Dear Mark:
I have received your December 23 letter wherein you expressed concerns
regarding the proposed assessment for storm sewer laterals being installed
within Cliff Road as a part of the above-referenced pro3eet.
On January 5, 1988, a publie hearing will be held to discuss the proposed
i_mprovements and the related estimated assessments. Enelosed with this letter
is a copy of Figure No. 6 which estimates the approximate drainage boundary of
the property draining directly into this new storm sewer system. As you can
see$ it incorporates approximately 837 sq• ft. of the southwest corner of the
above-referenced lot. Feasibility reports are preliminary engineering reports
prepared on proposed improvements estimated prior to final detail design
information becomes available. As sueh, it was "estimated" that approximately
837 sq. ft. of this property would drain into the Cliff Road storm sewer
system.
Based on a personal field inspeetion on this date, it has been verified that
no drainage from this lot will enter into the new storm sewer system being
constructed under this project. Therefore, this parcel will be eliminated
from the pending and final assessment rolls as no other assessments are
anticipated or proposed with th3s project.
I apologize for any concern that this proposal has ereated but hope that you
can appreciate the fact that we are not able to do an onsite inspection of
every property as a part of the £easibility report preparation process. I
appreciate your bringing this specific concern to my attention so that we
could address it in a timely manner to your satisFaetion.

Last month, you received a letter from Mr. Petran (4585 Lake Park
Drive - Lot 2) expressing concerns regarding the modification in
the wetland/drainage area within Lot 1 resulting from the
construction of a single-family residence. Attached to this memo
please find a report prepared by the Engineering Division providing
background information and the following information:
1. The 1978 Development Plan for Lake Park Shores showing
the existing low point, proposed building pad location
and proposed grading/drainage plan.
2. An existing topographic drainage plan from an April 15,
1990, aerial photo showing how the filling of Lot 1 for
the building construction relocated the low point
westerly but yet still maintaining the same general
directional drainage pattern.
3. The building permit Certificate of Survey for Lot 1
showing an acceptable drainage plan from the relocated
low point.
4. The grading/drainage plan submitted for Lot 2 with the
building permit with very limited information indicating
how ultimate drainage would be preserved or handled.
5. The Certificate of Survey showing the drainage plan for
building permit of Lot 3 which generally conforms to the
original development grading/drainage plan.
If there is any negative impact as a result of the relocation of
this low point, it is contained within Lot 1 in its entirety.
Please let me know if any additional information or, action is
desirable in further addressing this issue.

LETTER FROM JOHN PETRAN DATED FEBRUARY 17, 1992
Since Lot 1, Block 1, Lake Park Shores was the last lot to be
developed in the area, it became a low spot and retained a portion
of runoff from a drainage area of approximately 1 acre. The
overflow from this low point followed the south property line of
Lot 2, Block 1 until the grades would allow the water to flow
across the west side of Lot 2 and into the street. (See graphic)
In order to build on Lot 1, the contractor brought in a substantial
amount of fill to allow fall from all sides of the new home and to
provide more usable yard for the buyers.
Due to concerns raised by neighbors, John Petran and Dennis Kecker,
regarding the fill and their impression that Lot 1 was unbuildable,
Bill Bruestle and I met onsite on February 12, 1992. It is our
opinion that although the low point was shifted to the west of the
original low point, the drainage would follow the same path as in
preconstruction conditions once the final grading was completed.
The main concern we had with the new construction was with
potential erosion from the new home until permanent vegetation is
established and, therefore, recommended that a silt fence be
installed by the contractor as soon as possible.
As a result of the additional fill it is possible that a number of
trees within Lot 1, Block 1, may eventually die out. However, the
loss of trees should be within Lot 1, Block 1. It is not
anticipated that Lot 2, Block 1, would incur damage to trees or
lawn due to storm runoff if no damage has been done to date.

Dear Mr. Hedges:
This letter is to air my concern about the house being ui
lot adjoining mine on the south, particularly the drainage problems
foreseen.
On Feruary 12, Craig Knutson (a city engineer) and Bill Brustle
(a city excavation inspector) met with myselft neighbor Dennis Kecker
to visit the site. Dennis and 2 both expresse8 our large reservations
concerning the lot's low area which normally pooled water--in the east
central ma'rshy area. That is, it doesn't exist any more--a large
number of dumptruck loads of fill (25? 50? 75?) have been dumped to
the soutlh and southeast of the foundation as well as all the way
around it to the depth of perhaps 6 feet, beside the foundation.
My concern is that the run off will now pool in the west half of the
property. Moreover, that this may well result in a serious pooling
of water on a routine and frequent basis, not including rain storms
which might only briefly affect us. I have a significant number of
choice trees and good lawn. Nor do I want standing water on my prop-
erty at all!
Mr. Knutson and Mr. Brustle were cordial and promised to encourage teh
builder to construct a temporary silt fence on the property line,
parallel to the new foundation, but so what!? Pooling water...!?
