SUMMARY OF REOUEST
The applicant is requesting a building move permit to relocate a 40' x 28' garage from 810 Lone
Oak Road to 710 Lone Oak Road legally described as Lot 012, Block 00, Moss Addition (P.I.D. #10
48700 012 00).
AUTHORITY FOR REVIEW
NlovinE Permits - City Code Chapter 4, Section 4.10, gives the Protective Inspections Division
authority to issue permits to move a building and authorizes the City Council to issue a permit to
move a building to a location within the City. City Code Chapter 4, Section 4.10, Subd. 13 states
that a moving permit shall be denied for any one of the following reasons:
A. the applicant has not complied with any requirement of this section.
B. persons or property in the City would be endangered by moving the building.
C. the building is in such state of deterioration or disrepair or is otherwise so structurally unsafe
that it would constitute a danger to persons or property in the City.
D. the building is structurally unsafe or unfit for the purpose for which it is moved.
E. the equipment for moving is unsafe and persons and property would be endangered by its
use.

E. the building or its use would not be in compliance with zoning, building codes or other
provisions of the City Code.
G. if the building to be moved is in substantial variance with either the established or the
expected pattem of building development within the neighborhood to which the building is
to be moved. Comparative age, bulk, architectural style and quality of construction of both
the building to be moved and the other buildings in the neighborhood shall be considered in
determining whether a building is in substantial variance. If the building to be moved is
more than ten years older than the oldest building situated on lands abutting the land to
which the building is to be moved, such fact sha11 be evidence that the building to be moved
is in substantial variance.
EXISTING CONDITIONS
The subject site is a parcel consisting of a single family dwelling constructed in 1961 with an
addition in 1990.
EVALUATION OF REOUEST
Mr. Winzig is requesting that a moving permit be issued to him for the purpose of relocating a
garage from 810 Lone Oak Road to his residence at 710 Lone Oak Road.
All building setback requirements are met. A site inspection by the Protective Inspections Division
revealed no additional modifications would be required to meet the current code criterion; however,
a building permit will be required for a new concrete foundation for the structure.
City Code Section 4.10, Subd. 13G prohibits relocation of a building more than ten years older than
the oldest building situated on lands abutting the land to which the building is to be moved.
The garage was constructed in 1986. Buildings on land abutting the applicants are older than two
years; therefore, the proposal meets the requirement of Subd. 13G of the Eagan City Code.
Police Captan Swanson and City Engineer Matthys have reviewed and granted their approvals as
required in Section 4.10, Subd. 4c.
SUMMARY/CONCLUSION
Mr. Winzig is requesting to move an 1120 sq. ft. garage to his property at 710 Lone Oak Road.
Approval is required from the City Council for movement of any building within the City. The
request is consistent with all seven requirements listed in City Code Chapter 4, Section 4.10.
ACTION TO BE CONSIDERED
To approve/deny a building permit to move a bam from 810 Lone Oak Road to 710 Lone Oak Road
Road subject to the following condition:
A building permit for the foundation would be applied for and issued prior to construction.

It is hereby agreed that DAKOTA COUNTY, a municipal wrporation of the State of Minnesota
(Seiler), in consideration of the sum of One aad No/100 Dollar ($1.00) and other good and
valuable consideration paid to it by OTTING HOUSE MOVERS, 11640 East 275th Street,
Lakeville, Mianesota 55044 (Buyer), the receipt of wluch is hereby acknowledged, does hereby
grant, bargain, sell and convey onto Buyer, its successors and assigns, a four car, wood frame,
detached gazage located at 810 Lone Oak Road in Eagan, Minnesota.
To have and to hold the same, onto the Buyer, its successors and assigns, forever. Selter
covenants and agrees that it is the owner of the above-described personal property and has the
lega] right to sell the pmperty and that the same is free from all encumbrances.
THIS CONVEYANCE IS MADE WiTHOUT REPRESENTAI70N OR WARR.ANTY OF
ANY KIND. SELLER SPECIFICALLY DISCLAIMS ANY WARRANT OF
MERCHANTABII,ITY, WARRANTY OR FITNESS FOR A PARTICULAR PURPOSE AND
ANY OTHER WARRANTY, EITHER IMPLIED OR EXPRESSED.
The property is conveyed AS IS AND WITH ALL FAULTS. Risk of loss and liability for
damages to person or property caused by collapse of the structure due to natural causes or actions
of the Buyer traasfers immediaiely upon execution of this Bill of Sale.
Buyer agrees to hold Dakota County harmless from any losses, claims or causes of action arising
out of the collapse or destruction of the structure by natural causes or by actions of the Buyer.
Buyer further agrees to remove the structure from County right-of-way on or before
September 1, 1998, at Buyer's sole cost and expense.
