Deficiency of Water and Shutting Off Water. The City is not liable for any deficiency o= failure in the supply of water to customecs whether occasioned by shutting the water off for the purpose of making repairs or connections or by any other cause whatevec. In case of fixe, or alarm of fire, water may be shut off to insuce a supply foc fiie fighting. In making repairs or construction of new works, water may be shut off at any time and kept off so long as may be necessary. Subd. 2. Repair of Leaks. It is the responsibility of the consumer or owner to maintain the secvice pipe Erom the cuzb stop into the house oc other building. In case of failuce upon the part of any consumer or owner to repair any leak occurring in his service pipe within twenty-four (24) hours after ozal or written notice has been given the owner or occupant of the premises, the water may be shut off and will not be turned on until a reconnection charge has been paid and the water service has been repaired. When the waste of water is gceat or when damage is likely to result from the leak, the water will be turned off if the zepair is not proceeded with immediately. Subd. 3. Abandoned Services Penalties. All service installations connected to the water system that have been abandoned or, for any reason, have become useless foz further service shall be disconnected at the main. The owner of the premises, served by this service, shall pay the cost of the excavation. The City shall perform the actual disconnection and all pipe and appurtenances removed from the street right-of-way shall become the property of the City. When new buildings are erected on the site of old ones, and it is desired to increase the old water service, a new permit shall be taken out and the regular tapping charge shall be made as if this were a new aervice. It is unlawful for any pecson to cause oc allow any service pipe to be hammered or squeezed together at the ends to stop the flow of water, or to save expense in improperly removing such pipe fzom the main. Also, auch impropec disposition thereof shall be corrected by the City and the cost incurred shall be borne by the person causing or allowing auch work to be performed. Except as otherwise permitted by the City Code, it is a misdemeanor for any person to place or maintain a sign, advertisement, or other atructure in'any street without first havin9 obtained a written permit from the Council. Subd. 5. Placing Snoa or Ice in Any Street Right- A. It is a misdemeanor for any pezson, not acting under a specific contract with the City or without special permission from the City, to remove snow or ice from private property and place the same in any street right-of- way. S. Where permission is granted by the City Administrator the person to whom such permission is granted shall be 3nitially responsible for payment of all direct or indirect costs of removing the snow or ice from the street or sidewalk. If not paid, collection shall be by civil action or assessment against the benefited property as any other special assessment. Subd. 6. Continuing Violation. Each day that any person continues in violation of this Section shall be a separate offense and punishable as such. Subd. 7. Condition, Before gcanting any permit under any of the provisions of this Section, the Conncil may impose such insurance or bonding conditions thereon as it, considering the projected danger to public or private prop- erty or to persons, deems proper for safeguarding such persons and property. 5uch insurance oc bond shall also protect the City from any suit, action or cause of action arising by reason of such obstruction. SBC. 7.06. STRBBT OPSBINGS OR BRCAVATIOBS. It is a misdemeanor.for any pezson, except a City employee acting within the course and scope of his employment or a con- tractor acting within the course and acope of a contract with the City, to make any excavation, opening or tunnel in, over, across or upon a street or other public property without first having obtained a written permit fiom the City as herein pzovided. Subd. l. Application. Application for a permit to make a street excavation shall describe with reasonable particulacity the name and address of the applicant, the place, purpose and size of the excavation, and such other (1-1-63) 176 information as may be necessary or desirable to facilitate the investigation hereinafter provided for, and shall be filed with the City. Subd. 2. Investigation and Payment of Estimated Costs. Upon receipt of such application, the City shall cause such investigation to be made as he may deem necessary to determine estimated cost of repair, such as back-filling, compacting, resurfacing and replacement, and the conditions as to the time of commencement of work, manner of procedure and time limitation upon such excavation. The foregoing estimated costs shall inolude permanent and temporary re- paics due to weather or other conditions, and the cost of such investigation shall be included in such estimate. PaY- ment of such estimated costs ehall be made before the permit is issued. Subd. 3. Protection of the City and the Public. A. Non-COmpletion or Abandonment. Work shall progress expeditiously to completion in accordance with any time limitation placed thereon so as to avoid unnecessary ihconvenience to the public. In the event that work. is not performed in accordance therewith, or shall cease or be abandoned without due cause, or is determined to be unacceptahle, the City may, after 48 haurs notice in case of a non-emergency, correct the work, fill the excavation and repair the public property, and the cost thereof shall be paid by the person holding the permit. In an emergency where it is necessary to eliminate an existing hazard, the City may perform such work without prior notice. 8. Insurance. Prior to commencement of the work described in the application, the applicant shall fur- nish the City satisfactory evidence in writin9 that the applicant will keep in effect public liability insurance of not less than $100,000.00 for any person, $300,000.00 for any occurrence and ptoperty damage insurance of,not less than $25,000.00, issued by an insucance company authorized to do business in the State of Minnesota on which the City is named as a co-insured. C. Indemnification. Before issuance of a permit, the applicant shall, in writing, agree to indemnify and hold the City harmless from any liability for injury or damage arising out of the action of ttfe applicant in peifor- mance of the work, or any expense whatsoever incurred by the City incident tb a claim or action brought or commenced by any person arising therefrom. Subd. 4. Issuance of Permit. The City shall issue such permit after (1) completion of such investigation, (2) payment by the applicant in advance of 177 all estimated costs as aforesaid; (3) agreement by the applicant to the conditions of time and manner as aforesaid; (4) agreement in wzitin9 by the applicant to pay all actual cost of repairs over and above such estimate, and, (5) agreement in wiiting by the applicant to be bound by all of the provisions of this Section. Subd. 5. Repairs. All temporary and permanent repairs, including back-filling, compacting and resurfacing shall be the responsibility of the applicant and shall be performed in accordance with standards adopted by the City. In the event that the applicant does not fulfill such responsibility, the work may be performed, repaired or replaced by the City. Su6d. 6. Cost Adjustment. As to the payment already made, within sixty days following completion of permanent repairs the City shall determine actual costs to the City and prepare and furnish to such permit holder an itemized statement thereof and claim additional payment from, or make refund (without interest) to, the permit holdei, as the case may be. Subd. 7. Alternate Method of Charging. In lieu of the above provisions relating to cost and cost adjustment for etreet openinga, the City may charge on the basis of surface square feet removed, excavated cubic feet, or a combination of surface square feet and excavated cubic feet, on an established unit price uniformly charged. In lieu of a cash deposit a letter of credit, in a form acceptable to the City Attorney, may be filed. SBC. 7.07. PARADgS. Subd. 1. Definition. The- term "parade" means any movement of vehicles, persons or anfmals, or any combination thereof, which either moves together and as a body so as to in some way impede or affect the free and unobstructed flow of vehicular or pedestrian traffic, or which moves so that some part thereof is in violation of one or more traffic lawa or regulations, if auch movement.is without a permit hereunder. Su6d. 2. Permit Required. It ia a misdemeanor to sponsor or participate in a parade for which no permit has been obtained from the City, and it is also a misdemeanor to obtain a parade permit and not conduct the same in accor- dance with the permit granted by the City.
