Dear Mr. Lundsted:
Your letter to Ann Goers, Special Assessment Clerk, was forwarded to my
attention for review and response.
In 1976, the Council held a final assessment hearing for the benefits received
from Trunk Area Water availability to various properties throughout the
entire City. At that hearing, several property owners requested consideration
to have this assessment deferred until actual time of connection. Subsequently,
the Council approved several of those requests with the condition that the
assessment would be at the rates in effect at the time of actual connection
and would be collected through the sewer and water connection permit process.
This would help to explain similarity between the terms "assessment" and
"connection charge".
During the issuance of this sewer and water connection permit, the application
inadvertently bypassed the Special Assessment Division for review and was
subsequently issued. That is how the property was allowed to connect without
having to pay this outstanding financial obligation. However, the property
has not yet fulfilled it's special assessment for Trunk Area benefit received
from the Water Distribution System. Therefore, the Special Assessment clerk
is trying to pursue the matter to insure that this property fulfills it's
financial obligations. The $300 figure is based on the per lot rate that
was in effect in 1979 at which time the actual connection occurred.
If the City is unsuccessful in collecting this outstanding obligation, it's
only recourse is to preceed with a new formal final assessment hearing.
The assessment rate through this formal process would be $535 which is the
rate currently in effect during 1984.

Water Connection Charge
Dear Ann,
May 25,1984
We have just been informed by our insureds, the Gearys, that
they received a notice from you that there is a water connection
charge due on the above property in the amount of $300.00. This
assessment or charge did not appear in the County Auditor's
records nor did it appear on your search, a copy of which is
attached hereto. When our office inquired of yours about this
charge, we were informed that it had been waived for the original
owner. Consequently, I cannot understand how it can now be due.
The very term "waived" means that you gave up the right to
make a claim for this charge. If the city merely meant to defer
the charge, notice should have been given to subsequent purchasers
that the charge would become due. As you can see from your search,
this notice was not given. The house, to the best of my knowledge,
is now and has been hooked up to city water. Therefore, I cannot
see any way that the new purchaser could have had any knowledge of
or any reason to make further inquiry for unpaid assessments.
We will make an attempt to collect this charge from the
previous owner, however, the odds of this being successful are
rather slim. In the event that we are unsuccessful, we believe
that it should be the duty of the city to permanently waive this
charge. In the mean time, however, we ask that you at least defer
the charge while we make an attempt to collect it. Please inform
me as to how you will handle this matter.
