The a6ove-referenced projects are of atypical foundation design due to the topography of the lot and placement of
the home. Based on this, we aze requ'uing that a strucdual engineer design/review and certify the construction oFthe
foundation and retaining walls for both sites. Occupancy will not be allowed on either home until the retaining
walls are complete.
Attached is a copy of the Certificate of Survey for 647 Lexie Court approved by [he City. As you can see, we
requested a retaining wall design prior to framing. A site visit on December 13, 1999 showed ihat the house walls
are being framed, but we have not received a design from you.
As per my letter of November 29, We hold on construction remains in place for 646 Lexie Court.
A hold on construction at 647 Lexie Court will take effect on December 22 and remain in effect until a retaining
wall design is approved and work is commencing on the wall.
The silt fence must also be installed and functional as indicated on the approved site plans For both projects prior to
work commencing on the homes.

As you are aware, there is an erosion problem between 646 and 647 Lexie Court due to the sharp
drop in elevations. This erosion is causing problems with homes on Autumn Oaks Court, just
east of this azea. To prevent further soil erosion onto the properties in the Country Hollow
subdivision, the City is requesting the immediate replacement of the retaining wall
destroyed by the July rainstorm.
On April 20, 2000 our deparlment made a final inspection of the home at 646 Lexie Court. This
home did not meet the requirements to obtain a Certificate of Occupancy at that time. We feel
you have had ample time to make these corrections and aze asking that you call and schedule a
final inspection of this home.
Please call me at 651-681-4676 within 15 days of the date of this letter to discuss your plans to
correct these problems. Your anticipated cooperation is sincerely appreciated and I am looking
forwazd to working with you to bring closure to these issues.

The abovo-referenced projects are of atypical foundation design due to the mpography of the lot and placement of
the home. Based on this, we are roquiring that a structural engineer desigdreview and ceetify the conshuction of the
foundation and ntaining walis for both sites. Occupancy will not be allowed on either home until the retaining
walls aze complete.
Attached is a copy of the Certificate of Survey for 647 Lexie Court approved by the City. As you caa see, we
requested a retaining wall design prior to framing. A site visit on December 13, 1999 showed that the house walls
aze being framed, but we have not received a design from you.
As per my letter of November 29, the hold on construction remaias in place for 646 Lexie Court.
A hold on conswction az 647 Lexie Court will take effect on December 22 and remain in effect until a retaining
wall design is approved and work is commencing on the wall.
The silt fence must also be installed and functional as indicated on the approved site plans for both projects prior to
work commencing on the homes.

Dear Mr. Asleson:
On Thursday March 23, 2000 I was asked to perform a geotechnical review the construction of a
retaining wall at the referenced site in Eagan, MN. The wall had been installed without engineering
inspection.
The wall is approximately 12 feet high with 2 feet of embedment. Fifteen courses are exposed,
representing approximately ten feet. The wall was constructed around the exposed comer of the
garage from the southeast facing garage wall to the northeast facing garage wall, approximately as
shown on the Certificate of Survey document bearing the "REVIEWED" stamp by the City of Eagan
(signed and dated 11-23-99), except that the wail extends further northwest to the approximate north
range line of the house. The wall lies generally 20 to 22 feet from the garage wall.
To examine soil conditions at the base of the wall, three inspection pits were dug on March 27, 2000,
with the assistance of the retaining wall contractor. The pits indicated that a class 5 type (recycled)
gravel aggregate was used as a foundation leveling course below the wall. The aggregate was found
to be 12 inches to as much as 18 inches deep and appeared to be compact. A hand auger probe was
advanced to a depth of five feet below the embedment line grade at the three pits. Generally
competent, clay loam and sandy loam soils were found. No organic soils were found and no fat or
high plasticity clays were observed. The base of the wall was at or very near native soil grade
however no discemable soil horizon was found which would indicate the specific fill/natural soil
boundary.
A dynamic cone penetrometer was advanced into the soil ahead of the auger holes. This tool which
utilizes an eight kilogram drop hammer to advance a one inch diameter cone point, indicated
penetrations varying from 5 to 10 and to 15 blows per six inches. The tool was penetrated to 4.5, 6
and 6 feet 6elow the three test pits and revealed only minor areas of weaker soil zones.
The base of the wall appeared to have proper 1:1 lateral over sizing of either native or well
compacted filled soil.
To examine soil conditions behind the wall, two hand auger probe holes were advanced to depths of
five feet. Clay loam and sandy loam fill was brought up by the auger. The fill soil was found to be a
suitable soil materiai for compaction, with soil moisture at or near optimum but with higher moisture
conditions near the surtace from recent rainy weather. No organic materials were found and no soils
were found which have unacceptable plasticity.
The dynamic penetrometer tool was also advanced into the soil behind the wall. The tool was driven
into the soil just ahead of the advancing auger hole. The penetrometer revealed even compaction in
the filled soil to a siz foot depth which was the limit of the hand tools employed. Penetrations varied
from 5 to 10 blows per six inches in the filled soil behind (above) the wall.
It was observed that horizontal reinforcing grid material was laid at three block vertical intervals. It
was also noted that the wall had generally level course grades and an even backset batter up the wall
face.
Based upon this after-the-fact geotechnical investigation, Instant Testing Company is of the opinion
that the retaining wall at 647 Lexie Court was very probably constructed according to the geotechnical
requirements within the job specifications. Based upon our experience with auger probing and with
the penetrometer tool we believe that in generai, the disturbed and filled soils were likely compacted
to 95% of standard Proctor requirements.
None-the-less, this wall wili be subject to vertical and lateral movements such as any fully-inspected
wall, as the soil materials below and behind the wall settle into place and reach their full stability.
It is not the intent of Instant Testing Company by this investigation, analysis and report, to assume
any part of the responsibility of Manley Brothers Construction, or your subcontractors to warrant the
successful pertormance of this retaining wall or the stability of the retained soil.
