Zoning Classification
Dear Mr. Metz:
At the final assessment hearing held for Project 381 on August 7,
1984, your attorney, Mr. Howard A. Knutson, submitted a request to
have your property assessed at its present single-family residen-
tial use instead of the light industrial classification consistent
with its present zoning. Similarly, on September 18, there will
be a final assessment hearing held for Project 391 which proposes
to assess your property again on the light industrial zoned
classification rates in lieu of the present residential zoned usage.
However, in accordance with the attached special assessment policy
#82-2, you may elect to have the assessments levied at the
single-family residential zoned rate if you execute, notarize and
return the enclosed agreement which gives the City the right to
assess the difference at a later date when, and if, the land use
changes to become consistent with the current zoning.
Please note that I have included one agreement for each of the.
above-referenced projects. Based on the assumption that we will
receive both of these agreements executed and notarized by Septem-
ber 10, I will proceed with the adjustment of the final assessment
rates as follows:

A number of complaints have been referred to the City of Eagan
regarding the improper storage of vehicles (Volkswagon cars and
vans) at 810 Lone Oak Road. This property is presently owned by
Melvin and Martha Metz and is zoned "light industrial".
Pursuant to Eagan's City Code, Chapter 11, Subdivision 16, it is
not permissible to. store vehicles outside of a building without
the issuance of a conditional use permit by the Eagan City
Council. In a letter dated August 22, 1985, Zoning Administrator
Sturm informed the Metz's that the outside storage of vehicles in
a light industrial district rendered them in noncompliance with
the Eagan City Code. In a letter dated April 25, 1986, Sergeant
Greg Johnson, of the Eagan Police Department, informed the Metz's
that a conditional use permit would have to be obtained for the
continued outside storage of vehicles and related business activi-
ties. Sergeant Johnson also indicated in his letter that the
filing for a conditional use permit must occur by May 16, 1986 to
avoid a citation. In an unrelated event, Sergeant Johnson did
issue a citation on Monday, April 28, 1986 when an inoperable dune
buggy and two unlicensed Volkswagon vans were found on the Metz
property.
There are two issues presently related to the Metz property at 810
Lone Oak Road. The first is the outside storage of vehicles in a
light industrial area without a conditional use permit. The
second issue is the presence of undesirable and inoperable vehicles
at the site.
The Metz's have been cited for the presence of inoperable and
undesirable vehicles being located at their property and have
until May 16 to file for a conditional use permit to avoid
citation regarding the outside storage of vehicles in a light
industrial area. The Planning Department may want to reevaluate
this situation when and if the Metz's fail to apply for a
conditional use permit on or before May 16.

Last Spring I warned Melvin Metz at 810 Lone Oak
about several unlicensed, unoperable cars on his
property. He had several licensed and operable
and got rid of one of them.
The question concerning operating a parttime
business due to the zoning of that area as light
industrial was referred to zoninq. Jim Sturm
sent a letter to the Metz's in August. Apparently
the Metz's were required to get a permit. They
never did.
I spoke to Mrs. Metz at 810 Lone Oak on Friday,
April 25, 1986. I discovered an inoperable dune
bugqy and two unlicensed V.W. vans. I gave Mrs.
Metz until Monday to correct these.
I spoke to Jim Sturm and discovered that the Metz's
are in violation of Chapter 11, Subd. 16, dealing
with displaying items publicly for sale. I sent
a letter to the Metz's explaining my position on
this area. (See attached letter.)
I have advised them in my letter that if they do
not have a permit or do not clean up the cars,
they will be issued a citation. They have until
May 16, 1986 to comply.

It is our opinion that according to our City

repairing and selling cars at your residence.

SUBJECT: AUTO REPAIR AND SALVAGE QUESTIONS
This memo is intended to respond to the questions you raised
regarding the Volkswagon repair shop and wrecked cars off of
Highway 149.
With respect to the Volkswagon shop, Jim Sturm and i viewed the
site and a letter was forwarded indicating concerns about the
outside storage and possible screening. The owner is Mr. Melvin
Metz who seems cooperative, but has received no complaints
personally. Jim has offered to visit with Mr. Metz and encourage
him to screen better and reduce clutter in the yard. Jim
indicates, however, that the zoning in the area is light
industrial and auto repair is a permitted use. Therefore, Jim
will try to encourage appropriate changes rather than force them.
As to the salvage vehicles on Highway 149, Captain Geagan
indicates that the owners were contacted about the problem and
had removed all vehicles for a period of time. They were taken
• to the Mendota Getty station that then went out of business.
This necessitated the return of the vehicles. A second contact
has resulted in the removal of some of the vehicles. Seven or
eight remain and the owner has promised to move the rest by
September 10, 1965.

I am returning to your attention the original special assessment
agreement which you executed which would allow the City to assess
your property for its existing single-family use instead of
the Light Industrial zoning currently carried by the property.
While you properly executed the agreement, you failed to have
it notarized which is a requirement for this agreement to be
recorded at Dakota County. Therefore, will you please arrange
to have both agreements notarized and returned to my attention
as soon as possible so that we may correct the final assessment
rolls accordingly and record this agreement at Dakota County.
The City of Eagan has several notary publics on its staff available
at no charge for your use. However, you will have to come to
City Hall and duplicate your signature for one of the notaries
to witness and document it.
I apologize for any inconvenience this may create, but it is
a procedural necessity which we must comply with.

Dear Mr. Metz:
At the final assessment hearing held for Project 381 on August 7,
1984, your attorney, Mr. Howard A. Knutson, submitted a request to
have your property assessed at its present single-family residen-
tial use instead of the light industrial classification consistent
with its present zoning. Similarly, on September 18, there will
be a final assessment hearing held for Project 391 which proposes
to assess your property again on the light industrial zoned
classification rates in lieu of the present residential zoned usage.
However, in accordance with the attached special assessment policy
#82-2, you may elect to have the assessments levied at the
single-family residential zoned rate if you execute, notarize and
return the enclosed agreement which gives the City the right to
assess the difference at a later date when, and if, the land use
changes to become consistent with the current zoning.
Please note that I have included one agreement for each of the
above-referenced projects. Based on the assumption that we will
receive both of these agreements executed and notarized by Septem-
ber 10, I will proceed with the adjustment of the final assessment
rates as follows:

Based on the information above, you can see the cost savings
that can be realized from signing the attached agreement and
returning it to my attention by September 10. The City will
then record this agreement at the County under your legal descrip-
tion so that the City can retain the right to collect the differ-
ence for this partial deferment at a later date should the use
of the property change to be consistent with its current zoning.
Please be informed that the final assessment hearing for Project
391 is scheduled to be held on September 18.

WHEREAS, the City proposes to assess the following described premises

successors, and assigns, that if the aetual use of said property is changed in

POLICY: Where the existing land use is different (less than the high-
est and best use pezmitted by current zoning) than the current
underlying zoning, all trunk area and/or latPSal benefit assess-

agreement is notorized and executed by all persons holding in-
