us working with the builder in a less than ethical manner. Let me assure you that the City's Inspections
Division does not represent or perform services on behalf of any builder or homeowner. Our function is to
verify minimum code compliance.

that have arisen; however, we cannot require a builder to perform services beyond the minimum code

Dear Mr. Miller,
This letter is written in follow up to the conversations we had last week regarding
the property at 785 Golden Meadow Road, Lot 4, Block 1, Sunset 13`h Addition.
As you know, last December the City Councii denied your request for a Variance
to allow the existing detached gazage to be relocated in the front yard of the
existing house (the front yard being that area between the house and the public
right-of-way). The garage has since been relocated to that area and remains
detached from the house, which is a violation of the City's zonin-, code.
Your proposed resolution to this situation has been to attach the garage to the
house, however, we have had difficulty reaching agreement as to what constitutes
"attached." For this reason, we requested that you submit your proposal to the
City in writing, with appropriate plan drawings, so that we may present the
question to the City Council for clarification. You delivered your proposal on
October 16, 2002, and this question will be scheduled for City Council review at
their next meeting on November 7, 2002.
In the meantime, the garage continues to be in violation of the zoning code as
long as it is located in the front yard and remains detached from the house. For
this reason, building permits on the other three lots within the Sunset 13th
Addition subdivision will be withheid until this violation is corrected.
Also, the garage move and the footing and foundation work done prior to moving
the garage to its new location, were both done without benefit of the required
building permits. A building permit for the foo[ing and foundation was obtained
after the garage had been moved, however, it has not been inspected to verify
compliance with building codes. Please contact the City Inspections department
at 651-681-4675 to schedule that inspection.

In addition, it has also come to our attention that the basement within the house
was finished for living space sometime during your period of ownership, also
without benefit of the required building permits. As you know, working without a
permit is a violation ofthe Uniform Building Code Section 107.5.1. A permit
must be secured for the work that has been provided, and an on-site inspection
will be required to verify compiiance with applicable codes. This inspection may
include removal of finish materials.

As you Imow, the attachment of the garage to the house remains unresolved. Originally, this item
was to be placed on the November 7, 2002 City Council agenda. However, afrer reviewing this
issue with the City Attomey, it was determined that this item will be pulled from the agenda since
Municipal Center. the item in contention is regulated through a building permit. According to the Uniform Building
Code, the Building Official has the authority to render interpretations of the Code. Although we

Dear Mr. Miller,
This letter is written in follow up to the conversations we had last week regazding
the property at 785 Golden Meadow Road, Lot 4, Block 1, Sunset 13`h Addition.
As you know, last December the City Council denied your request for a Variance
to altow the existing detached garage to be relocated in the front yard of the
existing house (the front yard being that area between the house and the public
right-of-way). The garage has since been relocated to that area and remains
detached from the house, which is a violation of the City's zoning code.
Your proposed rzsolution to this situation has been to attach the garage to the
house, however, we have had difficulty reaching agreement as to what constitutes
"attached." For this reason, we requested that you submit your proposal to the
City in writin„ with appropriate plan drawings, so that we may present [he
question to the City Council for clarification. You delivered your proposal on
October 16, 2002, and this question wiil be scheduled for City Council review at
their next meetin; on November 7, 2002.
In the mean[ime, the garage continues to be in violation of the zoning code as
long as it is located in the front yard and remains detached from the house. For
this reason, building permits on the other three lots within the Sunset 13th
Addition subdivision will be withheld un[il this violation is corrected.
Also, the garage move and the footing and foundation work done prior to moving
the garage to its new location, were both done without benefit of the required
building permits. A building permit for the footing and foundation was obtained
after the garage hnd been moved, however, it has not been inspected to verify
compliance widl building codes. Please contac[ Ihe City Inspections department
at 65 1-681-4675 to schedule that inspection.
In addition, it has also come to our attention that the basement within the house
was finished for living space sometime during your period of ownership, also
without benefit of the required building permits. As you know, working without a
permit is a viola[ion of the Uniform Building Code Section 107.5.1. A permit
must be secured for the work that has been provided, and an on-site inspection
will be required to verify compliance with applicable codes. This inspection may
include removal of finish materials.
