Dear Mr. Hittner:
I am writing this letter as a follow-up to our phone conversation. The development
contract states: the Developer warrants all improvements required to be performed by
the Developer, its agents and employees, against poor design, engineering, materials and
faulty workmanship for a period of two (2) years after acceptance by the City. The
Developer shall be solely responsible for the cost and expense to perform all required
repair work to City Standards within thirty (30) days of written notification by the City.
Our records indicate that the City Council acknowledged the project completion on
December 19, 2000. This would be the date that the warranty period commences and
would remain in effect through December 19, 2002.
Since the City will not assume ownership and maintenance of the storm sewer until
repairs are made to City Standards, our recommendation would be that you contract your
appropriate agent to have the work performed and completed within thirty (30) days of
this notification.

The Hittner Residence is a slab on grade home with an indoor
swimming pool. Referencing our phone conversation of
September 1, 1999 regarding the above location, 2 have
designed the below duct system with6ut insulation on two
sides to build up a heat sink and insure the'f owner will have
warm floors. The money saved over a radiant loor system
($25,000) has been re-invested in a state of the art energy
recovery system which recovers 70% of the heat exhausted
from the toilets, kennel, library, and pool room, and uses
this recovered heat to temper the dry outside makeup air
required to maintain proper humidity levels in the pool
room. Deleting the insulation on two sides will add about
3 MBH to the heat loss but the energ;r recovery system will
reduce the heat loss by 50 MBH at design conditions.

Dear Mr. Hittner:
I am writing this letter to request your assistance with a drainage concern in the
subdivision you developed and in which you currently reside. With the frequency
of sienificant rainfalls this summer, Hittner Pointe south of your residence has
been flooded by the overtopping of the pond located on your property.
At the request of one of your neighbors whose access to their residence is affected
by the flooding of this private street, city staff reviewed the site and compared the
existing conditions with the approved grading plan for your development. The
grading plan clearly indicates the designated outflow of the pond on your parcel
to a storm sewer pipe at the northeast corner of the pond at an elevation below the
low point in Hittner Pointe that has been subject to flooding this summer. The
field review by staff revealed a landscaped area between the pond and outlet pipe
that has been graded above the pipe elevation that appears to be restricting the
overland drainage of the pond to this pipe. The grading of this landscaped area
does not appear to be in accordance with the approved development grading plan.
I believe the flooding issues would be resolved if the grading in this landscaped
area more closely reflected the approved grading plan. This would appear to
require the excavation of earthen material and the relocation of existing plantings.

The City of Eagan actively manages its right-of-ways and easements and, by
ordinance, regulates the installation and maintenance of trees, shrubs and
landscaping within or affecting these areas. The ordinances are intended to
protect and promote the safety and welfare of the general public.

and pedestrians on streets, intersections, trails, and sidewalks. Trees, shrubs or
landscaping shall not be planted as to block the visibility of any regulatory,
warning or street identification sign or block the illumination ofstreetlights...

Dear Mr. Hittner,
On June 9, 2006 I mailed you a letter informing you of a sight distance
obstruction on your property at the intersection of Pin Oak Dr. and Hittner Pointe.
During a recent follow up inspection it was discovered that this situation has not
been addressed. The tnxnk of the lilac bush in question does not actually fall
within the clear zone. The boundary line for the clear zone is on the very east side
of the trunk. The problem arises further up as the branches spread out. In order
to bring the intersection into compliance I would ask that you simply trim the
branches on the east side of the bush. Removing or relocating the bush would be
the best option as this will be an on-going issue in the future as the bush continues
to grow. However, with the trunk outside of the clear zone I can not require a
total removal.
I realize this may seem like a petty issue but we are required to follow up on all
complaints. While it may seem relatively minor, your property is in violation of
City Code at the intersection. Please make the requested corrections to ensure the
safe travel of the streets in your neighborhood. If you have any questions please
