CITY OF EAGAN, a Minnesota municipal corporation, organized under the laws of the State of
Minnesota (hereinafter referred to as "City").
WITNESSETH:
That the Landowner, in consideration of the sum of One Dollar ($1.00) and other good and
valuable consideration, the receipt and sufficiency of which is hereby aclaiowledged, does hereby grant
and convey urno the Ciry, its successors and assigns, forever, a 10.00 foot wide easement for sidewalk
and trailway purposes over, under and across the following described property, to wit:
All that part of Lots 9 and 10. Block 1, PERRON ACRES, according to the recorded
- plat thereof, Dakota County, Minnesota, the centerline of said easement is described as
follows:
Begirnvng at the intersection ofthe northeasterly line ofLot 9, Block 1,
said PERRON ACRES and the southeasterly right ofway line ofDodd
Road as delineated and dedicated on said PERROiv fsCRES; thence
on an assumed bearing of South 56 degrees 56 minutes 21 seconds
East, along said northeasterly line, a distance of 46.67 feet, to the
westerly right of way line of Leonard Lane as delineated and dedicated
on said PERRON ACRES and there terminating.
The sidelines of said easement shall be prolonged or shortened to terminate on said
southeasterly right of way line of Dodd Road and said westerly right of way line of
Leonard Lane.

A temporary easement for slope purposes lying over, under and across the
northwesterly 20.00 feet of Lots 8, 9, 10 and 12, Block 1, PERRON ACRES,
according to the recorded plat thereof, Dakota County, IvLnnesota, adjoining the
southeasterly right of way line of Dodd Road as delineated and dedicated on said
PERRON ACRES.
Said temporary easement shall expire upon the completion of the proposed Dodd Road
improvements, and said easement shall remain in effect until released by the City.

The grant of the foregoing permanent easement for sidewalk and trailway purposes includes
the right of the Ciry, its contractors, agents and servants to construct, reconstruct, inspect, repair and
maintain a sidewalk and/or trail and erect and maintain signs in conjunction with the public's use of said
sidewalk and/or trail and any signs erected in conjunction with the use of the sidewalk and/or trail.
The gant of the foregoing temporary easement shall be restricted to slope purposes, but
includes the right of the City, its contractors, agents and servants to enter upon the Easement Premises
at all reasonable times to construct, reconstruct, inspec[ and repair slopes and the further right to
remove trees, brusk undergrowth and other obstructions within the Easement Area. After completion
of such construction, maintenance, repair or removal, the City at its sole cost shall restore the
Easement Premises to the condition in which it is found prior to the commencement of such actions,
save only for the necessary removal of trees, brush, undergrowth and other natural obstructions.
And the Landowner, for itself, and its successors and assigns, does covenant with the City, its
successors and assigns, that it is the fee owner of the lands and premises aforesaid and has good right
to grant and convey the easements herein to the City.
IN TESTIMONY WHEREOF, the Landowner has caused this easement to be executed as of
the day and year first above written.

Step 2: Calculate the volume of the Combustion Appliance Space (CAS) containing
combustion appliances.
