This homeowner came in on Friday about the deck permit denied for<15' rear yard setback. Amy had me look at it and I
said we may be able to apply a 10' setback to the deck based on the zoning ordinance definitions.
Functionally,the west side acts like the rear yard given the orientation of this house on the lot. But the zoning
ordinance defines a rear yard as "the boundary of a lot which is opposite the front lot line. In the case of a corner lot, it
shall be the boundary opposite the shortest front lot line on a public or private street." Using that definition,the south
side would be the rear lot line, and the west side would be a side yard,so a 10'setback would apply to the principal
structure and attached deck.
I'm not sure if they are going to revise their plans or what, but talk to me if this permit comes back to you.
