between RONALD RUEGG and DEBRA RUEGG, husband and wife, herein
referred to as "LANDOWNER" and the CITY OF EAGAN, a municipal
corporation, organized under the laws of the State of Minnesota,
hereinafter referred to as the "CITY".
WITNESSETH:
That the LANDOWNER, in consideration of the sum of One ?ollar ($1.00)
and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant and
convey unto the CITY, its successors and assigns, permanent easement
for utility purposes, over, across and under the following descri6ed
premises, situated within Dakota County, Minnesota, to-wit:
The south 10.00 feet of the east 270.00 feet, as measured along
the south line of Lot 1, Block 5, SOUTH OAKS, according to the
recorded plat thereof.

The grant of the foregoing permanent easement for utility purposes
includes the right of the CITY, its contractors, agents and servants
to enter upon the premises at all reasonable times to construct,
reconstruct, inspect, repair and maintain pipes, conduits, mains or
ponds and the further right to remove trees, brush, undergrowth and
other obstructions. After completion of such construction,
maintenance, repair or removal, the CITY shall restore the premises
to the condition in which it was found prior to the commencement of
such actions, save only for the necessary removal of trees, brush,
undergrowth and other obstructions.
And the LANDOWNER, its heirs and assigns, does covenant with the
CITY, its successors and assigns, that it is the LANDOWNER of the
premises aforesaid and has good right to grant and convey the
easement herein to the CITY.
IN TESTIMONY WHEREOF, the LANDOWNER has caused this easement to be
executed as of the day and year first above written.

Dear Mr. Cortinas:
Thank you very much for your letter regarding the Majestic Oaks Subdivision east of
your home. In approaching azeas like this, the City works hazd to balance the interests of
current and future residents and properiy owners, as well as minimize the impact on our
natural environment. One of the realities that we must deal with, though, is that property
owners do have the right to develop provided that they meet the City's requirements. In
looking back at the minutes of the meeting at which this project was approved, these were
exactly the concerns raised by the Council in response to the comments presented by you
and your neighbors. As long as a developer meets the requirements of his original
approval, the City does not have the authority to rescind its approval.
While I am certain this is not the answer you had hoped to get, it is essential for the City
to operate within its established requirements and approvals. I am also hopeful that the
conditions placed on the approval of this development will help to retain some of the
natural beauty ofthe site for residents of both your neighborhood and of Majestic Oaks.

I am concemed about a new housing development across the street from my house on the
coraer of Cliff and Highway 3. They are building 22 houses in the wooded area. I've
spent a lot of momings and nighis on top of the hill and have seen raccoons, birds, white
tailed deer, and badgers. Their are too many rypes of animats for them to destroy. I think
the community wilt loose a valuable part of witd life and a sanctuary for the people and
the environment.
I would like for you to look in Yo it and see what you can do. I know ihis worlds needs
progress, but we shouldn't destroy animals and habitat that dcesn't pose any threat to ow
environment
