SUBJECT: BATTERY CASINGS IN I.S.T.S.
Jon, attached you will find a letter from Barry Schade, Dakota County Director of Environmental
Management. Barry has had a number of contacts with Gail McMahon regarding excavation of
battery casings on her properiy at 1429 Lone Oak Road.
As you can see by Barry's letter, the County has identified ten sites in Eagan that used battery
casings in the construction of individual sewage treatment systems (I.S.T.S.). It appeazs that four
of ten sites are still pending, or casings remain on-site. Based on this information, I believe we
should place a waming flag on lots containing battery casings that haven't been mitigated, as well
as place a copy of Barry's letter in the relevant pazcel files. A waming flag on the PIMS system
would.allow us to inform individuals requesting permits of this issue.
Barry has indicated that sites containing battery casings usually don't need to be mitigated until
they aze disturbed. Once they aze discovered, it is Dakota County's policy to require the property
owner to record this information with the property data base at Dakota Counry.
If you need additional information or if you feel our plan of action needs to be modified, please
advise.

Dear Ms. McMahon:
Enclosed are the analytical reports for the samples of water, house dust, and
soiis coilected from your residence on January 9, 2004. The results indicate that
the interior dusts and the well water supply are free of lead contamination. The
soils coliected from the soii/battery casing stockpile in your backyard contained
significant Ieveis of lead.
This suggests that lead from the soil/battery casing stockpile has not been
transpoRed into your house and has not impacted the well water supply.
However, the lead in the soil/battery casing stockpile represents risk to human
health and measures should be taken to reduce the potential for exposure to this
lead source. While the plastic cover piaced over the stodcpile has served to
reduce the potential for direct contact with the lead, bare soils contaminated with
lead are accessibie to direct contact or through wind dispersal. We recommend
placing additional plastic sheeting on the stockpile to further reduce the exposure
to the lead contaminated waste and soils. We also recommend that you limit the
use of the backdoor and install additional fencing around the stockpile to prevent
inadvertent contact with the stockpile.
Also enclosed is the list you requested of other situations the County has
encountered where battery casings have been used in the construction of ISTS's
(individual sewage treatrnent systems).

Pursuant to the Stipulation of the parties for the entry of dudg-
'ment in the above entitled case, and pursuant to the anplicable provisions
_ of Minnesota Statutes, Sections 429.061, 429.071, 429.081 and 435.19,
IT IS HEREBY ORDEP.ED AND ADdUDGED that:
7. The County of Dakota shall pay the City of Eagan $19,268.45
as limited 6enefit due to Eagan Improvement Project No. 137 on Parcel No.
10 03300 070 51 on the following computation:
a. The parcel consists of 87.27 acres. - "
b. 29.23 acres shall be eliminated from the assessment parcel
for ponding potential.
c. Twenty percent (20',:) of the remaining acreage shall be .
eliminated from the assessment as the nornial acreage that is consumed for .
street development, which shall then leave 46.43 acres in Parcel Plo. _

Dakota, and the City o{ Eagan shall not levy any special assessments-against
this property unless and until it has obtained the written permission of the
County of Dakota. -
5. This settlement and Judgment shall not be preceAent for nor
binding upon the City of Eagan nor the County of Dakota with respect to any
other special assessment proceedings against property in the County of.

WHEREAS, the County of Dakota on April 28, 1975 appealed from the
proposed special assessments in the amount of b55,414.95 for Eagan Improve-
ment Project No. 137, datcd April 15, 1975, against County park property
located in the City of Eagan and designated as Tax Parcel No. 10 03300 010 51
and No. 10 03300 010 77; and,
IJHEREAS, the City of Eagan has agreed to reduce the assessment
against Tax Parcel No. 10 03300 010 51 from 528,975.30 to $19,268.45 as the
actual limited benefit to this parcel 6y virtue of Eagan Improvement Project
No. 137; and,
blHEREAS, the City of F.agan has agreed to omit Parcel No. 10 03300 010 77
from this proposed special assessment now and until the County develops this
parcel to such an extent that the use of sanitary sewer is required on this
parcel; and,
blHEREAS, the County of Dakota ayrees to pay the Cit,y of Eagan for
whatever benefit the County actually receives on Parcel Plo. 10 03300 010 77
as a result of Eagan lmprovement Project No. 137 if and when the County
develops this parcel to such an extent that an actual need for the use of
sanitary sewer facilities then exists with respect to this parcel. If and
when such development occurs, the County of Dakota agrees to then pay the City
of Eagar. ,20,957,50, t.onptner with interest at the prevailing rate, not to
exceed eight percent (£3%) per annum, from April 15, 1975 to the date this
deferred assessment is paid by the County of Dakota; and,
WHEREAS, the City of Eagan does also agree that no sewer pipe for

of the County of Dakota.
5. The City of Eagan shall not install sanitary sevrer or water
lines on property belonging to the County of Dakota located in the City of

Jensen Park unless such action is specifically requested by the County of
Dakota, and the City of Eagan shall not levy any special assessments against i/

WHEREAS, the City of Eagan has agreed that it will not install
any sanitary sewer or water lines in County park property known and desig-
nated as liolland-Jensen County Park, whith is located in the City of Eagan
and East of Pilot Knob Road, unless such action is specifically requested
by the County of Dakota; and
WHEREAS, the City of Eagan and the County of Dakota expressly
understand that this Offer, Acceptance and Stipulation for Judgment is
expressly made by the parties with the express understanding that neither
party is waiving any other claim, right or defense that it may have.
NOI-J, THEREFORE, it is stipulated and agreed that:
1. The District Lourt shall enter its Order for Judginent in this
proceeding without further hearing, without further notice to either party
and witfiout any other Order of the Court, each party to pay its ovm costs
and dis6ursements and no costs or disbursements shall be taxed.
2. The County of Dakota shall pay the City of Eagan $19,268.45
as limited benefit due to Eagan Improvement Project tlo. 137 on Parcel No.
