Manley Bros. Construction was subsequently contacted to clean up and maintain their erosion control measures. 2. Apri120, 2000 A final inspection was performed but did not pass at 646 Lexie Court. A correction notice was issued to Manley Bros. Construction. 3. Jul , 2000 _ Rainstorm collapses retaining wall at this address. 4. October 3 2000 Building Inspection staff learned that this house was being occupied without the issuance of a Certificate of Occupancy or a successful final inspection. We also discovered that the retaining wall was not being repaired. A certified letter was sent to Mr. Kurt Manley requesting that these items be addressed. This letter was not accepted by Mr. Manley and was returned to City Hall. 5. October 26, 2000 Mr. Bill Bruestle, Senior Inspector, went to this address to hand deliver the above referenced letter. Mr. Bruestle explained to Mr. Manley what the letter pertained to and Mr. Manley pxoceeded to tear up the letter in front of Mr. Bruestie. 6. November 8, 2000 City Attorney Sharon K. Hills sends a letter to Mr. Manley regarding City Code violations, including occupying the house without a Certificate of Occupancy. 7. November 13. 2000 Mr. Manley contacts me and requests a written description of the items to be resolved. 8. November 15, 2000 Correspondence is sent to Mr. Manley regarding the above request. 9. November 24, 2000 Mr. Maniey proposes via letter that the retaining wall not be reconstructed until a settlement is reached between him and his original retaining wall contractor. 10. December 1, 2000 A letter is sent to Mr. Manley requesting that he proceed with the reconstruction of the retaining wall regazdless of his position with his retaining wall contractor. We also requested all the other items be corrected including Engineering Divisions items for Oak Bluff Development. 11. December 8, 2000 A meeting took place at City Hall. All the items to be resolved were discussed and a synopsis of the agreements made was sent to Mr. Manley and all attendees. Mr. Manley agrees to a) remove the damaged wall the week ofDecember 11; b) submit an Engineers Report to the City by December 14; c) repair the wall; d) change the egress window to comply with the Building Code; e) work on the punch list items supplied to him from Engineering Department. 12. 7anuarv 16, 2001 Mr. Manley and I met at City Hall to discuss the lack of progress on the items to be resolved. He stated that he needed more time. A request was made to Mr. Manley to propose a revision to the last time line previously agreed to. 13. January 29, 2001 Correspondence is sent to Mr. Manley to inform him that we were proceeding with any means necessary to gain compliance since no progress was observed and we have not „ received nor approved an alternate time line to our original agreement of December 8, 2000. 14. Januarv 30, 2001 Mr. Nlanley contacted me via telephone and stated that our code enforcement was not being applied uniformly to all contractors. Mr. Manley also stated that the city was partially responsible for the collapse of the retaining wall since we required it to be constructed. I indicated that we would be willing to review a revised plan of action to resolve these issues and requested that he propose them in writing. This morning I visited the site and found that the coritractor had finished construction of three retaining walls in your backyard area. I also Spoke with t,he contractor ta get an idea of what was placed below grade. The lowest wall measured 3' high above the lawer grade and was positioned s,pproximately 6' east of the second wall. The r.onLractor said that there were approximate four to Yive coursea of bloek buried in thia particular wall and two layers of geogrid measuring about 8' extenaion back fxom the wnlJ.. The second wa11 me&sured a maximum 3'-9" high and also had two layers of geogrid extending back about 8'. The third wsil had a height of 3' and two laYers of geogrid extendinfi back 8'. There was at least 10' of level aTea betFreen this last wall and the existing well jugt east of the hovse. It should be noted that the retaining walls were smaller and did not extend as Par north and south as we had thought would be huilt. Instead> the contractor placed the remaining embankment in a 2:1 siope extending dawn the hill toward the property lines. It is our understanding from you that the flat areas will receive topsoil and w911 be sodded by this coming Tuesday.
