In response to the request you made during our meeting at your residence on June 5, 2000, I am
writing a summary of our discussion. I have included a certificate of survey of your lot to
reference the area we discussed. The azea of interest is highlighted.
The area we discussed is between 830 and 832 Ivy Lane, near the rear of the structures
(highlighted). Evidence of erosion is visible in this sodded area. The slope of the ground surface
in this area is in violation of City Code Section 4.30 Subdivision S.J, which states the maacimum
permitted slope is 3-feet horizontal to 1-foot vertical. The ground surface in this area appears to
be in excess of a 3:1 slope; much of this area appears to be steeper than a 2:1 slope.
The closing for your residence occurred on December 17, 1996, with the ground surface under
snow cover, as you stated. During winter construction, frost and snow conditions in Minnesota
limit the ability of the builder to complete the final grading prior to a`winter' closing. In good
faith, the City of Eagan issued the Certificate of Occupancy with the understanding that the
builder, Country Home Builders, would complete the final grading of the lot in compliance with
city ordinances by the sutnmer of 1997. This is common practice in the City of Eagan during the
winter when the ground surface is frozen.
A Certificate of Occupancy would not have been issued for 832 Ivy Lane during the sutmner
construction season with the area previously mentioned in its present condition. The area is in
violation of City Code. I hope this information is helpful. Please contact me with any questions.

I am writing as a follow-up to our meeting at your residence on August 6, 1999. I have included
a certificate of survey of your lot to reference the areas we discussed. The areas of interest are
highlighted.
The first area we discussed is between 830 and 832 Ivy Lane, near the rear of the structures
(Green highlight). Evidence of erosion is visible in this sodded area. The slope of this area is in
violation of City Code Section 4.30 Subdivision S.J, which states a maximum slope of 3-feet
horizontal to 1-foot vertical. This azea appears to be in excess of a 2:1 slope.
The second area is between the garages of 830 and 832 Ivy Lane (Blue Highlight). This azea has
a substandard grade and does not drain toward a catch basin or the street. Based on my site
review, and confirmed by your personal recollection, this area drains toward the sidewalk along
the east edge of your residence. The sidewalk is the low point of this drainage area and
accordingly collects the runoffuntil it is either manually removed, infiltrates the ground, or
evaporates. During the spring thaw, prior to the thawing of the ground, this can become a
dangerous situation with the melting of snow and freezing of ice on the sidewalk.
