On August 18, 1995 I met with Mrs. Goranson to review the concems she has with her townhome
on ivy Lane. I explained to her that we would do what we could to help, but most of the concems
she had can not be regulated by the City.
The water leak in the laundry room ceiling fixture did not appear to be a major problem. It was
directly under the whirlpool tub area and happened only periodically. She stated that when her
grandchildren are in the tub, it is usually very full. This leads me to believe that the overflow seal
might have a leak or the rim of the tub might need caulk. She said that she would monitor the
water staining of the fluorescent fixture after the tub has been used. I will contact the builder
regarding this.
I adjusted the threshold on the patio door to create a better seal with the door sweep and told her
to contact the manufacturer if she experiences it leaking in the future. She said it seemed to only
leak during a driving rain.
On August 17, 1995 I spoke with Kim Jackson of CountryHome Builders. She has contacted
Advanced Companies to look into the problems Mrs. Goranson has and she will contact Mrs.
Goranson to set up a time for making the necessary corrections. Kim also mentioned that they
are preparing a response to Mr. & Mrs. Goranson's claims to the Attorney General's Office.
The lot to the north does not appear to be draining properly and I will contact Craig Knutson to
discuss this prablem.

I am in receipt of your letter indicating problems with your new townhome on ivy Lane. After
reviewing your concerns, it appears that we can try to rectify your problems; however, our power
is limited by those items specifically addressed in codes; i.e. the water leak in the ceiling fixture.
Additionally, I would like to look at your sunroom door and see if any recommendations can be
made.
We have asked LeRoy Berg, the City's Weed Inspector, to make a site inspection of the lot
adjacent to yours and he will then take the proper steps to enforce the weed ordinance.
The silt fence on the property line is not aesthetically pleasing; however, is necessary to prevent
erosion on your lot until development of the adjacent lot.
The remaining items in your letter appear to be a private contractual dispute between you and
the developer/builder. If you feel that misrepresentation warrants further action, it woutd be our
suggestion that you contact the Dakota County Association of Realtors at 452-6611 or the
Builders Licensing Division at the Minnesota Department of Commerce - 296-6319.
I have attempted to reach you by telephone and left messages for you on August 15 and August
17. Please call me at 681-4699 so we can set up a meeting to discuss your concerns.

At the April 20, 1993, public hearing for the above referenced project you preserrted
testimony indicating the parcel would not benefit from the improvements due to its limited
ability for development based on the fill that had been previously placed on this property.
The city received no additional information from you supporting your request.
On August 23, 1994, a letter was sent to your attention iMorming you of the finai
assessment hearing scheduled for September 6. This letter offered you an opportunity
to review the proposed finai cost and discuss any additional information or concems you
may have had regarding your original request. Staff did not receive any iMormation until
the night of the public hearing when you reiterated your objections to the assessments.
These objections were based on information you compiled indicating it is not possible to
develop the property and as such, cannot support the amourit of the assessments.
Subsequerrtly, that public hearing was continued until October 18 to allow additional time
for you to share that information with aty staff.
On September 16, not having yet received any information from you, i contacted you by
phone and personally requested that you provide whatever irdormation you feel
appropriate to the city's attention as soon as possible. You responded that you would
have that information delivered to our atterrtion "eariy+ next week`.
As cf this date, we have not yet recenred any information from you to further evaluate the
merits of your request to reduce the proposed assessments.

Dear Mr. Hedges:
Enclosed is a copy of our complaint letter to Ross Fefercorn, developer of Woodland Country
Homes.
We purchased a townhome at 856 Ivy Lane a yeaz ago and have had poor response to warranty
problems reported to the builder. We had expected the warranty would be the usual standard of
practice we have experienced in purchasing other new homes where house and lot problems were
corrected in less than 12 months.
In reviewing the language in the Country Homes warranty (post-purchase) we find the
responsibility of the builder to be very limited. The homeowner and the homeowners' association
aze designated as being responsible for correction of most problems (except for "structural,
mechanical, plumbing and electrical standards contained in the Building Code, Plumbing Code
and Electrical Code of the governmental entity having jurisdiction").
We have enclosed a highlighted copy of the warranty as well as a copy of the Country Homes
"Wananty Request" form which includes an interesting stipulation (in small print at the bottom):
" if the service call was within the scope of homeowner responsibility, that a minimum $50.00
service charge will be charged". This statement, alone, would discourage home owner requests
to correct a problem when the developer is the final arbiter as to the "worthiness" of the
complaint.
When we signed our purchase agreement we understood that the house and total landscaping
would be completed by our closing date; however, a satisfactory grade for the lot has never been
established with water pooling on the west and north sides of the house even with moderate
rainfall, the west side is still weeds instead of the promised BEAUTIF[JI. landscaping, and the
south side of the house has a length of dismal unsteady black plastic refened to by the developer
as an "erosion control fence". We had expected an attractive retaining wall matching the
landscaping scheme throughout the development where adjoining lots had different elevations.
As you can see by Mr. Fefercorn's arrogant letter to us dated November 21, 1994, the
professional landscaping of our lot will oot be completed until the property on the adjacent lot is
finished . It is unbelievable that he expects us to be looking at that black plastic for what could
be a very long time.
Our landscaping was to be completed when we paid for it July 15, 1994 at our closing. Lack of
completion constitutes a breach of our purchase agreement.
Another issue which caused problems for us and could cause unnecessary disappointment for
other prospective buyers is Country Homes false advertising/promotional displays. In their
model home there is a lazge display in color depicting the development with its lots, landscaping
and the pond with a walking path encircling it. This is what first attracted us to L.ot #24 directly
overlooking the pond. The display also showed the pond path connecting with the Great Oaks
subdivision. When Mr. Mains admitted on questioning that there was not room for the path
around the pond we decided on the more elevated Lot #13. Also, in regard to advertising, there
is a disclaimer on page 3 in the "addendum to the purchase agreement" stating the model home
does not constitute a representation that the townhome will conform to the model and also that
drawings and pictures in sales brochures also do not constitute a representation. What does???
The verbal information from the sales person was not reliable either. What is a buyer to expect?
We understand from other concerned homeowners in the Woodlands that the developer has
expanded to Woodbury and Eden Prairie with plans to start projects in Apple Valley, Chanhassen
and Oakdale. We have been told that warranties going back three years have not been taken caze
of so any further expansion concerns homeowners with unresolved problems.
A house at 853 Ivy Lane has had shingling "in progress" for about five weeks with doors and
windows left open on a regular basis. An unfinished unit at 862 Ivy Lane has been vacant for
several months with doors and windows left open even during the winter season. The
homeowners living in the other half of this townhouse are concerned about safety issues as
neighborhood children often go into the house unattended.
We feel the city should be awaze of these concems, possibly to correlate with complaints from
others in this development.

As you are well aware, there were imponant issues which had not been resolved at the time
of "closing" on the home we purchased from you on July 15, 1994.
The evening prior to closing we met with Ron Mains, your sales manager, in the model
home office. We were very concerned regarding the number and sign'{j'icanc¢ of un{j'inished
wark and unresolved issues. Most importantly, Mr. Mains had assured us that a mound of
dirt preventing a view of the portd from the ground level of our house would be graded.
Because we have always enjoyed water and boating, being able to see this little pond was
valuable to us. We would not have purchased the !ot without the pond view. Mr.Mains
stated that cutting down the mound would be no problem and reitemted this promise to us
several times during the construction period. He also assured us that the landscaping
around the oak trees on the west sicCe of the lot would be BEAUTIFUL. When we
questiorsed him regarding specifics, such as, wouCd it be terraced with flowers and
shrubbery as in some other lots dn the development?, he didn't know; however, he assured
us there was a total landscaping plan for the development which could be seen at the main
office. When we called to make arrangements to see the landscaping plan we were told
there was none. (The west side of our lol including the area overlooking the pond and
around the oak trees is still covered with weeds.)
In our conversation with Mr. Mains on the evening of July 14 we discussed delaying the
closing unless these problems were resolved. He then made a list of our concerns and
FAXed copies to Susan Sauter, Praperty Manager, who was on duty in the Country Homes
office. The list was tmnsmitted to Ms. Sauter at 7:27 P.M.. Included on Mr. Main's list:
"Homeowner would like dacumentation from an authorized person to ver{fy what the view
will be. As of now there is a hump of dirt and pond is not viewed from first level.
Homeowner paid a$10, 000 lot premium for view. Wants to know how landscape well be
done. "
We were unhappy when we arrived at the closing July IS and found that the
documentation requested was not available. Mr. Siekrnaan, Vice President of Woodland
Country Homes, who was present for the closing, assured us that we would be given the
documentation, and also have a visit from the'7andscape architect", who would show ua
"the plan" within two weeks. When we finally met with the architect, she could not show
us an overall plan, but decided to place stones and small evergreens on a portion of the
hillside.
We are not naive, nor are we dnexperienced in the purchase of homes. This is our third
new townhome purchase within the last ten years. Because we had encountered no
contractor diffzculties and all warranty work had been completed to our satisfaction in less
than six morzths, we had no reason not to believe Mr. Sielanann when he assured us shat
everything would be completed shoKly. It is now over eleven months since our dosing. In
spite of written lists, telephone calls, reminders and urzkept promises the "warranty work"
has not been completed, and, in most instances not even started. Enclosed is a copy of one
of ihe lists sent to your office by certifxed mail on November 18,1994. Also enclosed is Mr.
Fefercorn's arrogant letter of reply. The only item an the list which has beea corrected to
date is the firsplace heating unit. It was finally fi.red on Friday, December 23 qfler seveml
additional requests had been made.
In December we met with our attorney, Mr. Paul Hauge, to ddscuss the problems we were
having with your company. (A copy of his lelter to Mr. Fefercorn is enclosed.) As yau
know we met with Mr. Hauge, Mr. Mains and yourselj at our home on January 18 in an
attempt to reach at least a compromise. At the meeting Mr. Madns denied having ever
assured us that the mound of dirt would be removed to allow a pond view. Hds statement
was a lie. At the same meeting you discussed a tree consultant's inspection of the oak trees
and agreed to aend us a copy of the repart. We have, as yet, heard zodhing further fmm
you. .
This morning we had ouw lot resurveyed to locate the monuments which are required to be
set within one year of plat recording. Only one was found. We now have a11 four placed
and identified. It ds now even more clear that sodding and "premium pmfessional
landscaping" has never been completed on our lot as stated on your advertising bmchure.
We were not provided with a plat (including our lot) at the time of purchase as required,
but obtained one at the county recorder's office qfter the fact.
Attached is a list of additional problems which have been reported to you since the closdng
date but remain uncorrected. Minnesota Statutory Warranties are addressed in Chapter
327A. MN Statutes 327A.02, Subdivision 1(a) refers to the one-year period for correctron
and MN Statutes 327A.05 Suhdivision 1(a) and (b) defines the remedies for new home
warranties.
We now know that it would have been wise to talk to some af our neighbors prior to buying
a hnme in ynur develapment. Dissatisfaction with your negative response to problem
correction is prevalent. We should be settled in ared enjoying our home by now, but,
instead, we are still burdened with problems that could and should have been resolved
months ago.

Bea and Kurt 6oranson have contaeted me aTaout the qasline
easement problem that exists on their lot that was purchdsed from
Woodland Country Homes covering Lot 13, Block 2, the 47oodlands
North Third Addit'ion.
i have.reviewed a zumber of documents, including the plat, the
deed, the covenants covering the subdivision and have talked with
a representative of People's Gas and also Chicago Title
concerning the easement. It is my understanding that the sales
man, Rob Mains, assured the Goransons when they signed the
Purchase Agreement that they would have a clear view of the pond
that is located south and west of Cheir lot. I am now told that,
because of the qasline that exists on the west side of their lot,
that they cannot view the pond from their townhome and the reason
for the $10,000 lot premium tnat was:paid by the Goransvns
clearly cannot be carried out. I have also been told that
People's Gas has asked to lower the Zine but there are three
mature oaks within the vicinity of the gasline and the
possibility of doing damage or killing the oaks is certainly
fairly great if the line is changed in any way.
Two possibilities appear to be that the line could be moved to
cross the vaeant lot to the left around the oak trees, or the
line covld be lowered in an attempt to minimize any damaqe to the
Crees. Although the Goransons are very concerned about damaging

any o£ the aaks, a higher priority for them is the view of the
pond which was the basis for the premium paid for the lot.
The Goransons also were informad by both you and Ron Mains that
the area arpund the oak trees wauld be beautifully landscap2d
according to an overall landscape plan and that plan was never
prepased and the landscaping was not i.n.stalled as described.
I underatand also that there are some additional construction
items that are not complete and should be recYified as soon as
possible.
I expect to hear from you within ten days so that a decision can
be made jointly as to hnw to proceed with these issues.

Warranty Guidelines And Maintenance Manual
The following warrant guidelines are intended to specify the mini-
mum performance standards for construction, and set forth the basis
for determining the validity of all home buyers' complaints relative
to defective materials and workmanship during the applicable war-
ranty periods.
Only the most frequent defects of concern to the home buyer have
been enumerated in these guidelines. The structural, mechanical,
plumbing and electrical standards shall be those contained in the
Building Code, Mechanical-Plumbing Code and Electrical Code of
the governmental entity having jurisdiction of and regulating the
subject construction. Inspection by governmental jurisdiction will
provide evidence of compliance.
To the extent that minimum performance standards for construction
have not been enumerated in these guidelines, defecu and deficien-
cies in materials and workmanship will be those recognized under
generally accepted standards ofthe building industry in which assure
qualiry of materials and workmanship. _

ALL WORK DONE WILL BE IN RESPONSE TO A WRTT-

Similarly subcontractors will perform Homeowner work only upon
written instructions from the builder/construction office. The written
instruction is in the form of a work order or purchase order issued by

ROUTINE MAINTENANCE OF THE HOME IS THE
HOMEOWNERS' RESPONSIBILITY. THIS INCLUDES
APPRISING THEMSELVES OF RECOMMENDED
PROCEDURES FOR USING AND MAINTAINING ALL
COMPONENTS OF THE HOUSE. THE HOMEOWNERS
KNOWLEDGE AND COOPERATION ARE VITAL.
"HOMEOWNER HINTS" on maintenance have been included
for several items discussed in these guidelines. For example, *ro
for se_rs, furnace filters, shut offvalves for external sillcocks, etc.
Please review each category carefully. Negligence of normal main-
tenance items can void the warranty on the item involved.

opportunity to ask questions that have come up during the
first few weeks in your home as well as submit a list of any

appointment for the Customer Courtesy Call is arranged
during your Orientation/Walk Thru.

HELPFUL HINTS:
The wiring in your home will accommodate a number of electrical
appliances. Occasionally you may find an outlet or circuit that does
not operate when you first move into the home. In this case, electrical
wiring and appliances are protected by circuit breakers located in the
main panel box (usually located in the garage). Circuit breakers
eliminate the problems of replacing fuses. The breaker is normally
in the "on" position. To restore power, you snap it completely off
then back to the on position. Ordinarily small appliances may be
added without fear of overloading a circuit. However, large appli-
ances or many smalt appliances may cause tripping of the circuit.
Other causes of circuit tripping are:
• 1. Worn out cords or defective plug connections.
• 2. Defects within the appliances themselves.
If after resetting the circuit breaker it again becomes tripped, you
should immediately attempt to locate the cause and corcect it. If the
outlets have no power, check the switch in the room that controls the
outlet. One outlet in each room is operated by a wall switch. Usually
this is the switch closest to the door. If this does not work, check for
a bumed out bulb in the light fixture. If the trouble is not found there,
then check the circuit breaker and reset any tripped switches.
I£appliances such as your garbage disposal and dishwasher do not
operate, check the circuit breaker. Also check the heat reset button
on the garbage disposal.
WARRANTY
(a) During fhe one year period from and after the warranty
date, the dwelling shall be free from defects caused by
? faulty workmanship and defective materials due to

The Ground Fault Interrupter is usually found in
kitchens, bathrooms and main fuse boxes. The main
reason for this device is to protect areas high in risk
of electrical shock. Bathrooms have had them for
years. This year they are required in kitchens for
electrical permits after August 1, 1987. A kitchen
Ground Fault Interrupter is usually on it's own, but
it is not the rule. All outside outlets like patio and
garage outlets are on the Ground Fault Interrupter in
the bathroom.
Testing the Ground Fault Interrupter
Push Yellow "Test" button. Red "Reset"' button
will pop out, exposing the word "Trip": Power is
now OFF at all outleks protected by the interrupter.
This indicates that the device is functioning prop-
erly. Push the Red "Reset" button back in. Power is
now ON for all outlets protected by the intertupter.

HEATING, AIR CONDITIONING AND VENTILATION
HELPFUL HINTS
Your new home is furnished with a furnace and "(optional)" central
air conditioning system. The following points are suggested in case
of any difficulties you may encountec Before calling for service:
• 1. Check your circuit breaker.
• 2. Check the electrical switch that controls your fumace.
(Note: The switch will be on or near the furnace).
• 3. Leave doors open for better air circulation in bedrooms.
The fumace bumer will automatically turn on if the room tempera-
ture drops below the setting of the thermostat. A point to remember
is that, contrary to common belief, setting heating controls high does
not make a fumace heat faster.
WARRANTY
•(a)During the one year period from and after the wananty
? date, the dwelling shall be free from defecu caused by

LIMITATIONS
This warranty does NOT cover:

themselves, including exhaust fans, or any defect arising
from any cause other than the manner in which such units
have been installed; these units, to the extent present, are
warranted and serviced by the manufacturer, installer and
/or other supplier;
any heat pump, electronic air cleaner, exhaust fan,
thermostat or humidifier which may be furnished with your
home. (These items, to the extent present, are warranted
and serviced by the manufacturer, installer and/or other
supplier).
We will arrange with the heating sub-contractor any unit's
replacement if the failure is due to defects in installation,
workmanship or defective parts.

INSTRUCTIONS
HOMEOWNER
Here are a few operating instructions and what-to-do tips.
When new fumaces ignite, a slight odor or smoke may appear at
registers. This is because of the oil used in shipping. Continue to
run furnace with a window or door open.
• Fumace is out:
Find and read the service manual usually left by the installation
contractor on or near the cold air return filter. Check gas valves.
Arrows should be paralfel with the pipe. Check to see if gas water
heater is on. If not, you may not have gas.
• Check to see if thermostat indicator is on Heat.
• Check to see if thermostat indicator is on Auto Fan.
• Check thermostat - set to higher reading.
• Listen at furnace for clicking sound of electronic ignition.
• If no sound or flame, check to see if power switch is on and
also check circuit breaker in main fuse box. Circuit breaker
for fumace is marked along with the other circuit breakers
in the home. Markings are on main fuse box door.
Furnace door MiTST be on at all times for there is a safery switch
behind it. This must be compressed by the door in order for it to
operate. Since there is no pilot light in your furnace, these above
steps are about all you can do. Then please call a Woodland Coun-
tryHomes representative. We will see if we can help first or we will
set up a time for the installation contractor to fix the problem.
Usually there are four problems with the fumace.
• 1. There is no gas available
• 2. The fumace iuelf
• 3. Electric wiring problems
• 4. The furnace instatlation

your problem. Most problems can be remedied during normal work-
ing hours, between 8:00 AM. and 4:00 P.M. In the event that it is
after hours, call us as soon as possible, and keep doors and windows
shut to preserve heated sir. The temperature in the home should not
change drastically. We will be there first thing in the morning.
Maintenance Tips:
• Replace the filter every month.

Operating Tips:
The thermostat dial on the face will not be accurate with tempera-
ture reading on thermostat.
To help balance the heat, make sure the air damper is open on the
down flow supply during the heating season. Also, that the air
damper above the furnace in the supply air duct is 3/4 of the way
closed. These air dampers are marked alongside the pipes to indicate
open and closed.
After that, start with the register in the bay window area, openmg
it wide open. Then shut down the rest of the registers 1/2 way. Most
of the time, the register by the service door needs to be open only I/4
of the way because of heat from the furnace room and the kitchen.
Take note that heat from the register closest to the thermostat may
shut down your furnace too early, in tum making areas farthest from
the furnace cold.
Upstairs air supplies have air dampers in the pipes. By removing
the register,they can be adjusted.
Remember that the air suppiy duct is like a big balloon-when
punctured, the air escapes. The more open the registers are close to
the furnace, the longer it will take to fee] warm in the bay window
area.
These are a few tips for the heating season.
Just F RC them for the summer months with air conditioning.
AIR CONDITIONING
Air conditioning should not be used when outdoor temperature is
below 60 degrees F. If you have problems with your air conditioning
the following check list may help. Be sure to check all of these before
calling a maintenance person.
• 1. Check main power supply. The circuit breaker is located
in the main service panel in the garage.
• 2. Check to make sure the electrical switch on the side of
the furnace is in the on position.
MECHANICAL
• 3. Make the outside disconnect, located on your house by
the air conditioning unit, is on and fuses are installed.
. 4. Check the fumace filter. If i[ is dirty it needs to be
changed. Be sure to shut off power before changing.
• 5. Turn system selector on thermostat to on position. Fan
selector switch should be in AUTO position for normal
operation. Set thermostat to desired temp.
MOST COMMON PROBLEMS
Most common problems with air conditioning are caused by the
following:
• 1. Outdoor unit does not run;
No line voltage power to unit. (Refer to steps 1, 2, 3,
above).
• 2. Furnace fan does not operate;
Blower door not installed properly. This will cause the
power to the furnace to be off. (Refer to step 2 above).
• 3. Insufficient cooling;
Dirty filter. (Refer to step 4 above).
Dirty outdoor unit. (Clean per homeowners instructions
shipped with unit.).
Registers closed or blocked by furniture
Open windows or doors.

Your hot water heater is installed with a pressure relief vaive to

pressure. Hot water heaters normally collect a small amount of dirt

Preventing back tlow from garden hoses into household water
systems has become a growing concern. The combination of a
pressure reversal and a hose linked with contaminants can literally
poison a drinking system. MBCO's Pur-Tector sillcock was designed
to eliminate this dangec Under ordinary conditions, Pur-Tector per-
mits generous flow. But shoutd the pressure drop, causing a siphon
action, Pur-Tector goes to work; first as a check valve to prevent back
flow; then as a vacuum breaker to stop the siphoning action. Also
Pur-Tector can be manuatly drained to prevent winter freezeups.
HELPFUL HINTS
In some cases either your inside shutoff valve or your ouuide
sillcock may develop a slight drip. This is caused by the seating of
the packing in a new valve. To stop any leaking that may occur from
the packing seating iuelf take-a small crescent wrench and tighten
the packing nuu slightly. DO NOT OVER TIGHTEN.

Floor squeaks and loose subfloor are often temporary conditions
common to new construction and a squeak-proof floor cannot be
guaranteed. Generally, these will appear and disappear with changes
in weather conditions. A certain amount of floor shrinkage is normal.
Complete avoidance of shrinkage is impossible.
WARRANTY
We do NOT warrant t7oor squeaks unless caused by defective
materials such as de laminated plywood.
ROOFS
HELPFUL HINTS
We have used "seal-down" asphalt shingles on the roof. The mastic
is placed on the under side of the shingles and once the hot sun hits
the roof, they will stick fast to the shingles beneath them. There is a
possibility that the shingles may be lifted by strong wind when first
applied or if applied in winter.
In cases of (eaks resultin m damage caused by severe storms
with winds exceedin 30 m.p.h; which are not covered by our
warranty below, we sugg at you contact your insurance agent.
Normal shrinkage will cause the need for caulking around vents and
f7ues on the roof; failure to perform this maintenance task may, in
time, result in leaks.

If during the first year the roof develops leaks due to defects in

WOOD AND DRYWALL (General)
HELPFUL HINTS
Like other organic building materials, wood may contract or expand
with weather changes. Wood is affected by heat and cold. It may
shrink under extreme dryness or swelt under extreme humidity. Some
shrinkage and swelling is unavoidable. The primary areas affected
will be doors, baseboards, resilient floors and shelving. It is interest-
ing to note that these changes will be more pronounced on the outside
walls, as opposed to the inside walls, in such areas as bathrooms and
kitchens. Thus, shrinkage throughout the house will be uneven. This
shrinkage and swelling may result in slight cracks around doorways,
arches, windows, joints in door casings and nail pops around base-
boards. Althvugh it is impossible to completely alleviate the prob-
lem, keeping the house at an even temperature is an excellent
precautionary measure.
The interior walls of your home are constructed of drywall. Wood
shrinkage or settlement cracks, nail pops and/or seams can appear
during the drying out process of your home. This is normal. No
attempt should be made to repair these occurcences in the drywall
until your home has gone through the "drying out" period. After one
year, use spackle to fill in these areas. Spackle can be obtained at any
hardware or builder's supply store in either powder or paste form.
Touch-up paint is provided at the time of occupancy.
WARRANTY
The interior wood, drywall and paint in your home are warranted
to be free of defects in materials and workmanship for a period of
one year af[er you receive possession of your home.
LIMITATIONS
This warranty does NOT cover:

caused by the shrinkage of the wood to which the dry wall is attached.
One time at the end of the wartanty period, Woodland Country-
Homes will make drywall repairs.
The Homeowner will be responsible for any touch-up or repainting
that is needed as a result of this service. Such touch-up may not match
original paint exactly. REPAIRS WILL NOT BE MADE ON
FLAWS WHICH ARE ONLY VISIBLE UNDER PARTICU-
LAR LIGHTING CONDTfIONS.
If the drywall repair is the result of a plumbing leak or other
warranry-based repair, Woodland CountryHomes will assume the
cost of repainting the area of drywall. RESTORING CUSTOMER
PAINT COLORS OR WALLPAPER IS A HOMEOWNER RE-

Site applied paint is used on both the interior and exterior of your
home. Professional, good quality paints are used throughout. The
Masonite siding and garage doors are factory primed, over which is
applied one coat of either Iatex or oil base paint depending on air
temperature. Exterior cedar trim is primed on site over which is
applied two coats of either latex or oil base paint, again su6ject to air
temperature. Cedar trim boards tend to absorb paint unevenly due to
variations 'rn wood grains. These variations cannot be controlled and
excessive applications of paint will peel latet Exterior shutters are
site painted with two coats of either latex or oil base paint. Exterior
painted surfaces should be maintenance free for years after the
purchase of your home.
Interior walls are painted with a two coat system, 1-coat primer,
and 1-coat finish latex. No attempt should be made to wash interior
walis for a minimum of 90 days after the purchase of your home.
Paint takes at least this long to harden. After 90 days walls may be
carefully "blotted" with a damp sponge to remove marks. If marks

occur hefore 90 days and you want to remove them, it may be better
for you to touch-up your walls with the extra paint we have left with
you. In general, checks and cracks are common items due to causes
other than paint or its application.
While all painted surfaces are covered with either heavy bodied
stains or paint these surfaces wiil lose their color-fastness depending
on the conditions of exposure, although they wi11 maintain the
protection of the paint. It is a characteristic of exterior wood, to have
shrinkage, cracking, checking and sap pockets, which may somewhat
discolor the paint, these conditions are normal in any wood.
WARRANTY
The interior and exterior painted/stained surfaces of your home are
warranted to be free of defecu in materials and workmanship for a
period of one year after you receive possession of your home.
LIMITATIONS
This warranty does NOT cover:
• Scratches/marks on walls left after the purchase of your

STAIN
Stain and vamish are site applied on all interior woods with the
exception of bathroom and kitchen cabinets. The site finished wood
surfaces may include oak, birch, pine or fir. All woods have vari-
ations in grain and as such, will absorb stains differently even
amongst the same species of wood. All window sash are soft woods
as well as louvered doors, French doors, sliding glass doors and
atrium doors. Generally, trim and passage doors are hardwood,
usually oak. Variations in stain color cannot be controlled. Site
finished woods may be carefully cleaned with a moist sponge and
immediately dried with a sofi cloth.

DOORS
HELPFUL HINTS
During the summer months there is usually very little trouble with
doors, but winter heating may change the moisture content of the
wood, causing temporary warping. Interior doors and bi-folds often
stick or warp due to various weather conditions. We suggest that you
apply wax to the tracks of a bi-fold door to avoid their sticking. Use
graphite on door locks, not oil which may gum up the mechanism.
Don't slam doors. They will stick, sag and jamb. Teach children not
to hang on doorknobs and swing back and forth. The door will soon
sag and the hardware will work loose.
WARRANTY
Interior doors are warranted for one year after you receive posses-
sion ofyour home to be free of defects in materials and workmanship.
In addition, we will repair or replace doors that become inoperable,
or that warp more than one-half inch during this period. The finish
on wood front doors is to be maintained by the buyer after 90 days.
LIMITATIONS

MANUFACTURED CABINETS; (KITCHEN AND BATH)

The kitchen cabinets used in your home are factory f5nished and

scratch-removing furniture polish or coating with a wax stain. (Shoe
polish is sometimes used). You may enhance and preserve the rich
wood grain finish on your kitchen cabinets by applying a coat of paste
wax two or three times a year.

Your kitchen counter tops are heat resistant, not heat proo£ Cook-
ing pou, as they come off the stove, are hotter than counter tops will
stand. Do not put hot pans or cigarettes directly.on tops. Use triveu
or asbestos lined hot pads.
Your counter tops are made of a material which is scratch resistant
and will not crack or craze under normal usage. The tops will scratch
if used as a cutting board. Use a cutting board when cutting Food or
other items in your kitchen.
Use a low-abrasion cleanser, if necessary, for the scrubbing of the
tops. Heavy abrasives in some cleansers will damage the surface.
WARRANTY
Counter tops are warranted against defecu in materials and work-
manship for one year after you receive possession of your home.

RESILIENT FLOORS

Your new home may have resilient floots installed in the kitchen,
utility room and bathrooms. We would like to make you aware of
some of the inconveniences that may occur with these floors. The
following are three problems which occasionally are experienced.
• Seam lifting or peaking:
• This is caused after installation by water seeping into
mastic through a seam. It usually occurs in the bathroom
near the tub. As part of routine home maintenance, you
should caulk tub and floor joints with a compound made for
this purpose. Precautionary measures should be taken to
avoid spilling water on the floor from baths and showers. If
the seam has lifted, it may go back on its own after drying.
• Resilient floors can be permanently damaged by sharp
objecu. Using casters will help protect your floors against
damage which may be caused by sharp or small furniture
legs.
WARRANTY
All resilient floor coverings are warranted to be free of defects in
materials and workmanship for one year after you receive possession
of your home.
LIMITATIONS
This warranty does NOT cover:

HELPFUL HINTS
The primary living areas of your home are carpeted with profes-
sionally installed carpeting. Installation is with "tack strips" which
permiu removal for service (by a professional only).
Carpeting comes in standard widths. Seaming of the carpeting is
unavoidable in installation. Every effort is made to limit the number
of seams and to locate them as unobtrusively as possible. Neverthe-
less, seams can be noticed, especially when one is looking for them.
Seams tend to show more readily in flat, even-pile carpeting than in
shag carpeting.
In certain instances the installation of your carpet may appear to be
loose, for reasons other than faulty workmanship in insiallation.
Often this condition is due to differences in humidity.
The first three or four months your new carpet is down, excess yam
will appear on the carpet surface and will be even more apparent in
your vacuum cleaner bags. This is normal. Do not be concemed.
Usually within six months this situation will dissipate to the point
that it will no longer be objectionable.
Following these useful maintenance tips will help your carpet
remain beautiful for az long as possible.
1. Have your carpet professionally cleaned periodically.
The frequency of cleaning depends on the type of yarn and
the color of carpeting (light colors show soil sooner than
darker tones), the size of your family and the amount of dirt
tracked in. Steam cleaning is hard on carpet and often
resulu in the "heat set twist" coming out, thereby resulting

shampooing is less harsh.

Ceramic tile is affected by wood shrinkage. Hairline cracks may
develop in grouting between tiles due to normal settling. A separation
between the tub and wall tile or between floor tile and tub may occur
for similar reasons. Both can be repaired by simply filling the crack
with grouting which you may purchase at any hardware store.
Caulking should be applied at 90 degree tile joinu and between
different surfaces as hairline cracks occur due to shrinkage.

Asphalt is less susceptible to cracking then is concrete and will last
a considerable time with proper care and maintenance. Some expan-
sion cracks are unavoidable and sharp objecu such as bicycle kick
stands, ladders or tire jacks, will cause indentations, especially in hot
weather. Gas and oil spilled on asphalt will cause the material to
soften and disintegrate. Driveways are designed for norrnal auto
traffic and will not support heavy trucks such as moving vans.
WARRANTY
The asphalt driveway and sub-base is warranted to be in good
condition at the time of closing. (Should settlement due to an
improper sub-base or excessive cracking occur during the first year
afrer closing, the driveway will be repaired).
LIMITATIONS
This wartanry does NOT cover repair of:
• normal expansion cracks;
• damage arising from heavy vehicles such as moving vans
or from improper care such as sharp objecu or spitlage of
gas or oil.
CONCRETE WALKS, PATI05, STEPS
It is impossible to prevent cracking in concrete due to the nature of
the material and for the fotlowing reasons: Cracking may be caused
by the freezelthaw cycle, normal settling of the ground on new
building sites. Excessive rain may also cause additional settling.
Changing temperature may cause porch and patio posts to become
loose and patios and wa(ks to lift, even though we have installed
proper piers and rods for support. Correction can be made b_?
by shimming and renailing trim along the bottom. Depending on the
application, different tolerances of cracking or settling are accept-
able. The fol(owing is a guide:

Cracks greater than 1/4" are unacceQtable. Surface patching
is acceptable for non-structural cracks.
Concrete Floors
Cracks exceeding 1/4" in width or I/4"in vertical

Cracks exceeding 1/4" in width or 114" in vertical
displacement are considered excessive. Surface patching is

Stoops, Steps, Attached Patios

Concrete flatwork is warranted to be free of defects in materials and
workmanship for one year after closing.
LIMITATIONS
• This warranty does not cover cracking, damage or shi8ing
of concrete arising from changes in temperature, settlement
or chemicals. Mortar cracks can develop in the mortar used
in bonding bricks together. This is a normat condition due
to shrinkage in either the mortar or the brick.
Differential settlement in excess of 1" within the first 120
? lZ days of closing.will be repaired if not caused by unusual
? weatherconditions.
SERVICE LINES (WATER AND SEWER)
HELPFUL HINTS
Most problems with water and sewer lines can be avoided by not
stuffing large objecu into the drain lines. Care should be taken to
avoid disposal of sanitary napkins, disposable diapers and other such
materials into plumbing fixtures in order to minimize the possibility
of clogging. It is best to try a household plunger before calling the
Service Department. A good rule to remember with the use of your

keep the sink drain open.

Ventitation can be achieved even in rainy weather by staggering the
glass vents.
Clean aluminum surfaces with warm water monthly. Don't use
powder cleaner. After each cleaning of the metal, apply a clear coat
of paste wax. For broken glass, remove inner frame and take it to the
hardware store for a replacement.

CONDENSATION
Condensation is the water vapor that suddenly appears in cold
weather on the glass of windows and gliding doors. It is the result
of excess humidity in your home. This is the indicator that humidity
could be damaging your home and creating costly problems such as
peeling paint, rotting wood. buckling floors, insulation deterioration,
mildew, even moisture spocs on ceilings and walls.
Some suggestions to reduce excessive humidity would be to provide
more controlled ways for moist air to get out. Run kitchen or other
ventilating fans longer and more ofren than you normally do. New1y
constructed homes produce a lot of moisture. Wood, plaster and
cement contain a great deal of moisture, therefore, it takes time for
your new home to dry out. During this drying out process it is
recommended to either turn down or tum off your humidifier.

WINDOW CONDENSATION
When condensation first appears on windows, the natural reaction
is that the windows have failed. But thaYs not where the problem is.
When excessive amounts of humidity are present in your home, the
glass simply provides a visible surface on which the humidity
condenses. Indoor humidity levels can be reduced by doing two
things.
• I. Control the sources of humidity. Vent all gas burners and
clothes dryers to the outdoors. Use kitchen and bathroom
exhaust fans longer and more often than normal.
• 2. Your attic has been ventilated because ouuide air usually
contains less water vapor it will " dilute" humidity of inside
air.

CAiTTION_ Ifthe instructions are followed carefully your window
should come out very easy and could fall if not held on to.
Your screens may be removed by sliding the bottom sash up to the
center and sliding the top sash down to the center. lt is NOT
n acarv to release the balance clipc or to remove the sach for screen
removal_
SASH REMOVAL
1. Lift both balance clips with finger or
any flat tool.
2. Unlock and raise bottom sash until it
stops at the balance clips.
3. Lower bottom sash slightly and raise it
again with a gentle push against clips.
(You wiU feel the window disengage).
4. Raise the sash to top of frame, grasp top
and bottom and push to the left to
disengage it from the frame at right.
5. Pull the right edge towards you and
remove.
6. Lower top sash to expose balance clips,
unlock and repeat steps for bottom sash.
7. After replacing sash, press in both
balance clips to their original position.

Sliding glass doors lock from the inside only. The bottom tracks
must be kept clean so they will operate freely. Paraffin is a good
lubricant for these tracks. Under certain lighting conditions door
g{ass may be hard to see. If yoU keep the screen fully closed when
glass doors are opened, everyone will become accustomed to open-
ing something before going through.

maintenance. Oil the lock mechanism, pulley and rollers at least
twice per year with a light oil. When locking the door, step down on
the lock plate to line up the locking mechanism.

All garage doors are wananted to be free of defects in materials and
workmanship for one year. The finish on raised redwood garage
doors is to be maintained by the buyer after 90 days.

Subdivision I. As used in sections 327A.0I to 327A.07, the terms in this section shall have the meanings
assigned to them.

building industry for the geographic area in which the dwelling is situated.
Subd. 3. "Dwelling" means a new build in g, not previously occupied, constructed for the purpose of habitation:
but does not include appurtenant recreational fncilities, detached garnges, driveways, walkways, patios, boundary
walls, retaining walls not necessary for the structural stability of the dwelling, landscaping, fences, non permanent
construction materials, off-site improvements, and all ather similar items.

Subd. S. "Major construction defect" means actual damage to the load-bearing portion of the dwetling or the
home improvement, including damnge due to subsidence, expansion or lateral movement of the soil, which affects

home improetment for rosidential purposes. "Major construction defect" daes noI include damage due to
