Safety 1. Traffic shall be allowed to pass and to be protected at all times. If it
is not possible to allow traffic to pass, a suitable detour must be provided
and plans submitted to the Director of Public Works 72 hours in advance.
2. Barricades shall be erected in a manner which will provide suitable visibility
in all directions as shown on Std. Plate P-1. All- barricades sha11 be in
good condition, and all signs sha11 be of such size and legibility to provide
adequate warning to oncoming traffic. At least two 7" flashing amber lights
sha11 be mounted on each end barricade with one on an advance warning sign.
3. Excavations must be shored or sheeted when necessary to prevent under-mining
of roadway or other utilities, or for safety reasons.
4. No guys or stays to be attached to trees on right-of-way.
5. Flagmen shall be furnished by the party or organization performing the work
whenever the work being done creates a hazard either to the traffic using
said road or the personnel engaged in the construction, or when directed
to do so by the City.
OPERATIONS
1• Permit on Job--PeYmits or copies shall be kept on the site of the work while
it is in progress in the custody of the individual in charge, and shall
be exhibited upon request made by any City official.
2. Provisions and Specifications--These general provisions, specifications
and Std. Plate P-1 shall be considered as forming an integral part of each
and every permit issued for operations with Eagan. The work authorized
by this permit shall be done at such time and in such manner as shall be
consistent with the safety of the public and shall conform to all requirements
and standards of the City. If at any time it shall be found by the City
that the work is not being or has not been properly performed, the permittee,
upon being notified by the City in writing, shall immediately take the necessary
steps, at his own expense, to place the work in condition to conform to
said requirements or standards.
3. Execution--The permittee shall use diligence in the execution of the work
authorized under this permit in order not to endanger or unnecessarily obstruct
travel along any roadway. Operations shall be so condUCted at all times
as to permit safe and reasonable free travel over the roads within the limits
of the work herein prescribed. All safety measures for the free movement
of traffic shall be provided by the permittee at his own cost.
4. Conformity to Laws--The installation shall be made in conformity with all
applicable laws, regulations and codes covering said installations. All
installations shall be made in conformity with regulations of governmental
agencies for the protection of the public.. .
a. The applicant shall---.furnish a bond in the amount of $1,000 which -is
required to insure a,dequate & timely completion of street repair. This
bond shall remain in effect for 1 year subsequent to completion of street
repair -to--protect the City from settlement resulting from poor or improper
backfill compaction.
b. The applicant shall furnish evidence of public liability insurance of
not less than $100,000/300,000 and property damage of not less than
$25,000 issued by an insurance company authorized to do business in
the State of Minnesota on which the City is named as a co-insured.

c. Except for the negligent acts of the City, its agents and its employees,
the permittee shall assume all liability for, and save the City, its agents
and its employees, harmless from any and all claims for damages, actions
or causes of action arising out of the work to be done herein and the
continuing uses by the permittee, including but not limited to the placing,
constructing, and reconstructing, maintaining and using of said utility
under this application and permit for construction.
5. Existing Facilities--The utility facility and installations shall not interfere
with any existing utility facility on the City's right-of-way.
6. Private Property--The work permit or permit for construction as issued does
not in any way imply an easement on private property.
7. Quality of Work--Finished surface, base and sub-base of road upon completion
of work shall be at least equal to or better than specifications of original
road in accordance with City Standard Specifications. Surface shall be finished
within 48 hours upon completion of backfill.
8. Cutting Trees--The permission herein granted does not confer upon the permittee
the right to cut, remove or destroy trees or shrubbery within the legal limits
of the roadway or relieve permittee from obtaining any consent otherwise required
from the owner of the property adjacent thereto.
9. Drainage--All waterways and lines of drainage shall remain operative.
10. Pole Anchors--No pole anchors, anchors, braces or other construction to be
put on roadway shoulder, except by permit authorization.
11. Driving Limitations--No driving onto highway from ditch or driving on shoulders
or over curbs where damage will occur.
12. Lugs on Equipment--No lugs sha11 be used on equipment traversing road which
will damage the road surface.
13. Clean-Up--Street surface and roadside shall be cleaned after construction
is completed and left in a neat and presentable condition.
14. Trees and Vegetations--Burning or disking operations and/or the use of chemicals
to control or kill trees, brush and other vegetation is prohibited without
prior approval from the City.
15. Replacement of Sod--Wherever top-soil and sod are disturbed, they shall be
replaced and maintained satisfactorily until the turf is established.

APPLICATION SUMMARY: The applicant, Wayne Hoovestol, is request-
ing a Special Permit to locate a mobile office unit at 900 Lone
Oak Road for temporary office space.
EXISTING CONDITIONS: Currently, the property is zoned I-1
(Limited Industrial) and is surrounded by Eagandale Center In-
dustrial Park No. 3. The unplatted parcel has an existing house
which is being used as rental property upstairs for two oc-
cupants, and as a drivers lounge in the basement level for the
owners trucking company, Paradis Trucking. The site is not
serviced by City sewer and water.
Hoovestol Inc. is a contract hauler for the U.S. Postal Service
serving the Bulk Mail Center located at 3165 Lexington Avenue in
Eagan. The applicants service facility for their vehicles is lo-
cated at 2950 Lone Oak Circle, and the current leased office
space is located at 3300 Terminal Drive.
COMMENTS: The applicant is proposing to place the temporary
mobile office space near the NE corner of the lot. The removal
of approximately 8 trees would be necessary for this placement.
The applicant intends to have four or five employees at this
location and is requesting a two year Special Permit.
If approved the Special Permit shall be subject to the following
conditions:
1. Building plans must be submitted and meet all applicable
State Building Code.
2. A parking plan must be submitted to the planning staff.
3. All applicable Code requirements must be met.

BATTERY CASINGS IN I.S.T.S.
Jon, attached you will find a letter from Barry Schade, Dakota County Director of Environmental
Management. Bany has had a number of contacts with Gail McMahon regarding excavation of
battery casings on her property at 1429 Lone Oak Road.
As you can see by Barry's letter, the County has identified ten sites in Eagan that used battery
casings in the conshuction of individual sewage treatment systems (I.S.T.S.). It appears that four
of ten sites are still pending, or casings remain on-site. Based on this information, I believe we
should place a waming flag on lots containing battery casings that haven't been mitigated, as well
as place a copy of Barry's letter in the relevant parcel files. A wanung flag on the PIMS system
would allow us to inform individuals requesting permits of this issue.
Barry has indicated that sites containing battery casings usually don't need to be mitigated until
they are disturbed. Once they are discovered, it is Dakota County's policy to require the property
owner to record this information with the property data base at Dakota County.
If you need additional information or if you feel our plan of action needs to be modified, please
advise.

Dear Ms. McMahon:
Enciosed are the analytical reports for the samples of water, house dust, and
soils collected from your residence on January 9, 2004. The results indicate that
the interior dusts and the well water supply are free of lead contamination. The
soils collected from the soil/battery casing stockpile in your backyard contained
significant levels of lead.
This suggests that lead from the soil/battery casing stocfcpile has not been
transported into your house and has not impacted the well water supply.
However, the lead in the soil/battery casing stockpile represents risk to human
health and measures should be taken to reduce the potential for exposure to this
lead source. While the plastic cover placed over the stodcpile has served to
reduce the potential for direct contact with the lead, bare soils contaminated with
lead are accessible to direct contact or through wind dispersal. We recommend
placing additionat plastic sheeting on the stockpile to further reduce the exposure
to the lead contaminated waste and soils. We also recommend that you limit the
use of the backdoor and install additional fencing around the stockpile to prevent
inadvertent contact with the stockpile.
Also enclosed is the list you requested of other situations the County has
encountered where battery casings have been used in the construction of ISTS's
(individual sewage treatment systems).
