Subject: Greyhawk Townhomes
PURPOSE
This memo is to summarize the issues that have been raised by Nicole Whipple on behalf
of the Greyhawk Townhome Association, and Mazgaret Shreiner, her mother, regarding
private streets, easements, development reviews and approval, development contracts,
planned development agreements and financial guarantees. I met with both Mrs.
Whipple and Mrs. Schreiner on September 15, 2005. In response to the questions asked
and concerns raised, I have researched our records and consulted with other staff. The
following is a response to the questions raised in their e-mails and during my meeting
with them in September, and a summary of what I found in my research.
SUMMARY OF ISSLTES
There are a few issues here. There is a single-family home thaY is part of the Greyhawk
Subdivision, not part of the Association, that takes driveway access to the development's
private streets, apparently without an easement for such ingress/egress. The owner is also
parking a vehicle on the private street which I was told creates an obstruction and is
leaking oiUother fluids onto the street and damaging the asphalt. The homeowner
appazently is not contributing financially to the costs of maintaining the street. In
researching this particular issue, several others have come up.
Mrs. Schreiner has asserted that the City was remiss in not requiring an easement for the
single-family home's use of the private street, or its financial participation in the
maintenance of the private street She alleged that the City should have ensured that an

easement was provided, and that all parties using the private street contribute financially
their fair share to the maintenance of it. She questioned how the City has authority to
require one private party to utilize another private party's property and not pay for it.
While City staff has explained that the dispute they have is between the Association and
the single-family home owner, or between the Association and the developer, she alleges
that by its actions (in approving the development), or lack thereof (by not ensuring the
easement was provided), the City created the problem and should help resolve it. She
says they are just trying to get this resolved and no one is taking responsibility for it and
she indicated the association should not have to incur legal and other expenses to resolve
a problem created by the City and the developer.
CITY PROCEDURES/RESPONSES
1) Jon's e-mail from September 15`h effectively outlined how the development review
process occurs and that the "ordinances and directives" Mrs. Schreiner is looking for
is actually a conglomeration of the entire City Code, Fire Code, Engineering
Standards and City policies which are interpreted and applied by many members of
City Staff in the process of reviewing a development proposal. There is no one
concise document that governs all these things.
2) The City Attorney typically reviews association documents to ensure that ownership
and maintenance of private streets and other common areas is provided for where
such things exist. In this instance, City Attorney review of the association documents
was required prior to final subdivision approval.
3) When there is a subdivision of land, the City executes a Development Agreement
(contract) with the developer and obtains a financial guazantee in the form of a letter
of credit to ensure that the development is completed according to the approved plans
and that the terms of the Development Agreement are fulfilled. The letter of credit
amount may be reduced as items are satisfactorily completed. The Greyhawk letter of
credit has been reduced from its original amount and was last reduced in December
2004. The current amount of the letter of credit is approximately $65,000.
4) When I met with Nicole Whipple on September 15`h, she asked on behalf of the
Greyhawk Association that the City not provide any further release or reduction in the
letter of credit amount for this development "until the association boards have

happy to work with an Association when concem about a developer's performance
has been expressed, we typically do not consult with the association before releasing
a financial guarantee. City staff does conduct inspections of the development site to
determine that compliance with the terms of the Development Agreement have been
satisfied. To the extent that the Association's concerns coincide with the
requirements of the Development Agreement, we can work together to gain
satisfactory completion and compliance. Therefore, we do ask that an Association
inform appropriate City staff when they have a concern so that we may detemune if
the issue is something that is covered by our Development Agreement and therefore,

enforceable by the City. However, the Association may have some concerns or be
dissatisfied with cedain items that are not covered by the Development Agreement, in
which case they will need to resolve those issues with the developer or builder
directly.
5) Nicole Whipple has asked the City to review the grading and drainage in certain areas
of the Greyhawk development. Our Engineering staff has been made awaze of this
concern and has been reviewing the site to determine whether the grading is in
compliance with the approved plans and also whether the drainage is functioning
properly. Dave Westermayer from Engineering has since met on the site with Mrs.
Whipple to discuss the drainage issues.
6) Further question has been raised regazding utilities. Are Yhe utilities for this
development public or private? Where does the single-family home connect to sewer
and water and storm sewer? Is there a separate connection for the single-family
home, or does it connect to the association's sewer line and water line and storm
sewer? These questions were passed on to Engineering and the following information
has since been conveyed to Nicole Whipple:
? All main line sanitary sewer and water main with Greyhawk is considered
public and is maintained by the City with public drainage and utility easement
over the private streets. Public drainage and utility easements also cover the
sform sewer lines 12" in diameter or larger, whetYier they are in the street or
off.
? The single-family home was connected to sewer and water mains within
Blackhawk Road prior to the Greyhawk development and those connections
were not modified with the Greyhawk development. Thus, they remain
sepazate from the lines brought in to service the Greyhawk townhomes.
HISTORY OF THE DEVELOPMENT
The Greyhawk subdivision and Planned Development was approved in 2002. The
development site consisted of one parcel containing a single-family home and one vacant
commercial parcel. The development consolidated the two parcels, and subdivided the
property into 44 townhome lots, one single-family lot, and three outlots. The
development proposed private streets and showed access to Blackhawk Road for the
townhomes as well as the existing single-family home via the new private street.
A Planned Development Agreement was executed that included the Site Plan, which
again showed access for the single-family home via the private street. The 44
townhomes and one single-family home and three outlots were all part of the PD
Agreement.
In 2003, an Amendment to the Planned Development and an amended subdivision/plat
were completed that adjusted the internal alignment of the private streets and the specific
location of some units due to poor soil conditions encountered in the initial phase of
construction. An Amendment to the Planned Development Agreement was executed as a

supplement to the original PD Agreement, and included a revised site plan and landscape
plan. A new Development Agreement was also completed for the revised subdivision.
Neither the conditions of approval for the PD nor for the subdivision included a
requirement that an ingress/egress easement be provided for the single-family loYs use of
the private street. The conditions of approval did require that a townhome association be
established and that the association documents be reviewed by the City Attorney prior to
final subdivision approval and that the association own Outlot B(the private street) and
other common areas.
During the development review process, signing of the private street as "ho pazking" was
determined to be not necessary from a public safety perspective because the street meets
engineering and design standards and is sufficient for emergency vehicle access and
provides for emergency vehicle turnaround.
From what Pve been told and the docmnentation they provided, the single-family home is
not part of the association. However, the association documents state "An Easement and
Maintenance Agreement is anticipated to be executed with regard to Lot 1, Block 1,
Greyhawk 2"° Addition, and the property lying north of said Lot 1, Block 1, which will
provide ingress/egress to Lot 1, Block 1, at this time; and which will provided
ingress/egress for future development of those parcels, together with the obligation to
provide pro rata maintenance of Outlot A of Greyhawk Second Addition." Apparently,
this easement, if executed, was never recorded. The Association has consulted with their
own attorney and has contacted the original developer, Mark Gergen and Associates
about the easement, but has had no luck in locating the document.
INFORMATION PROVIDED
When I met with Mrs. Whipple and Mrs. Schreiner on September 15`h, I explained the
following points:

? That the Development Agreements are not recorded.
? That Planned Development Agreements are recorded.
? That City Engineering is working on reviewing the grading and drainage.
? That it is the developer's responsibility to follow-through on the requirements in
the association documents, namely that an easement for ingress/egress for Lot 1's
use of the private street would be created.
? That the CiYy is not a party to association covenants or agreement, and does not
enfarce or ensure follow-through on the provisions in the association documents.
? That for whatever reason, the City did not require the ingress/egress easement to
be in place as a condition of either subdivision or Planned Development approval.
? That the Association should continue to inform the City in wriring of concerns
they have about the developer's performance and completion of development
obligations so we can follow up on those issues as they may colncide with items
covered in our Contracts and Agreements with the developer.

? That the City has authority to approve zoning and subdivision of land (in
response to the question of what authoriYy the City has to allow one private
property owner's use of another private property owner's land).
UPDATE
Since my meeting with Nicole Whipple and Margaret Schreiner on September 15th , staff
has continued to work with Mrs.lVhipple to respond to her questions, provide
information, and meet with her on site to discuss concems. I have remained the primary
contact for Mrs. Whipple, and have directed Mrs. Whipple to other staff inembers as
needed. John Gorder and Dave Westermayer in Engineering have been particularly
helpful in responding to questions and issues. Mary Granley in Code Enforcement has
also responded to some questions about placement of directional and parking signs
internal to the townhome development. Mrs. Whipple is in direct contact with ow
Engineering staff regarding the City's acceptance of public improvements within this
development, and release of the financial guarantee.
