I am the owner of a twin home development on Brooklyn Lane, Eagan, adjacent to the West End Fishing & Hunting Club ("Gun Club"). I have been living in this address since October 2006. Last weekend, without any notices from the Gun Club or the City of Eagan, the Gun Club started to take down tall trees and build a new driveway on their property leading to a new entrance on Brooklyn Lane, facing my driveway and front yard. Their new driveway is literally wider than Brooklyn Lane! My neighbors and myself are in disbelief and are seriously concerned. The Gun Club has been in the neighborhood for quite some years. They already have a private road in the junction of Biscayne Avenue and Gun Club Road. The traffic on that dirt road is noticeably busy especially during evenings. Many SUV, trucks and other vehicles seldom stop properly at that junction when they come out from Gun Club Road. Now that the entrance will be on a residential small road, homeowners are extremely upset. Why is the Gun Club intrusive enough to build a driveway in the residential neighborhood? Why is the City Planning Department of Eagan allowing the Gun Club to do this? Do the homeowners in the neighborhood have any protection from your office? My neighbors and I have called the City Planning Office this morning in this regard. Unfortunately, we were informed that the Gun Club was given permit to do their driveway. I understand that you and some of your neighbors have also discussed your concerns with City staff. I can certainly appreciate your frustration, both about the project itself and the fact that you were not formally noticed of such a project. The challenge in this instance is the Gun Club property abuts a public street and therefore, they do not require any land use or Municipal Center other City approvals to connect to Brooklyn Lane. Rather, the Gun Club simply needed a 3830 Pilot Knob Road permit to work in the right of way to make the physical connection, and the City had no Eagan, MN 55122-1810 authority to deny that permit. At the time the club purchased its present property from Mr. Earl Marotzke in 1960, it was conditioned upon our ability to use the property as a gun club. I appeared before the then Township Board, petitioned for and received a Special Use Permit to shoot upon the premises on Sundays, Mondays and Wednesdays. Shortly thereafter in 1960 or 1961, the club requested and received permission to add Thursdays to their Special Use Permit. Recently it was called to rny attention that the permit as it now stands does not include Thursdays. At the time the club was moved to its present location, approximately 90 per cent of the membership was from St. Paul. During the last 20 years, the club has grown and most of said membership growth has come from residents of the surrounding area including Eagan, Rosemount, Apple Valley, etc. At least 70 per cent of the club's present membership lives in the Eagan vicinity. The age of the membership has also lowered and the majority are now fathers with relatively young families. These members are interested in providing gun training for their children. Several of the members are qualified instructors under the DNR Gun Training Program. This is the primary reason we have for requiring the use of the club on Thursdays. Minnesota Statutes Section 87A.02, subdivision 2(2007), provides that the November 1999 revised edi6on of the National Rifle Association's Range Source Book: A Guide to Planning and Construction (hereinafter the Michael G. Dougherty, City Attorney May 21, 2008 Page 2 "NRA Standards") shall serve as the interim shooting range performance standards until the Commissioner adopts shooting range performance standards under subdivision 1(a). On May 19, 2008, Chuck Niska of the Minnesota Department of Natural Resources informed Michael Klemm that the Cominissioner has not yet adopted shooting range performance standards, so the NRA Standards are still in effect. Mimiesota Statutes Section 87A.02, subdivision 2, does not address whether the NRA Standards are "in compliance with" the noise standards set forth in Minnesota Statutes Section 87A.05. Regardless, the noise standards set forth in Minnesota 5tatutes Section 87A.05 stand on their own. Minnesota Statutes Section 87A.05 (2007) provides: Allowable noise levels for the operation of a shooting range are the levels detetmined by replacing the steady state noise L10 and L50 state standazds for each period of time within each noise azea's classificadon with a single Leq(h) standard for nnpulsive noise that is two dBA lower than that of the L10 level for steady state noise. The noise level shall be measured outside of the range pmperty at the location of the receiver's activity according to Minnesota Rules, parts 7030.0010 to 7030.0080, as in effect on May 28, 2005. For purposes of ttris sec6on, "Leq(h)" means the energy level that is equivalent to a steady state level that contains the same amount of sound energy as the time varying sound level for a 60-minute time period. "L10" means the sound level, expressed in decibels and "A-weighted" to adjust for the human response to sound, which is exceeded 10% of the time for a one hour survey, as measured by test procedures approved by the Commissioner. Minn. Rule 7030.0020, subp. 7(2007). "L50" means the sound level, expressed in decibels and A-weighted ("dB(A)"), which is exceeded 50% of the time for a one hour survey. Id. at subp. 8. The allowable noise level is based in part on the "noise area classification" for the land use activity at the location of the sound receiver. The noise area classification for land use containing household units is noise azea classificafion 1, and the corresponding daytime L10 and L50 sound levels are 65 and 60 respectively. Minn. Rule 7030.0040, subp. 2(2007). Pursuant to Minnesota Statutes Section 87A.05, for purposes of evaluating noise from a shooting range, the L10 and L50 standards aze replaced by a single Leq(h) standard that is is 2 decibels lower than the L10 standard, so the applicable standard in this case is I.eq(h) 63. AccousHcal Test The Acoustical Field Test Report from Architectural Testing asserts that testing was conducted on a residential lot at 650 Gun Club Road for three successive hours on April 20, 2008. The Report states that the Leq(h) sound level for each of the three hours were 65.7 dBA, 64.9 dBA and 693 dBA, above the maximum permitted sound level of Leq(h) 63. We have not researched whether or not the test procedures used by Arcliltectural Testing are approved by the Commissioner, or whether the test results are valid. For the purpose of tlvs memo, we will assume that the test was properly conducted and that the test results aze valid. 5.VeasoK m DW?dMOLtNDMp? Michael G. Dougherty, City Attomey May 21, 2008 Page 3 Analvsis 1. The Gun Club May Be Subject To A Naisance Action, Bnt There Is No Basis For A Nuisance Action Against The City. Minnesota Statutes Section 87A.06 (2007) pmvides: A person who owns, operates, or uses a shooting range in this state that is in compliance with shooting range performance standards is not subject to any nuisance action for damages or equitable relief based on noise or other matters regulated by the shooting range performance standazds. This section does not prohibit other actions. Thus, if the acoustical field test report is conect, and if the interim shooting range perfortnance standards are deemed to include the noise standards under Minnesota Statues Secrion 87A.05, then Section 87A.06 does not bar the developer or homeowners from bringing a nuisance action against the Gun Club. However, the Gun Club may have defenses against a nuisance action. To the extent the City does not "own, operate or use" the shooting range, there is no appazent basis for a nuisance action against the City. H. The City Did Not Violate Minnesota 5tatutes Section 87A.04 By Approving The Homestead Village Development, Even If The Development Caused The Shooting Range To Be Out Of Compliance With The Noise Standards. Minnesota Statutes Section 87A.04 (a) (2007) prohibits the City from approving any change in use, new development or construction of a structure on properry within 750 feet of the perimeter pmperiy line of an outdoor shooting range if such change in use, development, or construction would cause a shooting range in compiiance with Chapter 87A to become out of compliance. However, Section 87A.04 specifically exempts uses, developments and structures in euistence or for which appmval has been granted by October 1, 2005. The Preliminazy Planned Development Agreement for Homestead Viliage was recorded on May 9, 2005, and the Final Planned Development Ageement was recorded with the Plat on September 23, 2005, so the Homestead Village development is exempt from Minnesota Statutes Section 87A.04. Furthermore, both recorded documents contain Condition #9 providing "A notice of the existence of the gun club, its noise and hours of operation shall be included in the recorded planned development agreement, and in the developer sales materiai, which materials shall be submitted to the City for its approval." Minnesota Statutes Section 87A.04(b) (2007) pmvides protection to shooting ranges in connection with a change in use, new development, or construction on property within 750 feet of the perimeter pmperty line of an outdoor shooting range: A change in use, new development, or construcrion of a structure subject to ttris section may be approved if the person seeking the appmval or, at the discretion of the governing body, the approving authority agrees to provide any mitigation required to keep the range $KN90N, $=LpONl OOOCeE0.iY & MOI.Lmfth P.A. The person requesting an appmval subject to this section is responsible for providing documentation if no mitigation is required under this section. Failure to pmvide the documentation or any mitigation required under this section exempts the range from being found out of compliance with the shooting range performance and noise standazds of tlus chapter with regard to the property responsible for the mitigation if the failure to pmvide the documentation or required midgation is the sole basis for the range being out of compliance with the shooting range perfomiance standards. Any action brought by the owner of the property against the range is subject to section 87A.06 [irnmunity from nuisance actions]. With the permission of the range operator, any mitigation required under this section may be pmvided on the range property. Minnesota Statutes Section 87A.04(b) does not apply in this case, because approval for the Homestead Village development was granted by October 1, 2005. However, it illuminates the current public policy on this issue. III. The City Is Required To Allow The Gun Club To Conduct AddiHonal Shooting Activities Even If The Gun Club Is A Nonconforming Use, Provided The Gun Club Is In Compliance With Noise And Shooting Range Performance Standards. Minnesota Statutes Section 87A.03, Subdivision 2(2007), provides: A shooting range that is a nonconforming use shall be allowed to conduct additional shooting activities within the range's lawful property boundaries as of the date the range became a nonconforming use, pmvided the shooting range remains in compliance with noise and shooting range performance standards under this chapter. The apparent purpose of this section is to create an exception to the general rule that nonconfornvng uses may not be expanded. This section does not require the City to pmhibit a shooting range from conducting additional shooting activities in any event. IV. The Gun C?ub May Compty With The Noise Standard While Serving Its Current Patrons By Eapanding Its Hours Of Operation And Reducing The Sound Level. Minnesota Statutes Section 87A.03, Subdivision 1(2007), provides: A shooting range that operates in compliance with the shooting range performance standards must be permitted to do a11 of the following within its geographic boundaries, under the same or different ownership or occupancy, if done in accordance with shooting range performance standards: (1) operate the range and conduct activiries involving the discharge of firearms; SMMr.sM?n, Wura(tan&MO?MPA. Dougherty, City Attorney May 21, 2008 Page 5 (2) expand or increase its membership or opportunities for public participation related to the primary activity as a shooting range; (3) make those repairs or improvements desirable to meet or exceed requirements of shooting range performance standards; (4) increase events and ac6vities related to the primary activity as a shooting range; (5) conduct shooting activities and discharge fireazms daily between 7:00 a.m. and 10:00 p.m. A local unit of government with zoning jurisdiction over a shooring range may extend the hours of operation by the issuance of a special or conditional use permit; and (6) acquire addifional lands to be used for buffer wnes or noise mitigation efforts or to otherwise comply with this chapter. The Act provides the Gun Club with the legal right to expand its hours of operation, if the Gun Club operates in compliance with the shooting range performance standards. By expanding its hours of operation, the Gun Club may be able to bring the noise level into compliance with the statute. Chart on page 6 can help track your activities. Your toilet is not a garbage can. Do not flush anything besides human waste and toilet paper. No wet wipes, cigarette butts, disposal diapers, used medicine, feminine products or other trash! The system and septic tanks needs to be checked every 36 months Your service provider or pumper/maintainer should evaluate if your tank needs to be pumped more or less often. Seasonally or several times per year • Leaks. Check (listen. look) for leaks in toilets and dripping faucets. Repair leaks promptly. • Soil treatment area. Regularly check for wet or spongy soil around your soil treatment area. if surfaced sewage or strong odors are not corrected by pumping the tank or fixing broken caps and leaks, call your service professional. Untreated sewage may make humans and animals sick. Keep bikes, snowmobiles and other traffic off and control borrowing animals. • Alarms. Alarms signal when there is a problem; contact your service professional any time the alarm signals. • Lint filter. If you have a lint filter, check for lint buildup and clean when necessary. If you do not have one, consider adding one after washing machine. Effluent screen. If you do not have one, consider having one installed the next time the tank is cleaned along with an alarm. Annually • Water usage rate. A water meter or another device can be used to monitor your average daily water use. Compare your water usage rate to the design flow of your system (listed on the next page). Contact your septic professional if your average daily flow over the course of a month exceeds 70% of the design flow for your system. • Caps. Make sure that all caps and lids are intact and in place. Inspect for damaged caps at least every fall. Fix or replace damaged caps before winter to help prevent freezing issues. • Water conditioning devices. See Page 5 for a list of devices. When possible, program the recharge frequency based on water demand (gallons) rather than time (days). Recharging too frequently may negatively impact your septic system. Consider updating to demand operation if your system currently uses time, • Review your water usage rate. Review the Water Use Appliance chart on Page 5. Discuss any major changes with your service provider or pumper/maintainer. During each visit by a service provider or pumper/maintainer • Make sure that your service professional services the tank through the manhole. At each visit a written report/record must be provided to homeowner. Plumbing/Source of Wastewater • Review the Water Use Appliance Chart on Page 5 with homeowner. Discuss any changes in water use and the impact those changes may have on the septic system. • Review water usage rates (if available) with homeowner. Septic Tank/Pump Tanks • Manhole lid. A riser is recommended if the lid is not accessible from the ground surface. Insulate the riser cover for frost protection. • Liquid level. Check to make sure the tank is not leaking. The liquid level should be level with the bottom of the outlet pipe. (If the water level is below the bottom of the outlet pipe, the tank may not be watertight. If the water level is higher than the bottom of the outlet pipe of the tank, the effluent screen may need cleaning, or there may be ponding in the soil treatment area.) • Inspection pipes. Replace damaged or missing pipes and caps. Baffles. Check to make sure they are in place and attached, and that inlet/outlet baffles are clear of buildup or obstructions. • Effluent screen. Check to make sure it is in place; clean per manufacturer recommendation. Recommend retrofitted installation if one is not present. • Alarm. Verify that the alarm works. • Scum and sludge. Measure scum and sludge in each compartment of each septic and pump tank, pump if needed. Pump • Pump and controls. Check to make sure the pump and controls are operating correctly. • Pump vault. Check to make sure it is in place; clean per manufacturer recommendations. • Alarm. Verify that the alarm works. • Drainback. Check to make sure it is draining properly. • Event counter or elapsed time meter. Check to see if there is an event counter or elapsed time meter for the pump. If there is one or both, calculate the water usage rate and compare to the anticipated use listed on Design and Page 2. Unsettled solids can exit the tank and enter the soil treatment area. • Use of a garbage disposal is not recommended. • Minimize garbage disposal use. Compost instead. • To prevent solids from exiting the tank, have your tank pumped more frequently. - Add an effluent screen to your tank. Washing machine • Washing several loads on one day uses a lot of water and may overload your system. • Overloading your system may prevent solids from settling out in the tank. Unsettled solids can exit the tank and enter the soil treatment area. • Choose a front -loader or water -saving top -loader, these units use less water than older models. • Limit the addition of extra solids to your tank by using liquid or easily biodegradable detergents. Limit use of bleach -based detergents and fabric softeners. . Install a lint filter after the washer and an effluent screen to your tank • Wash only full loads and think even — spread your laundry loads throughout the week. Dishwasher • Powdered and/or high -phosphorus detergents can negatively impact the performance of your tank and soil treatment area. • New models promote "no scraping". They have a garbage disposal inside. • Use gel detergents. Powdered detergents may add solids to the tank. • Use detergents that are low or no -phosphorus. • Wash only full loads. • Scrape your dishes anyways to keep undigested solids out of your septic system. Grinder pump (in home) • Finely -ground solids may not settle. Unsettled solids can exit the tank and enter the soil treatment area. • Expand septic tank capacity by a factor of 1.5. • Include pump monitoring in your maintenance schedule to ensure that it is working properly. • Add an effluent screen. Large bathtub (whirlpool) • Large volume of water may overload your system. • Heavy use of bath oils and soaps can impact biological activity in your tank and soil treatment area. • Avoid using other water -use appliances at the same time. For example, don't wash clothes and take a bath at the same time. • Use oils, soaps, and cleaners in the bath or shower sparingly. In the code review summary provided, we listed this building as an A2 occupancy but realized that it's operation as a social club and training facility wasn't specifically listed in the IBC, Section 303, directly under any of the provided occupancy types. Since we didn't anticipate any design impacts regarding this classification versus the A3 occupancy type we didn't further scrutinize this selection. During the city's plan review process it has been brought to our attention that this choice of classification does have a code implication that would require the building to include a fire suppression system per IBC Section 903.2.1.2, a fact that was overlooked in the original code review. While the building and addition is a single story building and less than the 5,000 square foot threshold listed by this code section, it does have any occupant load of 225 occupants which is more than the 100 occupant threshold in the remaining condition triggering sprinklers. We further realize that this A2 classification would likely meet the 100 occupant threshold even without the addition. Since this facility is served by a private well and city services are quite a distance away, the provision of a fire suppression system is a significant addition to the overall project. CNH Architects has since looked into the occupancy classification in further detail, looking at the IBC and the IBC Commentary as well as further discussing the use of the building with the representatives of the West End Trap Club. Based on this review, I feel that reclassification as an A3 occupancy could be justifiable for the following reasons. First of all, in the IBC the A2 occupancy specifically lists the following uses: banquet halls, night clubs, restaurants, and taverns / bars. This facility does not fit specifically into these categories since it is a social club and doesn't have a kitchen to prepare foods like a restaurant, doesn't have musical entertainment or banquet rentals, and only serves beer as part of its social club operations. Further, the club has very limited hours with the majority of the use in the winter months only on Sundays, which is the period most likely to fill the building's interior space, as most members gather outside during the warmer weather as part of the trap shooting activities. The other significant use of the building, and one of the reasons for the addition, is the large gun safety classes that would be taught regularly in the club. If the facility doesn't specifically meet the uses listed under A2, the code would then refer to the A3 occupancy for "other assembly uses not classified elsewhere in Group A." We feel that some of the specifically listed A3 occupancies would likewise serve beer incuding uses such as bowling alleys, some community halls, and pool and billiard parlors. Given this more in-depth review of the operations of the West End Trap Club as well as the IBC Commentary, we are requesting that this facility be classified as an A3 occupancy. This is what I have found starting with the 2015 Minnesota Fire Code which references the 2012 International Fire Code. Section 5606 of the IFC states the following: 5606.1 General. Indoor storage and display of black powder, smokeless propellants and small arms ammunition shall comply with this section and NFPA 495. 5606.2 Prohibited storage. Small arms ammunition shall not be stored together with Division 1.1, Division 1.2 or Division 1.3 explosives unless the storage facility is suitable for the storage of explosive materials. Section 5606 goes on to provide additional information regarding storing in Group R or M occupancies but does not have any additional requirements relevant to this project. Paragraph 5606.2 doesn't apply to this project as the Trap Club doesn't store the ammunition along with any explosives. Consequently the governing regulation is the reference to NFPA 495. Excerpt from NFPA 495 — 2006 Edition 14.2 Small Arms Ammunition. 14.2.1 No restrictions shall be imposed on transportation of small arms ammunition other than those imposed by the U.S. Department of Transportation or by the presence of other hazardous materials. 14.2.2 No quantity limitations shall be imposed on the storage of small arms ammunition in warehouses, retail stores, and other occupancies other than those imposed by the limitations of the storage facility and by public safety regulations. 14.2.3 Small arms ammunition shall be separated from materials classified by the U.S. Department of Transportation as flammable liquids, flammable solids, and oxidizing materials by a distance of 4.6 m (15 ft) or by a fire partition having a fire resistance of at least 1 hour. 14.2.4 Small arms ammunition shall not be stored together with Division 1.1, Division 1.2, or Division 1.3 explosives, except where the storage facility is suitable for the storage of explosive materials. Looking at these two documents, I don't see any concerns relative to the storage of the small arms ammunition within this building. As requested, I also discussed with the representative of the Trap Club several other questions posed by the City of Eagan in your review. 1) The West End Trap Club does sell ammunition as a service to individuals shooting at the club. The club representative stated that there are typically a maximum of 80 to 100 flats in the building stored for sale to members. There are 10 cases per flat and 10 rounds per case resulting in 80,000 to 100,000 rounds total. 2) The representative of the West End Trap Club clarified that reloading of shells does not occur at the club. Small arms ammunition shall not be stored together with Division 1.1, Division 1.2 or Division 1.3 explosives unless the storage facility is suitable for the storage of explosive materials. Section 3306 goes on to provide additional information regarding storing in Group R or M occupancies but does not have any additional requirements relevant to this project. Paragraph 3306.2 doesn't apply to this project as the Trap Club doesn't store the ammunition along with any explosives. That really only leaves the reference to NFPA 495. Excerpt from NFPA 495 — 2006 Edition 14.2 Small Arms Ammunition. 14.2.1 No restrictions shall be imposed on transportation of small arms ammunition other than those imposed by the U.S. Department of Transportation or by the presence of other hazardous materials. 14.2.2 No quantity limitations shall be imposed on the storage of small arms ammunition in warehouses, retail stores, and other occupancies other than those imposed by the limitations of the storage facility and by public safety regulations. 14.2.3 Small arms ammunition shall be separated from materials classified by the U.S. Department of Transportation as flammable liquids, flammable solids, and oxidizing materials by a distance of 4.6 m (15 ft) or by a fire partition having a fire resistance of at least 1 hour. 14.2.4 Small arms ammunition shall not be stored together with Division 1.1, Division 1.2, or Division 1.3 explosives, except where the storage facility is suitable for the storage of explosive materials. Again, NFPA requires separating the storage of small arms ammunition from flammable liquids, flammable solids and oxidizers as well as all divisions of explosives. This doesn't apply to this project. Consequently, as Paragraph 14.2.2. indicates there is no quantity limitation in storing small arms ammunition. Given that there aren't limitation, do you want any changes to the Code Summary? If so let me know and I will update with a statement of no limitation. Looking at these two documents, I don't see any concerns relative to the storage of the small arms ammunition within this building. I did check to see typical ammunition storage quantities at the building. The club representative, Tom Wood, noted that there are 80 to 100 flats maximum ever in the building. In the course of the zoning review of the application, Planning and Engineering noted the section of the zoning code that requires utility hook up if services are available. We have been discussing the interpretation of what "available" means and, while the building is 350' from the property line, sewer and water are in the street by the property driveway. In response to the voicemail attached, I called Scott back and visited about the situation. He said they understood from their conversations with you that it would be an option to either hook up or insure they have a compliant, sufficiently sized well and septic system. He read me an email to that effect that he said he had gotten from you dated November 4, 2015. He said he currently understands they can upgrade their on-site system for approximately $24,000 and they are prepared to do that. He believes the estimate for sewer and water hook up, including connection charges and SAC charges would be around $170,000. Based on the perceived option to upgrade on-site, they've proceeded with design and related expenditures. I told Scott the Code appears to require hook up, but that I want to know more from you and what you understood at the time, before we confirm any final conclusions, but I'd get back to him after we've had a chance to talk. I've visited with John Gorder and he recalls visiting with you about the general issue last fall, but not specifics and he said he hopes you have records of the conversations and assumptions. Property was zoned Agricultural. By 1964, the property was zoned P, Park, which remains the zoning today. 1980 — Special Use Permit expanded to permit the addition of a third weekday evening, specifically Thursday. Condition required the Club to dedicate 40' half R -O -W for Gun Club Rd. to the north. (2010 Agenda memo clarifying days of operation indicates the Club operated historically on Sundays, Tuesdays, Wednesdays, and Thursdays.) 11/19/2002 — Variance approved for parking lot and access road performance standards (crushed rock vs. pavement w/ curb & gutter), ultimate NURP pond standards, and temporary sewer holding tank system. Gun Club was proposing to replace the four buildings with two new buildings -- a new clubhouse and an accessory structure for storage. The Nov. 2002 staff report identified that the property was not serviced by City sewer and water, and that the property was unplatted. The Variance was continued to 12/02/02 for further discussion on big picture issues with the property. The 12/02/02 CC Agenda Memo includes : "The proposed club house will require a new septic system to be installed and City staff has concern relating to such an investment when it is very likely that a utility extension from Red Pine Lane to the south will occur within the next three to six months to serve anticipated development on the Mr. Jim Oberg property [i.e. Red Pine Crossing]. Development of the Oberg property will result in utilities being extended and available to the Gun Club at their northern boundary. The City staff has previously investigated opportunities to extend City sewer and water utilities to the general area of Gun Club Rd. and 120th Street at the Rosemount border, which would provide the West End Hunting and Fishing Club and surrounding areas with sewer and water serviceability in accordance with the City's Comprehensive Plans." In the 12/02/02 City Council minutes, the Gun Club's representative stated "the Club would agree to install a holding tank and then connect to City services within 12 months of service availability. He further stated they would install a NURP pond and would pave the parking lot within 24 months of improved access being provided." The conditions of Variance approval do not specifically stipulate these improvements, but include "A development agreement shall be attached to the variance." However, I see no development agreement in the Variance file. The conditions also state "the applicant waives the right to appeal assessments at the time of public improvements." Was such a development agreement created, does it include a Waiver of Hearing for assessments, and does anyone have a copy of it? Ultimately, the new buildings were constructed, and apparently, issuance of the building permit was allowed on unplatted property, although Waiver of Platting was not specifically referenced in the report or City Council minutes. 2004-2005 — Adjacent property to the east was subdivided and developed as single-family (Long Acres and Homestead Village subdivisions). 2005 — State Shooting Range Protection Act implemented (May 28, 2005). 2008 — City Attorney memo interpreting state statutes with regard to Gun Club operations and noise (in response to alleged noise violations raised by developer of adjacent residential subdivision). Memo appears to indicate expansion of hours and operations is permitted, even where gun club is a nonconforming use provided it operates within shooting range performance standards. 2010- Clarification of conditions regarding days of operation to be limited to Sundays, Tuesdays, Wednesdays and Thursdays. Recent info indicates they are now operating on Mondays — not clear if they added Monday, or swapped Monday for one of those other days. Would a new CUP be needed to expand to additional days of operation? Or approval/clarification to alter which four days of the week they do operate? Or are City limitations on gun club operations moot, given the 2005 Statute which apparently gives gun club's the ability to expand? 2011? — Gun Club access relocated from Gun Club Road to Brooklyn Lane to the east. If the Club's operations are expanding now, does that raise the question again about the amount of traffic and the extension of 120th Street further west? 2016 — Proposal to expand clubhouse and parking: Site conditions today indicate the Club did not proceed with the phasing in of site improvements noted in the Council minutes — the parking lot remains crushed rock; we have no permit on file for installation of a septic tank so it may still be only the temporary "holding tank alluded to in 2002;" and the site is not connected to City utility services, which were not ultimately extended to the site from the north as anticipated, but sewer and water were installed within Brooklyn Lane adjacent to the property with residential development around 2005. I think the path is being clarified. • Utility Connection — We have confirmed the interpretation that availability of utility service includes consideration of the cost of connection. While utilities are available to an edge of the property, the 350' distance from the boundary to the building makes the cost of connection prohibitive and, therefore, staff has determined that connection would not be required for this project. • Property Platting —The City Attorney's office has confirmed that platting is necessary in order to take out a full building permit, but they have concluded that it would be possible for the Club's contractor to clarify the permit application to take out a footing and foundation permit in advance of completion of the plat process. Please work with Dale and Craig to provide the modified information that would be necessary to pull that part of the project out of the plans submitted to date. Please continue to work with them as well on the information necessary to finalize the rest of the building permit, so it's ready be released when the final plat is completed and recorded. • Platting Costs v. Area Charges — We have confirmed with Public Works that utility and storm water area charges would apply at the time of subdivision and connection charges would apply at the time of utility connection, whenever either would occur. Platting does not trigger them. So there will be the application fee and processing costs to complete the Final Plat application, as overviewed by Mike Ridley yesterday, but no area charges or connection charges to complete the process. • Building Type Determination — We made good progress in identifying the kinds of things that would help finalize a determination between an A-2 and A-3 occupancy. Tom and Steve, we'll look forward to seeing your narrative on gathering types, parameters and frequencies as soon as you can complete it. City engineering review has been completed and minor changes made to the plat. 2. Dakota County surveyor has completed their review and will provide release tomorrow morning. 3. The next step is to submit all items to the City of Eagan for approval by City Council. This involves the following: a. I will drop off the signed application form and deposit agreement forms at Rehder & Assoc tomorrow morning. b. Tom Wood — please drop of the check(s) made out to the City of Eagan to Greg Gentz at Rehder & Assoc offices tomorrow if possible. c. Greg Gentz will drop off all items at City Hall once he has the two items above in hand. 4. The City of Eagan will review the submitted applications and plat, and assuming all is in order, put the item on the next available City Council consent agenda for approval. 5. After City Council approval, mylar copies of the plats are made and these then need to be signed by the Owner and City. 6. Mylars are then dropped off at Dakota County and a receipt is provided. 7. A copy of this Dakota County receipt is given to the City of Eagan completing the plat process. 8. At this time a building permit can be issued. Depending on City Council meeting dates and agenda submittal deadlines, my estimate is that the above steps will likely take about 2 %2 weeks.
