
in the northwest corner to ensure that this drainage continued over
to the trailway at a point where the elevation would have
permitted. The woodchip landscaping with plastic underlayment
should be placed on top of or to the house side of this berm to
ensure that water is not directed across it resulting in the damage
that has been experienced. In reviewing the current situation, a
drainage swale along the west side of the house was provided for
with the final lot grading which would function adequately to avoid
any damage to the structure. However, once the plastic
underlayment and woodchip landscaping were placed in this drainage
swale, the resultant problems could easily have been predicted.
A better solution would have been to provide a continuous slope
from the house foundation to the trail edge which would have
minimized this problem.
The Tillery's presented their concerns and your position to the
City Council at their meeting on August 21. After evaluating all
the facts and current City policies, the City determined that the
drainage problem being experienced by the Tillery's is a matter to
be resolved between the private parties involved. If it is
determined more cost effective to lower a segment of the City
trailway system, the City will either perform this work subject to
a financial commitment or,if it is desired to be performed
privately, the City must have an opportunity to review and approve
the proposed plans as well as provide inspection of the
construction activities.

I am enclosing a copy of the letter forwarded to the Tillery's
informing them of the City's position on this matter. We feel that
the solution to the problem can easily be accommodated through the
final lot grading and landscaping improvements which should be the
responsibility of the lot's development. Please let me know if the
City of Eagan can provide any technical assistance in helping to
understand the drainage pattern in this area and helping to design
the final landscaping improvements.

At the City Council meeting of August 21, the Council reviewed and
discussed in detail the drainage concerns and problems you have
been experiencing during the past several months. The City has
received numerous communicatiorrs and correspondence from your
builder, Centex Homes, regarding this issue.
After reviewing the information and the situation, the City feels
that throuqh proper final site grading and landscaping, the
proLlems that you have been experiencinq can be avoided.
As was explained, the mere fact that the City's trailway is
approximately 10" higher than the original concept design should
not have prevented the final grading and landscapinq from properly
diverting the common lot line drainage along the north side of your
lot an8 redirect it over the trailway onto Northview Park Road.
The tra , iilway was placed on a grade provided by the developer of the
Hills of Stonebridge development. This deviation of 10" is not
significant in relationship to the size of the development and the
fact that the grading plan is based on 2' contours. It appears
that the concept overall drainage plan for this development does
work properly and that each individual lot should take that concept
development/drainage plan into account in performing their final
site grading and landscaping improvements.

Also, the proper placement of landscape material is very important
to eliminate the potential for washouts during hiqh intensity peak
rainfall events. It appears that your landscaping was placed in
a natural drainage swale rather than being placed on a berm which
wou2d shed water away from the landscaping rather than directing
it down through the middle of this unstable type material.
The City Council, staff and City Attorney's Office feel that the
problems that you have been experiencing can most effectively be
resolved by dealing with the private parties who are involved in
the gradinq of your lot elevations and final landscaping design and
construction.
If it is determined that it would be cost efficient to remove a
portion of the City's trailway system to properly divert and convey
this back yard drainage, the City would be receptive to either
performing that work with City forces with proper reimbursement or
allowing a private contractor to perform the work if the design and
construction is properly reviewed and inspected by City personnel.
However, I sincerely feel that a more economical method would be
to provide some berming at appropriate locations on your property,
which, With proper landscaping, can be easily incorporated into
your final lawn improvements.
The City sirlcerely regrets the problems and frustrations that you
have experienced but hope that you can understand the necessity for
individual site improvements to take into consideration existinq
conditions and incorporate them into any final improvements.
Please feel free to contact the Engineering Division for any
technical assistance and advice that you feel would be helpful in

not decelop the Stonebridse Subciivision. That w-as done bc linited Mortgade
Gomnanp with Pioneer Engineering nerforming the engineering. Plans c:ere
submitted and subsequently approved by the Citc of Eagan in `1ay, 1987.
The approved plans included a development plan wfiich illustrates the
proposed house pad elevations and the direction drainage is designed to
tai:e. It is evident from these pians that the drainage c.as designed to
flow out to tiorthview Park Drice. I speculate that is w'hy the plans for
the uath were designed to set the elevation of the path at the grade
necessary to allow drainage across it. I do not understand how the city
staff can maintain that thec or their consultants were not aware of this
important design criteria.

City Councilmember Tim Pawlenty has asked our City Administrator,
Tom Hedges, to investigate your concerns about a trail's elevation
in your neighborhood. I am looking into the matter at the request
of City Administrator Hedges.
You have been in contact with John Wingard of the City's
Engineering Department. I have spoken with Mr. Wingard and he has
informed me that he is attempting to secure information regarding
the trail from Bonestroo, Rosene & Anderlik, one of the City's
consulting engineering firms. To this date, they have not yet
responded. However, Mr. Wingard and the Engineering Department
have assured me that they will intensify their efforts to obtain
this information. Please be assured that they will be in contact
with you as soon as possible.

I have set up a meeting for Wednesday, August 15 at 3:00, at the
site to discuss the drainage problem in the Hills of Stonebridge
development. Joel Cooper with Pioneer, Kevin Clark with Centex
Homes, and the City will be attending this meeting.
I will be presenting a solution to the drainage problem of grading
side yard drainage swales along lot lines 7& 8, 8& 9, and 9& 10
to divert runoff water from the backyard drainage swale. This
grading work would allow the drainage to flow along the lot lines
and in the City's drainage and utility easements. If this
alternative is accepted, then the final lot grading can be
accommodated to?meet the existing trail along Northview Park Road.

Dear Mr. Foertsch:
As requested, we have investigated the drainage situation at 741 Havenhill
Road and aur findings are presented herein.
Our understanding of the issue is that Centex Homes believes that the city
created a drainage problem by constructing a trail approximately 10" higher
than the design grade at the location as shocm on the attached photo copy af
the developer's grading plan. The following comments summarize our findings
and response to this.
* Our interpretation of the grading plan is that the drainage was not
intended to flow from east to mest as Centex believes. The attached copy
of the developer's grading plan shoms a southwesterly drainage pattern.
From thie we do not think that the elevation of the trail at the point in
question is a critical elevation control point and therefore the
deviation of the trail at the point in question is not unacceptable
especially considering the other circumstances described in the following
points.
* It eas the developer's site grading contractor who was, by the terms of
the development agreement between the City and the developer, responsible
for grading the development and the right of way at this location.
* The citq's project involved constructing the trail upon the grade
provided by the developer.
* Matching the trail grade with the grade pravided at the point in question
matched the adjacent grade +uithin the development and was consistent with
public works policy of °flaating" the trails to match the adjacent
terrain.
* We believe that the final grading of the lots could have accommodated the
change in elevation of the trail vithout undue difficulty.

In consideration of our understanding of the circumstances as outlined herein
we do not think the city is responsible to expend its funds to remedy this
matter. To summarize our position:
The primary responsibility for the elevation of the trail was not the
City's.
The trail elevation as it exists blended well with the adjacent eleva-
t3ons as graded by the developer.
The existing trail elevation does not conflict with our interpretation of
the intent of grading plan.
The trail grade could have been accommodated by the final grading of the
lots.

for the homes on HavenYii.Ll., is all supposed to f'1.ow over the pathway onto
Northvi.ew Park Drive. Howecer, the elevation of the pathwap is higher
i.han the rear yards that are intended to drain over it. The resulting
imnact i.s tnat al.l. the rear lot draina-ce is direct across one homeowner's
lot, ryir. and Ylr.'Pillery a,t 741 Havenhill.

the curb. Typieal design would place the path at about .3 to .4 feet fr.om

high. Fou have stated that the city doesn't hace the f'unds to remove and
reinsta.ll the pathway as per design. 1'ou also said you were in con'tact
a•ith the Cit.y's consultant 1'or this project but they have not responded to
rour inqiairc yet. I linow you have personallp inspected the area and I
believe you ar•e workiri:? to f9nd a solution. I just cant the city to
